BANK OF CANADA ACT

Policy for buying and selling securities

The Governor of the Bank of Canada establishes this policy pursuant to subsection 18.1(1) of the Bank of Canada Act, for buying and selling securities and financial instruments for the purposes set out in paragraph 18(g)(i) of the Act. This policy sets out the range of securities and instruments that the Bank will use for certain types of transactions but it in no way obligates the Bank to accept the full range of securities and instruments for any particular transaction. Nor does this policy in any way restrict the securities and instruments in which the Bank may transact pursuant to its statutory powers other than those powers set out in paragraph 18(g)(i) of the Act, including, without limitation, paragraph 18(g)(ii).

Purposes and types of financial transactions under paragraph 18(g)(i)

Pursuant to paragraph 18(g)(i) of the Act, the Bank may buy and sell securities and instruments, other than instruments that evidence an ownership interest in an entity, for purposes of conducting monetary policy or promoting the stability of the Canadian financial system. In conducting monetary policy and promoting the stability of the Canadian financial system, the Bank buys and sells securities and instruments through purchase and resale transactions (buybacks). The Bank determines, at its sole discretion, when it will engage in buybacks and the securities and instruments which it will use, within the range of securities and instruments set out below.

Transactions in the normal course

In the normal course, the Bank engages in buyback transactions with primary dealers for purposes of implementing monetary policy, when it feels that market conditions warrant such transactions. The Bank will normally buy and sell Government of Canada bonds and treasury bills in such transactions. Buyback transactions normally have a duration of one business day (being a day on which there is a clearing of payment items pursuant to the Canadian Payments Act) but the Bank may from time to time conduct buybacks in the normal course for longer terms.

Exceptional transactions

The Bank may also engage in buyback transactions for purposes of addressing a situation of financial system stress that could have material macroeconomic consequences. In buyback transactions for this purpose, the Bank may expand the range of securities and instruments that it will buy and sell beyond Government of Canada bonds and treasury bills to include any or all of the following securities and instruments:

  • any security issued or guaranteed by the Government of Canada or a provincial government;
  • securities issued or guaranteed by the U.S. Government;
  • securities issued or guaranteed by member states of the Organization for Economic Cooperation and Development (OECD), including Canadian dollar securities issued or guaranteed by member states of the OECD;
  • Canadian dollar corporate and municipal bonds, including Canadian dollar bonds issued by foreign entities;
  • Canadian dollar bankers acceptances with a term to maturity not exceeding 365 days;
  • Canadian dollar promissory notes with a term to maturity not exceeding 365 days;
  • Canadian dollar commercial paper, including asset-backed commercial paper, with a term to maturity not exceeding 365 days; and
  • Canadian dollar term asset-backed securities,

provided that the securities or instruments meet such applicable conditions and criteria as may be published by the Bank from time to time, including, without limitation, credit rating requirements. (Such buyback transactions conducted for this purpose and using an expanded range of securities or instruments to be referred to as “exceptional transactions.”)

Exceptional transactions will be conducted with such counterparties and will be for such duration as the Bank chooses, subject to a maximum term for any transaction of 180 days. The Bank will publicly announce in advance when it intends to conduct exceptional transactions, the range of counterparties with whom it will transact, the securities or instruments that it will use in the transactions, the term of the transactions and any other terms that it considers appropriate.

Resort by the Bank to exceptional transactions is distinct from, and does not take the place of, the Bank’s power under paragraph 18(g)(ii) to buy and sell any securities and other financial instruments where the Governor is of the opinion that there is severe and unusual stress on a financial market or the financial system. (see footnote 1)

Terms and arrangements for counterparties

In order to be eligible to be a counterparty in normal course buyback transactions or exceptional transactions with the Bank, an entity must first make appropriate arrangements with the Bank, including, without limitation, operational arrangements and entering into the Bank’s legal agreements.

In addition to this policy, all transactions for the purchase and sale of securities are subject to such policies, rules and terms pertaining to that transaction as the Bank may publish from time to time.

Coming into force of the policy

This policy comes into force on the later of

(a) as provided in subsection 18.1(2) of the Bank of Canada Act, seven days after the day on which the Bank publishes it in the Canada Gazette; and

(b) the day on which sections 146 and 147 of the Budget Implementation Act, S.C. 2008, c. 28, come into force.

11.2. The Permittee shall ensure that all contractors involved in the loading or disposal for which the permit is issued are made aware of the conditions identified in the permit and of the possible consequences of any violation of these conditions.

11.3. The Permittee shall ensure that a copy of the permit and of the letter of transmittal is displayed at each loading site, on all towing vessels, loading platforms and equipment involved in disposal at sea activities.

11.4. The Permittee shall inform Environment Canada’s Environmental Enforcement Division, Pacific and Yukon Region, by fax at 604-666-9059 or by email at das.pyr@ec.gc.ca prior to, and within 48 hours of, any loading for disposal.

11.5.  5. Disposal Site(s): 49°24.75′ N, 54°50.40′ W, at an approximate depth of 60 m.

 6. Route to Disposal Site(s): Most direct navigational route from the loading site to the disposal site.

 7. Equipment: Vessels, barges or other floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved disposal site.

 8. Method of Disposal: The material to be disposed of shall be discharged from the equipment or vessel while steaming within 300 m of the approved disposal site. Disposal will take place in a manner which will promote the greatest degree of dispersion. All vessels will operate at maximum safe speed while discharging offal.

 9. Rate of Disposal: As required by normal operations.

10. Total Quantity to Be Disposed of: Not to exceed 750 tonnes.

11. Material to Be Disposed of: Fish waste and other organic matter resulting from industrial fish-processing operations.

12. Requirements and Restrictions:

12.1. It is required that the Permittee report, in writing, to Mr. Rick Wadman, Environmental Protection Operations Directorate, Environment Canada, 6 Bruce Street, Mount Pearl, Newfoundland and Labrador A1N 4T3, 709-772-5097 (fax), rick.wadman@ec.gc.ca (email), at least 48 hours prior to the start of the first disposal operation to be conducted under this permit.

12.2. A written report shall be submitted to Mr. Rick Wadman, identified in paragraph 12.1, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity and type of material disposed of pursuant to the permit and the dates on which the loading and disposal activities occurred.

12.3. It is required that the Permittee admit any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999 to any place, ship or structure directly related to the loading or disposal at sea referred to under this permit, at any reasonable time throughout the duration of this permit.

12.4. The loading and transit of waste material to the disposal site must be conducted in such a manner that no material enters the marine environment. Waste material spilled at any place other than the permitted disposal site must be retrieved. All waste must be contained on shore while the barge is away from the loading site.

12.5. The material to be disposed of shall be covered by netting or other material to prevent access by gulls, except during direct loading or disposal of the material.

12.6. This permit must be displayed in an area of the plant accessible to the public.

12.7. The loading or disposal at sea referred to under this permit shall not be carried out without written authorization from the Permittee.

12.8. Material loaded for the purpose of disposal at sea may not be held aboard any vessel for more than 96 hours without the written consent of an enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999.

 6. Route to Disposal Site(s): Most direct navigational route from the loading site to the disposal site.

 7. Equipment: Vessels, barges or other floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved disposal site.

 8. Method of Disposal: The material to be disposed of shall be discharged from the equipment or vessel while steaming within 300 m of the approved disposal site.  7. Equipment: Vessels, barges or other floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved disposal site.

Order 2008-87-05-02 Amending the Non-domestic Substances List

Whereas, pursuant to subsections 87(1) and (5) of the Canadian Environmental Protection Act, 1999 (see footnote a), the Minister of the Environment has added the substances referred to in the annexed Order to the Domestic Substances List (see footnote b);

Therefore, the Minister of the Environment, pursuant to subsections 87(1) and (5) of the Canadian Environmental Protection Act, 1999a, hereby makes the annexed Order 2008-87-05-02 Amending the Non-domestic Substances List.

(Section 110 of the Canadian Environmental
Protection Act, 1999
)

Whereas the Minister of the Environment and the Minister of Health have assessed information in respect of the living organism Carthamus tinctorius L.S-317 - 4206-8A;

Whereas the living organism is not on the Domestic Substances List;

And whereas the Ministers suspect that a significant new activity in relation to the living organism may result in the living organism becoming toxic under the Canadian Environmental Protection Act, 1999,

Therefore, the Minister of the Environment indicates, pursuant to section 110 of that Act, that subsection 106(4) of the same Act applies with respect to the living organism in accordance with the Annex.

ANNEX

Information Requirements

(Section 110 of the Canadian Environmental
Protection Act, 1999
)

1. In relation to the living organism Carthamus tinctorius L.S-317 - 4206-8A, a significant new activity is any activity involving the living organism other than the following:

(a) its processing by dry milling;

(b) its export, before or after it has been dry milled; or

(c) the burial of the living organism or of solid wastes resulting from dry milling of the living organism at a depth of at least one metre in a landfill site authorized by the laws, regulations and other requirements of the jurisdiction where the burial will take place.

2. A person that proposes a significant new activity set out in the Notice for this living organism shall provide to the Minister of the Environment, at least 120 days prior to the commencement of the proposed significant new activity, the following information:

(a) a description of the proposed significant new activity in relation to the living organism;

(b) in relation to a significant new activity involving the processing of the living organism:

(i) a description of the processing location of the living organism;

(ii) a description of the processing methods and of quality control and quality assurance procedures;

(iii) the information specified in paragraphs 2(d) and (e) of Schedule 5 of the New Substances Notification Regulations (Organisms); and

(c) in relation to any other significant new activity:

(i) the information specified in items 3, 4, 5, 7 and 9 of Schedule 5 to those Regulations; and

(ii) in respect of the oleosin-carp growth hormone fusion protein produced by the living organism:

(A) test data from a biodegradation study conducted according to the methodology described in the Organisation for Economic Co-operation and Development (OECD) Test Guideline No. 308 entitled Aerobic and Anaerobic Transformation in Aquatic Sediment Systems;

(B) test data from a chronic toxicity study conducted according to the methodology described in the OECD Test Guideline No. 210 entitled Fish, Early-life Stage Toxicity Test and in conformity with the practices described in the “OECD Principles of Good Laboratory Practice” set out in Annex 2 of the Decision of the Council Concerning the Mutual Acceptance of Data in the Assessment of Chemicals, adopted on May 12, 1981, and that are current at the time the test data are developed; and

(C) test data from a chronic toxicity study and depending on the most significant route of exposure to the environment, conducted according to the methodology described in the OECD Test Guideline No. 218 entitled Sediment-Water Chironomid Toxicity Test Using Spiked Sediment or OECD Test Guideline No. 222 entitled Earthworm Reproduction Test (Eisenia fetida/Eisenia andrei) and in conformity with the practices described in the “OECD Principles of Good Laboratory Practice” set out in Annex 2 of the Decision of the Council Concerning the Mutual Acceptance of Data in the Assessment of Chemicals, adopted on May 12, 1981, and that are current at the time the test data are developed, or a similar study, which will permit assessment of the chronic toxicity of the oleosin-carp growth hormone fusion protein.

3. The above information will be assessed within 120 days after the day on which it is received by the Minister of the Environment.

CUSTOMS TARIFF

Invitation to submit comments on extension of most-favoured-nation tariff treatment to Libya

The purpose of this notice is to inform interested parties that it is the Government’s intention to extend most-favoured-nation (MFN) tariff treatment to Libya. Comments and enquiries from interested parties are welcomed and should be made in accordance with the procedures set out below.

Background

Libya is one of only two countries whose products are subject to Canada’s General Tariff. Under the General Tariff, most imports are subject to an import duty of 35%, which is higher than the average MFN tariff of 5.5%. Under its World Trade Organization (WTO) obligations, Canada grants MFN tariff treatment to all its trading partners that are members of that organization. In the past, Canada has also extended MFN tariff treatment to states not members of the WTO in the context of bilateral MFN agreements.

Libya first applied to become a WTO member in 2001. In 2004, Canada and other WTO members granted observer status to Libya and agreed to start talks on its membership bid. Other trading partners have already granted MFN tariff treatment to Libya in advance of its WTO membership, including the United States and the European Union.

Relations with Libya have been normalized, as demonstrated by the appointment of a resident ambassador in Tripoli in 2004 and the designation of a Libyan ambassador in Ottawa in 2005. Canada and Libya are cooperating on a variety of subjects such as Darfur, culture and the fight against terrorism. There is commercial interest on both sides to expand on bilateral commercial activities.

Foreign Affairs and International Trade Canada is actively working to enhance Canada’s commercial relations with Libya, and better position Canadian companies to take advantage of the numerous opportunities in this market. In 2005, Libya unilaterally reduced its customs tariff on Canadian goods to zero (except for cigarettes) and established a port service tax of 4% instead. As such, Canadian exports to Libya currently benefit from low import charges as a result of these unilateral Libyan actions.

Canadian merchandise exports to Libya increased from $67 million in 2006 to $196 million in 2007, due to an increase in exports of aircraft and spacecraft products, which was Canada’s main export to Libya, followed by cereals, mineral ores, and machinery and equipment. Value of imports from Libya vary widely from year to year, but remain relatively low. They are mostly made up of mineral fuel and oil.

It is intended that the proposed extension of MFN tariff treatment be implemented through an Order in Council made pursuant to the Customs Tariff. Given current trade patterns, the expected annual amount of duty foregone is minimal.

Notice No. SMBR-003-08 — Changes to the domestic protection criteria for FM broadcast stations

Industry Canada is hereby giving advance notice that the domestic protection criteria for FM stations as set forth in Broadcast Procedures and Rules, Part 3: Application Procedures and Rules for FM Broadcasting Undertakings (BPR-3), will be amended to promote a more efficient use of increasingly scarce FM broadcast spectrum.

The amended protection criteria will come into effect on January 1, 2011 and will address the following

  • existing stations will be protected to their 54 dBµV/m service contour as per the official coverage map or based on the interference criteria set forth in BPR-3, section C-1.1.17, whichever provides the greater protection. When the service contour of the existing station is calculated using the propagation method as outlined in section C-3.2.1(c) of BPR-3, it will be protected and interference from the incoming station will be calculated using the F(50,10) propagation curves.
  • in cases where the 54 dBµV/m contour of the existing station extends beyond the distances given in section C-1.2.2 of BPR-3, protection will only be based on the applicable distances for the station class.
  • existing stations will retain the right to increase parameters to the maximum permitted for their class (unless limitations were applied when the technical certificate was issued) and the incoming station will be required to accept any additional interference that may occur under these circumstances as outlined in BPR-3, section C-1.5. Until the abovementioned deadline, broadcasters are encouraged to increase the parameters of their stations to the maximum permitted. Applications filed prior to the deadline will be treated under the current criteria and this will be valid until the CRTC has rendered its decision on the application.
  • most limitations on existing stations are currently predicated on protecting the other existing stations to the maximum parameters of their class. After the above deadline, the Department will entertain requests for limitation changes based on the new criteria on a case-by-case basis.
  • international protection of Canadian stations from U.S. stations will continue to be based on the 1997 revisions to the FM working agreement between the Government of Canada and the Government of the United States of America relating to the FM broadcasting service. It must be clearly understood that the proposed changes apply to domestic protection between Canadian stations only.

BANK ACT

The Bank of New York Mellon — Order permitting a foreign bank to establish a branch in Canada and order to commence and carry on business

  • Pursuant to subsection 524(1) of the Bank Act, the Minister of Finance issued an order on July 1, 2008, permitting The Bank of New York Mellon to establish a branch in Canada to carry on business in Canada under the name The Bank of New York Mellon; and
  • Pursuant to subsection 534(1) of the Bank Act, the Assistant Superintendent, Regulation Sector, on behalf of the Superintendent of Financial Institutions, issued an order approving the commencement and carrying on of business in Canada by The Bank of New York Mellon, effective July 1, 2008.
