CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Notice is hereby given that, pursuant to section 127 of the Canadian Environmental Protection Act, 1999, Disposal at Sea Permit No. 4543-2-03475 authorizing the loading for disposal and the disposal of waste or other matter at sea is approved.

 1. Permittee: Department of Fisheries and Oceans (DFO), Small Craft Harbours, Vancouver, British Columbia.

 2. Waste or other matter to be disposed of: Dredged material.

2.1. Nature of waste or other matter: Dredged material consisting of rock, gravel, sand, silt, clay, non-reusable concrete, wood waste, or material typical to the approved loading site, except logs and usable wood.

 3. Duration of permit: Permit is valid from August 31, 2009, to August 30, 2010.

 4. Loading site(s): DFO Small Craft Harbours, Ladysmith, British Columbia, at approximately 48°59.92′ N, 123°48.89′ W (NAD83), as described in the figure titled “Dredge Areas” submitted in support of the permit application.

 5. Disposal site(s): Porlier Pass Disposal Site, within a 0.5 nautical mile radius of 49°00.20′ N, 123°29.90′ W (NAD83).

 6. Method of loading: Loading will be carried out using cutter suction dredge, barge-mounted excavator or clamshell dredge.

 7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site via pipeline, hopper scow, towed scow or hopper dredge.

 8. Method of disposal: Disposal will be carried out by pipeline, bottom dumping, end dumping or cutter suction dredge.

 9. Total quantity to be disposed of: Not to exceed 15 000 m³.

10. Fees: The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations.

11. Inspection:

11.1. By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

11.2. The Permittee shall ensure that records of all loading and disposal activities are kept on site for the duration of the permit and are available for inspection by any enforcement officer or analyst for two years following the expiry of the permit.

11.3. Ships operating under the authority of this permit shall carry and display a radar-reflecting device at all times mounted on the highest practical location.

12. Contractors:

12.1. The loading or disposal at sea referred to under this permit shall not be carried out by any person without written authorization from the Permittee.

12.2. The Permittee shall ensure that all contractors involved in the loading or disposal activity for which the permit is issued are made aware of the conditions identified in the permit and of possible consequences of any violation of these conditions.

13. Reporting and notification:

13.1. The Permittee shall provide the following information at least 48 hours before loading and disposal activities commence: name or number of ship, platform or structure used to carry out the loading and/or disposal, name of the contractor including corporate and on-site contact information, and expected period of loading and disposal activities. The above-noted information shall be submitted to Environment Canada’s Environmental Enforcement Division, Pacific and Yukon Region, 604-666-9059 (fax) or das.pyr@ec.gc.ca (email).

13.2. The Permittee shall submit a written report to the Minister, as represented by the Regional Director of the Environmental Protection Operations Directorate, Pacific and Yukon Region, 201–401 Burrard Street, Vancouver, British Columbia V6C 3S5, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: a list of all work completed pursuant to the permit, including the names of the loading and disposal sites used, the quantity of matter disposed of at the disposal site(s), and the dates on which disposal activities occurred.

Notice is hereby given that, pursuant to section 127 of the Canadian Environmental Protection Act, 1999, Disposal at Sea Permit No. 4543-2-06590 authorizing the loading for disposal and the disposal of waste or other matter at sea is approved.

 1. Permittee: Breakwater Fisheries Ltd., Cottlesville, Newfoundland and Labrador.

 2. Waste or other matter to be disposed of: Fish waste and other organic matter resulting from industrial fish-processing operations.

2.1. Nature of waste or other matter: Fish waste and other organic matter consisting of fish and shellfish waste.

 3. Duration of permit: Permit is valid from August 31, 2009, to August 30, 2010.

 4. Loading site(s): Cottlesville, Newfoundland and Labrador, at approximately 49°30.4′ N, 54°51.80′ W (NAD83).

 5. Disposal site(s): Cottlesville, within a 250 m radius of 49°30.4′ N, 54°53.70′ W (NAD83), at an approximate depth of 142 m.

 6. Method of loading: The Permittee shall ensure that the material is loaded onto floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved disposal site.

6.1. The Permittee shall ensure that the waste to be disposed of is covered by netting or other material to prevent access by gulls and other marine birds, except during direct loading or disposal of the waste.

6.2. Material loaded for the purpose of disposal at sea may not be held aboard any ship for more than 96 hours from the commencement of loading without the written consent of an enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999.

6.3. The loading and transit shall be completed in a manner that ensures that no material contaminates the marine environment, notably the harbour and adjacent beaches. The Permittee shall also ensure that the loading sites are cleaned up and, if necessary, that spilled wastes are recovered.

 7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site.

 8. Method of disposal: The Permittee shall ensure that the waste to be disposed of shall be discharged from the equipment or ship while steaming within the disposal site boundaries and in a manner which will promote dispersion.

 9. Total quantity to be disposed of: Not to exceed 1 500 tonnes.

10. Inspection: By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

11. Contractors: The loading or disposal at sea referred to under this permit shall not be carried out by any person without written authorization from the Permittee.

11.1. The Permittee shall ensure that all contractors involved in the loading or disposal activity for which the permit is issued adhere to the conditions identified in the permit and are aware of possible consequences of any violation of these conditions.

12. Reporting and notification: The Permittee shall provide the following information at least 48 hours before loading and disposal activities commence: the expected period of loading and disposal activities. The above-noted information shall be submitted to Mr. Rick Wadman, Environmental Protection Operations Directorate, Environment Canada, 6 Bruce Street, Mount Pearl, Newfoundland and Labrador A1N 4T3, 709-772-5097 (fax), rick.wadman@ec.gc.ca (email).

12.1. This report shall contain the following information: the quantity of matter disposed of at the disposal site(s) and the dates on which disposal activities occurred.

Notice with respect to potentially industry-limited high priority petroleum substances

Pursuant to paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999, notice is hereby given that the Minister of the Environment requires, for the purpose of assessing whether the substances listed in Schedule 1 to this notice are toxic or are capable of becoming toxic, or for the purpose of assessing whether to control, or the manner in which to control the listed substances, any person described in Schedule 2 to this notice, who possesses or who may reasonably be expected to have access to the information required in Schedule 3 to this notice, to provide that information no later than September 23, 2009, 3 p.m. Eastern Daylight Saving Time.

Persons Required to Provide Information

1. This notice applies to any person who was required to provide information pursuant to the Notice with respect to certain high priority petroleum substances under section 71 of the Canadian Environmental Protection Act,1999, published in the Canada Gazette, Part I, on March 8, 2008.

2. If any person described in section 1 of this Schedule has already provided the information requested in Schedule 3 of this Notice to the Oil, Gas and Alternative Energy Division of Environment Canada, then that person is not required to resubmit the specified information under this notice.

Definitions

1. The definitions in this section apply in this notice.

“bitumen” means crude oil having a density greater than or equal to 1 000 kg/m³.

“calendar year” means a period of 12 consecutive months commencing on January 1st.

“heavy crude oil” means crude oil that has a density of between 900 and 1 000 kg/m³.

“petroleum refining” means the refining of crude oil or bitumen diluted with a hydrocarbon, into petroleum products, and includes storage and processes such as cogeneration, hydrogen generation and sulphur recovery, but excludes the production of synthetic crude oil.

“petroleum refining facility” means a facility that engages in petroleum refining.

“synthetic crude oil” means a crude oil derived by the conversion of bitumen or heavy crude oil through the addition of hydrogen or the removal of carbon.

“upgrading” means the conversion of bitumen, blends of bitumen, heavy crude oil or blends of heavy crude oil to produce synthetic crude oil or petroleum products and synthetic crude oil.

“upgrading facility” means a facility that engages in upgrading.

2. If the person subject to the notice is a company, response to the notice shall be submitted on a company-wide basis. The person shall include information with respect to each petroleum refining facility, upgrading facility, or facility that engages in both petroleum refining and upgrading in their single response on behalf of the entire company.

Whereas the Minister of the Environment and the Minister of Health have assessed information in respect of the living organism b/h PIV3/RSV F2;

Whereas the living organism is not on the Domestic Substances List;

And whereas the Ministers suspect that a significant new activity in relation to the living organism may result in the substance becoming toxic under the Canadian Environmental Protection Act, 1999,

Therefore, the Minister of the Environment indicates, pursuant to section 110 of that Act, that subsection 106(4) of the same Act applies with respect to the living organism in accordance with the Annex.

ANNEX

Information Requirements

(Section 110 of the Canadian Environmental
Protection Act, 1999)

1. In relation to the living organism b/h PIV3/RSV F2, a significant new activity is any activity involving the living organism, other than its use in a Phase I or Phase II clinical trial for the purpose of preventing lower respiratory tract illness caused by Respiratory Syncytial Virus (RSV) and Parainfluenza Virus Type 3 (PIV3) in infants.

2. A person who proposes a significant new activity set out in this Notice for this living organism shall provide to the Minister of the Environment, at least 120 days prior to the commencement of the proposed significant new activity, the following information:

(a) a description of the proposed significant new activity in relation to the living organism;

(b) all information prescribed by Schedule 1 to the New Substances Notification Regulations (Organisms), including the concentration of the notified living organism in final products and the volume of the final product as a result of the significant new activity;

(c) the final clinical trial report and raw data on the safety, immunogenicity and viral shedding of MEDI-534 in seronegative infants from a Phase II clinical trial; and

(d) a pulmonary pathogenicity final study report in domestic cattle, which includes test protocols, raw data for observed clinical signs, shedding of the vaccine strain and serological response (in test animals, and in positive and negative controls).

3. The above information will be assessed within 120 days after the day on which it is received by the Minister of the Environment.

EXPLANATORY NOTE

(This explanatory note is not part of the
Significant New Activity Notice.)

A Significant New Activity Notice is a legal instrument issued by the Minister of the Environment pursuant to section 110 of the Canadian Environmental Protection Act, 1999. The Significant New Activity Notice sets out the appropriate information that must be provided to the Minister for assessment prior to the commencement of a new activity as described in the Notice.

Living organisms that are not listed on the Domestic Substances List can be manufactured or imported only by the person who has met the requirements set out in section 106 of the Canadian Environmental Protection Act, 1999. Under section 111 of the Canadian Environmental Protection Act, 1999, in circumstances where a Significant New Activity Notice is issued for a new living organism, it is the responsibility of every person who transfers the physical possession or control of the living organism to notify all persons to whom the possession or control is transferred of the obligation to comply with the Significant New Activity Notice and of the obligation to notify the Minister of the Environment of any new activity and all other information as described in the Notice. It is the responsibility of the users of the living organism to be aware of and comply with the Significant New Activity Notice and to submit a Significant New Activity notification to the Minister prior to the commencement of a significant new activity associated with the living organism. However, as mentioned in subsection 106(6) of the Canadian Environmental Protection Act, 1999, a Significant New Activity notification is not required when the proposed new activity is regulated under an act or regulations listed on Schedule 4 of the Canadian Environmental Protection Act, 1999.

A Significant New Activity Notice does not constitute an endorsement from Environment Canada of the living organism to which it relates, or an exemption from any other laws or regulations that are in force in Canada and that may apply to the living organism or activities involving the living organism.
