Certain carbon steel welded pipe — Decision

On July 21, 2008, the President of the Canada Border Services Agency (CBSA) made a final determination of dumping and a final determination of subsidizing, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), in respect of carbon steel welded pipe, commonly identified as standard pipe, in the nominal size range of 1/2 in. up to and including 6 in. (12.7 mm to 168.3 mm in outside diameter) inclusive, in various forms and finishes, usually supplied to meet ASTM A53, ASTM A135, ASTM A252, ASTM A589, ASTM A795, ASTM F1083 or Commercial Quality, or AWWA C200-97 or equivalent specifications, including water well casing, piling pipe, sprinkler pipe and fencing pipe, but excluding oil and gas line pipe made to API specifications exclusively, originating in or exported from the People’s Republic of China.

The goods in question are commonly classified under the following Harmonized System classification numbers:

The Canadian International Trade Tribunal (Tribunal) is continuing its inquiry into the question of injury to the domestic industry and will make an order or finding by August 20, 2008. Provisional duties will continue to apply until this date.

If the Tribunal finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, future imports of subject goods will be subject to anti-dumping duty equal to the margin of dumping and/or countervailing duty equal to the amount of subsidy on the goods. In that event, the importer in Canada shall pay all such duties. The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping and countervailing duty.

Replacement Class Screening Report: Fixed Aids to Navigation — Maritimes Region — Public Notice

The Canadian Environmental Assessment Agency (the Agency) declares the report entitled Fixed Aids to Navigation — Maritimes Region to be a replacement class screening report (RCSR) pursuant to the provisions of subsection 19(1) and paragraph 19(2)(a) of the Canadian Environmental Assessment Act (the Act).

Public consultations on the RCSR took place from May 28 to June 27, 2008. The Agency received no written submissions from the public concerning the RCSR. In making the declaration proposed by Fisheries and Oceans Canada—Canadian Coast Guard (DFO-CCG) and Transport Canada (TC), the Agency has reviewed the RCSR and has determined that the project screening process, as described in the document, will meet the requirements of the Act for the environmental assessment of the class of projects. It is also the Agency’s opinion that the class of projects described in the RCSR is not likely to cause significant adverse environmental effects when the design standards and mitigation measures described in the report are applied.

The declaration is effective August 2, 2008, and is subject to the following terms and conditions:

  • Subject to subsection 19(8) of the Act, the declaration period is valid until August 2, 2018.
  • DFO-CCG and/or TC will notify the Agency, in writing, a minimum of six months prior to the date on which the declaration expires, of its intention to re-declare the RCSR, to re-declare the RCSR with modifications or additions, or not to re-declare the RCSR and, thereby, allow the declaration to expire.
  • To re-declare the RCSR, DFO-CCG and/or TC will submit the proposed RCSR to the Agency no less than three months prior to the expiration date of this declaration, so that the Agency may initiate a new declaration process.
  • DFO-CCG, TC and the Agency will ensure that the RCSR is made available to the public in accordance with the requirements of the Act. As such, DFO-CCG will place the RCSR in the Canadian Environmental Assessment Registry (the Registry) project file. On a quarterly basis, DFO-CCG will also post on the Registry Web site a statement of the projects in respect of which the RCSR was used, as required under paragraph 55.1(2)(d) of the Act. The quarterly schedule for posting on the Registry Web site is contained in section 1.4 of the RCSR.
  • Any amendments to the report will be developed and implemented in accordance with the provisions for amendment contained in section 6.0 of the RCSR.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2008-011) on July 24, 2008, with respect to a complaint filed by 144314 Canada Inc./Nexys (Nexys), of Montréal, Quebec, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, concerning a procurement (Solicitation No. 9606-07-0007) by the Department of Human Resources and Social Development (HRSDC). The solicitation was for the provision of translation and revision services in both official languages.

Nexys alleged that HRSDC improperly evaluated its proposal.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was valid.

Regulatory policy — Amendments to the Radio Regulations, 1986 — Implementation of the Commercial Radio Policy 2006 and the Digital Radio Policy

The Commission hereby announces that it has made amendments to the Radio Regulations, 1986 (the Regulations) in order to implement the commercial radio and digital radio policy frameworks established in Broadcasting Public Notice 2006-158 (the Commercial Radio Policy 2006) and Broadcasting Public Notice 2006-160 (the Digital Radio Policy).

Specifically, the Commission has amended the Regulations in order to

  • implement changes relating to the Canadian content of musical selections from subcategory 31 (concert music) and subcategory 34 (jazz and blues) in accordance with paragraph 94 of the Commercial Radio Policy 2006;
  • implement the new Canadian content development (CCD) contribution regime as set out in the Commercial Radio Policy 2006;
  • implement changes to broaden the definition of Local Management Agreement (LMA) as defined in paragraph 178 of the Commercial Radio Policy 2006; and
  • extend the regulatory framework for FM analog services to licensees operating in the L-band as determined in the Digital Radio Policy.

The amendments were registered on May 28, 2008 (SOR/2008-177) and come into force on September 1, 2008. The amendments were published in the Canada Gazette, Part II on June 11, 2008, and a copy is appended to the notice.

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES

Nova Scotia Power Incorporated

By an application dated July 24, 2008, Nova Scotia Power Incorporated (the “Applicant”) has applied to the National Energy Board (the “Board”), under Division II of Part VI of the National Energy Board Act (the “Act”), for authorization to export 1 000 MW of firm or interruptible power and annually up to 1 200 GWh of either firm or interruptible energy for a period of ten years commencing on November 6, 2008.

The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The directions on procedure that follow explain in detail the procedure that will be used.

3. Pursuant to subsection 119.06(2) of the Act, the Board shall have regard to all considerations that appear to it to be relevant. In particular, the Board is interested in the views of submitters with respect to

(a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported;

(b) the impact of the exportation on the environment; and

(c) whether the Applicant has

(i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and

(ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.

4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by September 17, 2008.

Permission and leave granted

The Public Service Commission of Canada (PSC), pursuant to section 116 of the Public Service Employment Act, hereby gives notice that it has granted permission, pursuant to subsection 114(4) of the said Act, to Jean-Luc Matteau, Technical Advisor (EN-ENG-03), Natural Resources Canada, Ottawa, Ontario, to allow him to seek nomination as, and be, a candidate before and during the election period in the next federal election that will be held at a date to be announced for the electoral district of Berthier-Maskinongé, Quebec.

The PSC, pursuant to subsection 114(5) of that Act, also grants a leave of absence without pay during the election period, effective close of business on the first day of the election period, to allow him to be a candidate during this election.
