SCHEDULE 1
Plan for the assessment and management of certain substances on the Domestic Substances List and list of Batch 9 Challenge substances
1. Background
The Canadian Environmental Protection Act, 1999 (CEPA 1999) required that the Government review some 23 000 Domestic Substances List (DSL) substances to determine whether they have certain characteristics which indicate that the Government should assess the risks that may be associated with their continued use in Canada. The Government completed this exercise — called categorization — in September 2006. Categorization provided a new information baseline on all identified substances, one that will allow the Government of Canada to work with its partners to achieve tangible results that protect Canadians and the environment.
The Ministers of the Environment and of Health (the Ministers) published on December 9, 2006, in the Canada Gazette, Part I, Vol. 140, No. 49, the Notice of intent to develop and implement measures to assess and manage the risks posed by certain substances to the health of Canadians and their environment. The notice indicated that approximately 200 of the 4 300 chemical substances identified by the categorization exercise are high priorities for action under the initiative known as the Challenge because
This notice also outlines the measures the Ministers intend to take regarding these substances to further protect the health of Canadians and the environment. These measures will
In so doing, the Ministers will make timely risk management interventions that minimize the risk of serious or irreversible harm associated with the above-mentioned substances.
Pursuant to paragraph 74(a) of the Act, the Ministers are required to conduct a screening assessment of the substances categorized under subsection 73(1) to determine if they meet the criteria established in section 64 of the Act.
The Ministers have documented for each of the 17 Batch 9 Challenge substances the categorization information in their possession and have prepared documentation which (a) summarizes the scientific information and any relevant uncertainties, (b) specifies the information necessary for improved decision making and, where appropriate, requires submission of this data using section 71, and (c) outlines how this information will be used in decisions.
Information deemed necessary for improved decision making is being gathered via section 71 of CEPA 1999. Additional information regarding the scientific properties of these substances, or best management practices associated with the use of these substances that is deemed beneficial by interested stakeholders, will be collected as detailed in the technical documentation available via the Government of Canada Chemical Substances Web site (www. chemicalsubstances.gc.ca). The absence of new information will not preclude the Ministers from issuing a decision that safeguards human health and the environment.
2. Timelines
If new information for the 17 substances listed below is not received by September 10, 2009, then by no later than December 19, 2009, the Ministers will open a 60-day public comment period under subsection 77(1) on (a) the screening assessment and (b) the proposal to pursue one of the measures as specified under subsection 77(2).
If new information is received by September 10, 2009, that information will be considered and, by no later than March 20, 2010, the Ministers will open a 60-day public comment period under subsection 77(1) on (a) the screening assessment and (b) their proposal to pursue one of the measures as specified under subsection 77(2) and, where applicable, the implementation of virtual elimination under subsection 65(3) as specified under subsection 77(2).
Discussions with stakeholders on the development of the risk management approach, where applicable, will be initiated at the time of the subsection 77(1) publication. The Ministers will publish their final recommendation under subsection 77(6) by no later than June 19, 2010, where no new information was received during this call for information, and by no later than September 18, 2010, where new information was received during this call for information. A risk management approach, where applicable, will be available at that time outlining actions which the Government proposes to take to protect Canadians and their environment from risks associated with these substances.

EXPLANATORY NOTE
The Canadian Environmental Protection Act, 1999 (CEPA 1999) required the Minister of Health and the Minister of the Environment to categorize the approximately 23 000 substances on the Domestic Substances List. Based on the information obtained through the categorization process, a number of substances have been identified by the Ministers as high priorities for action. This includes substances
The Challenge initiative is meant to engage stakeholders to provide new information that could improve decision-making with respect to 200 substances identified as high priorities for action.
In accordance with section 76.1 of CEPA 1999, and in the absence of additional relevant information as a result of this Challenge, the Ministers are predisposed to conclude, through a screening assessment, that a substance satisfies the definition of toxic under section 64 of CEPA 1999 in that it “may enter the environment in a quantity or concentration or under conditions that have or may have an immediate or long-term harmful effect on the environment or its biological diversity or may constitute a danger in Canada to human life or health.” As such, the Ministers may then recommend to the Governor in Council that this substance be added to the List of Toxic Substances in Schedule 1 of CEPA 1999, with the intent of initiating the development of risk management measures taking into account socio-economic considerations. The measures will be subject to review in light of new scientific information, including monitoring and ongoing assessment activities.
The 200 Challenge substances are in commerce or believed to be in commerce in Canada. Should no information be forthcoming through this Challenge to confirm that a substance is in commerce in Canada, the Ministers may conclude, through a screening assessment, that this substance is not currently in commerce in Canada and that as such it may not satisfy the definition of toxic under section 64 of CEPA 1999. However, given the hazardous properties of these substances, there is concern that new activities for the substances that have not been identified or assessed under CEPA 1999 could lead to the substances meeting the criteria set out in section 64 of the Act. Therefore, it will be recommended that these substances be subject to the Significant New Activity provisions specified under subsection 81(3) of the Act, to ensure that any new manufacture, import or use of these substances in quantities greater than 100 kg/year is notified, and that ecological and human health risk assessments are conducted as specified in section 83 of the Act prior to the substances being introduced into Canada.

RADIOCOMMUNICATION ACT
Notice No. DGRB-005-09 — Consultation on transition to Broadband Radio Service (BRS) in the band 2500-2690 MHz
Through this notice, Industry Canada hereby announces a consultation on the transition to Broadband Radio Service (BRS) and on the criteria to be used in the issuance of BRS licences to operators of qualified Multipoint Communication System (MCS) licences and Multipoint Distribution Service (MDS) authorizations. This notice also introduces the Stakeholder Proposal Development (SPD) process, which will be conducted soon after the release of this notice.
The Department is also announcing a moratorium, effective immediately, on new applications for broadcasting certificates in the band 2500-2690 MHz. All applications for broadcasting certificates already in the possession of Industry Canada will be processed, culminating in the issuance of a broadcasting certificate should all requirements be met. All outstanding documents necessary for the processing of these applications must be received by the Department within three months of the date of this notice, otherwise the application will be returned.
In March 2006, Industry Canada issued policy decision DGTP-002-06 — Policy Provisions for the Band 2500-2690 MHz to Facilitate Future Mobile Service (www.ic.gc.ca/eic/site/smt-gst.nsf/ eng/sf08551e.html). This policy enabled the implementation of mobile services for both MCS and MDS operators subject to the return of current authorizations and the issuance of new spectrum licences with the flexibility to offer mobile, fixed and broadcasting services in approximately two thirds of the originally authorized spectrum.
Given that some incumbents indicated their intent to pursue their existing business plans and expressed concerns about the uncertain future status of mobile services in the band, the Department did not impose a fixed transition date to BRS licences in the 2006 policy. Instead, the Department reserved the right to consult at a future date on issues related to such a transition. Since the issuance of the policy in 2006, international developments at the technological and regulatory levels have removed the uncertainty about the implementation of advanced mobile services in this band.
Licences such as BRS, which support a mix of services, including mobile, fixed and broadcasting, are often referred to as “flexible-use” licences. The Department is committed to taking the necessary steps for the implementation of BRS in order to increase flexibility in service provision that would benefit Canadians by enabling the development of competitive high-speed mobile services. To this end, the Department is initiating the consultation process to determine whether to renew the licences and continue with voluntary conversion to BRS, or adopt a firm transition date for the implementation of BRS and related transition policies.
Although the 2006 policy provided details in terms of the spectrum for the new flexible-use BRS licences, it did not address eligibility criteria for conversion of MCS and MDS authorizations to BRS licences, nor did it address the geographic conversion of site-specific MCS licences and MDS authorizations to spectrum licences for BRS. This consultation will be used to determine the criteria to be applied for the voluntary conversion pursuant to the 2006 policy, as well as for the eventual implementation of the transition policy.
Submitting comments
Respondents are requested to provide their comments in electronic format (XHTML, WordPerfect, Microsoft Word, Adobe PDF or ASCII TXT) along with a note specifying the software, version number and operating system used, to the following email address: spectrum.operations@ic.gc.ca.
Written submissions should be addressed to the Director, Spectrum Management Operations, Radiocommunications and Broadcasting Regulatory Branch, Industry Canada, 300 Slater Street, Ottawa, Ontario K1A 0C8.
All submissions should cite the Canada Gazette, Part I, the publication date, the title and notice reference number DGRB-005-09. Parties should submit their comments no later than May 15, 2009, to ensure consideration. Soon after the close of the comment period, all comments received will be posted on Industry Canada’s Spectrum Management and Telecommunications Web site at www.ic.gc.ca/spectrum.
The Department will also provide interested parties with the opportunity to reply to comments from other parties. Reply comments will be accepted until June 15, 2009.

4. Criminal matters shall also include investigations or proceedings relating to offences concerning taxation, duties, customs and international transfer of capital or payments.
5. Assistance shall include
(a) taking of evidence and obtaining of statements of persons;
(b) provision of information, documents and other records, including criminal records, judicial records and government records;
(c) location of persons and objects, including their identification;
(d) search and seizure;

2. The Requested State, in accordance with its laws and procedures, may execute a request for assistance regardless of bank secrecy.
Article 3
Refusal or Postponement of Assistance
1. Assistance may be refused if, in the opinion of the Requested State the execution of the request would impair its sovereignty, security, public order or similar essential public interest, prejudice the safety of any person or be unreasonable on other grounds.
2. Assistance may be postponed by the Requested State if execution of the request would interfere with an ongoing investigation or prosecution in the Requested State.
3. The Requested State shall promptly inform the Requesting State of a decision of the Requested State not to comply in whole or in part with a request for assistance, or to postpone execution, and shall give reasons for that decision.
4. Before refusing to grant a request for assistance or before postponing the grant of such assistance, the Requested State shall consider whether assistance may be granted subject to such conditions as it deems necessary. If the Requesting State accepts assistance subject to these conditions, it shall comply with them.
PART II — SPECIFIC PROVISIONS

3. Insofar as not prohibited by the law of the Requested State, documents, objects and records shall be transmitted in a form or accompanied by such certification as may be requested by the Requesting State in order to make them admissible according to the law of the Requesting State.
Article 6
Availability of Persons to Give Evidence or Assist Investigations in the Requesting State
1. The Requesting State may request that a person be made available to testify or to assist an investigation.
2. The Requested State shall invite the person to assist in the investigation or to appear as a witness in the proceedings and seek that person’s concurrence thereto. That person shall be informed of any expenses and allowances payable.
Article 7
Making Detained Persons Available to Give Evidence or Assist Investigations in the Requesting State
1. A person in custody in the Requested State shall, at the request of the Requesting State, be temporarily transferred to the Requesting State to assist investigations or proceedings provided that the person consents to that transfer and there are no overriding grounds against transferring the person.
2. Where the person transferred is required to be kept in custody under the law of the Requested State, the Requesting State shall hold that person in custody and shall return the person in custody at the conclusion of the execution of the request.
3. Where the sentence imposed expires, or where the Requested State advises the Requesting State that the transferred person is no longer required to be held in custody, that person shall be set at liberty and be treated as a person present in the Requesting State pursuant to a request seeking that person’s attendance.
Article 8

A person present in the Requesting State in response to a request seeking that person’s attendance shall not be prosecuted, detained or subjected to any other restriction of personal liberty in that State for any acts or omissions which preceded that person’s departure from the Requested State, nor shall that person be obliged to give evidence in any proceeding other than the proceedings to which the request relates.
2. A person who is present in the Requesting State by consent as a result of a request for the person’s attendance to answer before a judicial authority for any acts, omissions or convictions shall not be prosecuted or detained or subjected to any other restriction of personal liberty for acts and omissions or convictions which preceded that person’s departure from the Requested State, not specified in the request.
3. Paragraphs 1 and 2 of this Article shall cease to apply if a person, being free to leave the Requesting State, has not left it within a period of 30 (thirty) days after being officially notified that that person’s attendance is no longer required or, having left that territory, has voluntarily returned.
4. Any person who fails to appear in the Requesting State may not be subjected to any sanction or compulsory measure in the Requested State.
Article 9
Proceeds of Crime
1. The Requested State shall, upon request, endeavour to ascertain whether any proceeds of a crime are located within its jurisdiction and shall notify the Requesting State of the results of its inquiries. In making the request, the Requesting State shall notify the Requested State of the basis of its belief that such proceeds may be located in this jurisdiction.
2. Where, pursuant to paragraph 1 of this Article, suspected proceeds of crime are found, the Requested State shall take such measures as are permitted by its law to freeze, seize and confiscate such proceeds.
