Notice is hereby given that, pursuant to section 127 of the Canadian Environmental Protection Act, 1999, Disposal at Sea Permit No. 4543-2-04333 authorizing the loading for disposal and the disposal of waste or other matter at sea is approved.

 1. Permittee: Department of Public Works and Government Services (Quebec).

 2. Waste or other matter to be disposed of: Dredged material.

2.1. Nature of waste or other matter: Dredged material consisting of gravel, sand, silt, clay and colloids.

 3. Duration of permit: Permit is valid from March 23, 2009, to December 31, 2009. The loading and disposal at sea activities are restricted to the following periods: from March 23 to May 4, 2009, from June 11 to June 30, 2009, and from September 1 to December 31, 2009. The Permittee may modify the duration of the restriction periods with the written approval of the Department of the Environment.

 4. Loading site(s): Pointe-Basse Harbour, Quebec, 47°23.36′ N, 61°47.45′ W (NAD83), with the exception of the zone of exclusion described in Annex 1, Figure 2, of the “Examen environnemental préalable 2009,” by the Department of Public Works and Government Services, and approved by the Department of the Environment.

 5. Disposal site(s):

(a) PB-8, 47°22.10′ N, 61°47.75′ W (NAD83). The disposal site is located at approximately 2.4 km south from the loading site; and

(b) Pointe-Basse Harbour, 47°23.36′ N, 61°47.45′ W (NAD83).

 6. Method of loading: Dredging will be carried out using a clamshell dredge or a hydraulic shovel.

 7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site via towed scow.

 8. Method of disposal: Disposal will be carried out by bottom dumping and levelling of the seabed by a steel beam, a scraper blade, or a hydraulic shovel.

 9. Total quantity to be disposed of: Not to exceed 14 000 m3 scow measure.

10. Fees: The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations.

11. Inspection: By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

11.1. The Permittee shall ensure that records of all loading and disposal activities are kept on site for the duration of the permit and are available for inspection for two years following the expiry of the permit by any enforcement officer or analyst.

12. Contractors: The loading or disposal at sea referred to under this permit shall not be carried out without written authorization from the Permittee.

12.1. The Permittee shall ensure that all contractors involved in the loading or disposal activity for which the permit is issued are made aware of the conditions identified in the permit and of possible consequences of any violation of these conditions.

13. Reporting and notification: The Permittee shall provide the following information at least 48 hours before loading and disposal activities commence: name or number of ship, platform or structure used to carry out the loading and/or disposal, name of the contractor including corporate and on-site contact information, and expected period of loading and disposal activities. The above-noted information shall be submitted to the Regional Director, Environmental Protection Operations Directorate, Department of the Environment, Quebec Region, 105 McGill Street, 4th Floor, Montréal, Quebec H2Y 2E7, 514-496-6982 (fax), immersion.dpe@ec.gc.ca (email).

13.1. The Permittee must complete the Register of Disposal at Sea Operations as provided by the Department of the Environment. This register must, at all times, be kept aboard any vessel involved with the disposal operations and be accessible to enforcement officers designated under the Canadian Environmental Protection Act, 1999.

13.2. The Permittee shall submit a written report to the Minister, as represented by the Regional Director identified in paragraph 13, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: a list of all work completed pursuant to the permit, including the names of the loading and disposal sites used, the nature and quantity of matter disposed of at the disposal site, the dates on which disposal activities occurred and the Register of Disposal at Sea Operations.

13.3. The Permittee must keep a written register of the time of departure of the vessel to the disposal site and advise the Canadian Coast Guard station once per day of the departure times entered in the register. The Permittee must record these communications in the register mentioned in paragraph 13.1.

13.4. At all times, a copy of this permit and of documents and drawings referenced in this permit shall be available at the loading site and on all powered ships directly engaged in the loading and disposal operations.

(b) Millerand Harbour, 47°12.96′ N, 61°59.09′ W (NAD83).

(b) L’Île-d’Entrée Harbour, 47°16.67′ N, 61°43.17′ W (NAD83).

 7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site via towed scow.

Notice of intent to amend the Domestic Substances List under subsection 87(3) of the Canadian Environmental Protection Act, 1999 to indicate that subsection 81(3) of the Act applies to one substance

This Notice applies to

1. Ethanol, 2-[[4-[(2,6-dichloro-4-nitrophenyl)azo]phenyl] methylamino]-

Whereas this substance set out in Annex 1 to this Notice has been identified for screening assessment under subsection 73(1) of the Canadian Environmental Protection Act, 1999;

Whereas the Minister of the Environment and the Minister of Health have issued a draft screening assessment on this substance under section 74 of that Act and have published a summary of the results of this process under subsection 77(1) thereof on February 21, 2009, in the Canada Gazette, Part I, for a 60-day public comment period;

Whereas the Ministers have identified no current manufacture or importation activity for this substance set out in Annex 1 above 100 kg per calendar year; and

Whereas the Ministers suspect that a significant new activity in relation with this substance set out in Annex 1 to this Notice may result in the substance meeting the criteria set out in section 64 of the Act,

Notice therefore is hereby given that the Minister of the Environment intends to amend the Domestic Substances List under subsection 87(3) to indicate that subsection 81(3) applies to this substance set out in Annex 1 to this Notice as described in Annex 2 attached hereto.

Public comment period

Any person may, within 60 days of publication of this notice, file with the Minister of the Environment comments with respect to this proposal. All comments must cite the Canada Gazette, Part I, and the date of publication of this notice and be sent to the Executive Director, Program Development and Engagement Division, Environment Canada, Gatineau, Quebec K1A 0H3, 819-953-4936 (fax), existing.substances.existantes@ec.gc.ca (email).

Significant New Activity Notice

(Section 85 of the Canadian Environmental Protection Act, 1999)

Whereas the Minister of the Environment and the Minister of Health have assessed information in respect of the substance Lithium cobalt manganese nickel oxide, Chemical Abstracts Service Registry No. 182442-95-1;

Whereas the substance is not on the Domestic Substances List;

And whereas the Ministers suspect that a significant new activity in relation to the substance may result in the substance becoming toxic under the Canadian Environmental Protection Act, 1999,

Therefore, the Minister of the Environment indicates, pursuant to section 85 of that Act, that subsection 81(4) of the same Act applies with respect to the substance in accordance with the Annex.

ANNEX

Information Requirements

(Section 85 of the Canadian Environmental Protection Act, 1999)

1. In relation to Lithium cobalt manganese nickel oxide, a significant new activity is any activity involving the use of the substance in quantities greater than 10 kilograms per calendar year, where the substance is engineered to contain particles between 1 to 100 nanometres particle size range.

2. A person who proposes a significant new activity set out in this Notice for this substance shall provide to the Minister of the Environment, at least 90 days before the day on which the quantity of the substance involved in the activity exceeds 10 kilograms per calendar year, the following information:

(a) a description of the proposed significant new activity in relation to the substance;

(b) measurement of the particle size and particle size distribution of the substance;

(c) the information specified in Schedule 6 of the New Substances Notification Regulations (Chemicals and Polymers) for this substance;

(d) the analytical information needed to determine the physical dimensions of the test substance for the duration of the health and ecological toxicity tests required pursuant to paragraph (c); and

(e) test data and a test report on the water solubility of this substance that comply with the Organisation for Economic Co-operation and Development Series on Testing and Assessment, Number 29, Guidance Document on Transformation/Dissolution of Metals and Metal Compounds in Aqueous Media.

3. The above information will be assessed within 90 days after the day on which it is received by the Minister of the Environment.

EXPLANATORY NOTE

(This explanatory note is not part of the Significant New Activity Notice.)

A Significant New Activity Notice is a legal instrument issued by the Minister of the Environment pursuant to section 85 of the Canadian Environmental Protection Act, 1999. The Significant New Activity Notice sets out the appropriate information that must be provided to the Minister for assessment prior to the commencement of a new activity as described in the notice.

Substances that are not listed on the Domestic Substances List can be manufactured or imported only by the person who has met the requirements set out in section 81 of the Canadian Environmental Protection Act, 1999. Under section 86 of the Canadian Environmental Protection Act, 1999, in circumstances where a Significant New Activity Notice is issued for a new substance, it is the responsibility of every person who transfers the physical possession or control of the substance to notify all persons to whom the possession or control is transferred of the obligation to comply with the Significant New Activity Notice and of the obligation to notify the Minister of the Environment of any new activity and all other information as described in the notice. It is the responsibility of the users of the substance to be aware of and comply with the Significant New Activity Notice and to submit a Significant New Activity notification to the Minister prior to the commencement of a significant new activity associated with the substance. However, as mentioned in subsection 81(6) of the Canadian Environmental Protection Act, 1999, a Significant New Activity notification is not required when the proposed new activity is regulated under an act or regulations listed on Schedule 2 of the Canadian Environmental Protection Act, 1999.

A Significant New Activity Notice does not constitute an endorsement from Environment Canada of the substance to which it relates, or an exemption from any other laws or regulations that are in force in Canada and that may apply to this substance or activities involving the substance.

NOTICE OF INTENT TO CONDUCT A STRATEGIC ENVIRONMENTAL ASSESSMENT OF THE CANADA-BAHRAIN AND CANADA-TUNISIA FOREIGN INVESTMENT PROMOTION AND PROTECTION AGREEMENTS

The Government of Canada will undertake a Strategic Environmental Assessment of the negotiations for Canada-Bahrain and Canada-Tunisia Foreign Investment Promotion and Protection Agreements (FIPA). Comments are invited on any likely and significant environmental impacts of the negotiations on Canada.

The Government of Canada is committed to sustainable development. Mutually supportive trade, environmental and investment policies can contribute to this objective. To this end, the Minister of International Trade, with the support of his Cabinet colleagues, has directed trade officials to improve their understanding of, and information based on, the relationship between trade and environmental issues at the earliest stages of decision making, and to do this through an open and inclusive process. Environmental assessments of trade negotiations are critical to this work.

This process is guided by the 2001 Framework for Conducting Environmental Assessments of Trade Negotiations and with direction from the 2004 Cabinet Directive on the Environmental Assessment of Policy, Plan, and Program Proposals.

NATIONAL BATTLEFIELDS COMMISSION

Secretary (full-time position)

Salary range: $90,000–$105,900

Location: Québec City, Quebec

The National Battlefields Commission (NBC) was established in 1908 under the National Battlefields at Québec Act to acquire and conserve the great historic battlefields in Québec City and turn the Plains of Abraham and Des Braves Park into one of the most prestigious parks in the world. As a national institution within the Canadian Heritage Portfolio, the NBC is also responsible for the acquisition, administration, governance and development of the battlefields and for managing the funds allocated to them. In this regard, it offers a wide range of educational and interpretation activities allowing Canadians to discover and learn more about the rich heritage of the area and its important role in Canadian history.

As the Head of Agency, the Secretary provides leadership and guidance to the organization in the formulation of its strategic direction and ensures the Commission carries out its mandate and objectives effectively.

The successful candidate must posses a degree from a recognized university in a relevant field of study or an acceptable combination of education, job-related training and/or experience. Extensive experience in managing human and financial resources at the senior executive level within the federal government is required, as is experience in managing complex partnerships and stakeholder relationships. The qualified candidate will possess experience in national/international outreach initiatives and in dealing with senior government officials in the federal, provincial and municipal governments. Previous experience in reporting to or serving a board would be considered an asset.

The qualified candidate will possess knowledge of the National Battlefields Commission’s mandate and activities, of the National Battlefields at QuébecAct and other relevant federal legislation. Extensive knowledge of the accountability structure and reporting obligations of a Departmental Agency is required, as is knowledge of the federal government’s priorities and how they relate to the National Battlefields Commission. The preferred candidate will possess extensive financial literacy and knowledge of sound governance and management principles and practices. Knowledge of real asset management in the Canadian cultural domain would be considered an asset.

The ability to provide leadership and vision needed to meet the National Battlefields Commission’s mandate and objectives is necessary, as is the ability to identify, analyze and define priorities and strategies. The qualified candidate will possess the ability to focus the energies and talents of the National Battlefields Commission’s employees and motivate them to achieve the established objectives.

The successful candidate will possess the ability to lead and develop effective relationships with key stakeholders in Québec City and with three levels of government to facilitate collaboration in the planning and development of the Commission’s activities and programs.

The ability to develop effective working relationships with the Board, the Minister and his office and the Deputy Minister is essential. Superior communication skills, both written and oral is required, as is the ability to act as the Commission’s spokesperson in dealing with stakeholders, media, public institutions, governments and other organizations on a national and international level. The successful candidate must possess sound judgment and integrity and must adhere to high ethical standards. He/she must be a strategic and innovative leader and must possess superior interpersonal skills.

Proficiency in both official languages is essential.

No member of the Commission shall have, nor shall the Secretary have, any contract with the Commission, or be pecuniarily interested, directly or indirectly, in any contract or work with regard to which any portion of the moneys at the credit of the Commission is being or is to be expended.

The successful candidate must be willing to relocate to Québec City or to a location within reasonable commuting distance.
