  • pursuant to subsection 229(1) of the Bank Act, of letters patent amalgamating and continuing Bank West, C.A. Bancorp Financial Corp., AgriFinancial Canada Corp. and AgriFinancial Leasing Inc. as one bank under the name, in English, Bank West, and in French, Banque Ouest, effective January 30, 2009; and

Pursuant to subsection 524(1) of the Bank Act, the Minister of Finance made an order on December 12, 2008, permitting Bayerische Hypo- und Vereinsbank AG to establish a branch in Canada to carry on business in Canada under the name, in English, Bayerische Hypo- und Vereinsbank AG, Canada Branch, and in French, Bayerische Hypo- und Vereinsbank AG, succursale canadienne.

CANADA MARINE ACT

Nanaimo Port Authority — Supplementary letters patent

BY THE MINISTER OF TRANSPORT, INFRASTRUCTURE AND COMMUNITIES

WHEREAS Letters Patent were issued by the Minister of Transport for the Nanaimo Port Authority (“Authority”) under the authority of the Canada Marine Act effective July 1, 1999;

WHEREAS Schedule B of the Letters Patent describes the federal real property managed by the Authority;

WHEREAS paragraph 3 of Schedule B of the Authority’s Letters Patent describes the following leasehold interest:

Leasehold interest granted pursuant to the Indenture dated November 1, 1962 between Her Majesty the Queen in Right of the Province of British Columbia and Nanaimo Harbour Commissioners, and Modification Agreement dated May 4, 1979 between Her Majesty the Queen in Right of the Province of British Columbia and Nanaimo Harbour Commission

Those ungranted foreshore lands and lands covered by water, vested in the Province and within the boundaries of the Nanaimo Harbour, as more particularly shown hatched in green on the plan annexed as Schedule “A” to the Modification Agreement

WHEREAS the above-described Lease dated November 1, 1962 expired (the “Expired Lease”) and was replaced by a Lease Agreement dated November 1, 2002 between Her Majesty the Queen in Right of the Province of British Columbia (the “Province”) and the Authority (“Lease No. 111325”);

WHEREAS Lease No. 111325 was modified by agreement dated July 4, 2005 between the Province and the Authority;

WHEREAS the Authority acquired title to District Lot 89, Nanaimo District, being a portion of the leased premises described in Lease No. 111325;

WHEREAS Lease No. 111325 was further modified by agreement dated June 12, 2008 between the Province and the Authority to remove District Lot 89, Nanaimo District from the leased premises;

AND WHEREAS the Board of Directors of the Authority requests the Minister of Transport, Infrastructure and Communities to issue Supplementary Letters Patent to amend Schedule B of the Authority’s Letters Patent by replacing the Expired Lease from paragraph 3 with Lease No. 111325, as follows:

All that unsurveyed Crown foreshore or land covered by water being part of the bed of Nanaimo Harbour, all within Nanaimo District, as shown outlined in red on the plan attached as Schedule “B” to the Modification Agreement dated June 12, 2008

NOW THEREFORE under the authority of section 9 of the Canada Marine Act, the Letters Patent are amended by replacing the Expired Lease from paragraph 3 of Schedule B with Lease No. 111325.
