Regulations Amending Certain Regulations Made Under the Canada Post Corporation Act (Miscellaneous Program)

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Description

These amendments to regulations made under the Canada Post Corporation Act are non-substantive and technical in nature. The amendments are as follows.

1. The references to the Universal Postal Convention and its Final Protocol in the Non-mailable Matter Regulations and the Special Services and Fees Regulations are being updated to reflect the most recent Postal Congress held in Geneva in 2008. These technical amendments will ensure that Canada Post’s Regulations are consistent with the latest Universal Postal Convention, and will come into force on January 1, 2010, or on the day the Convention is ratified by Canada, whichever is later.

2. A reference to “of the current Regulations” is being added to section 3 of the schedule to the French version of the Letter Mail Regulations in response to an observation made by the Standing Joint Committee for the Scrutiny of Regulations. The amendment will ensure that the French and English versions are consistent with one another. This regulatory amendment will come into force on the day on which it is registered.

Consultation

The Canada Post Corporation Act requires a consultation period through publication of the regulatory proposal in the Canada Gazette. All representations must be sent to the Minister of Transport. The representations will be taken into consideration in the preparation of the final regulatory proposal.

Compliance and enforcement

These Regulations are enforced by Canada Post under the Canada Post Corporation Act. No increase in the cost of enforcement is expected as a result of the changes.

PROPOSED REGULATORY TEXT

Notice is hereby given, pursuant to subsection 20(1) of the Canada Post Corporation Act (see footnote a), that the Canada Post Corporation, pursuant to subsection 19(1) (see footnote b) of that Act, proposes to make the annexed Regulations Amending Certain Regulations Made Under the Canada Post Corporation Act (Miscellaneous Program).

Interested persons may make representations with respect to the proposed Regulations within 30 days after the date of publication of this notice. All such representations must cite the Canada Gazette, Part I, and the date of publication of this notice, and be addressed to the Minister of Transport, House of Commons, Ottawa, Ontario K1A 0A6.

CANADA POST CORPORATION

REGULATIONS AMENDING CERTAIN REGULATIONS MADE UNDER THE CANADA POST CORPORATION ACT (MISCELLANEOUS PROGRAM)

SPECIAL SERVICES AND FEES REGULATIONS

1. The definition “Universal Postal Convention” in section 2 of the Special Services and Fees Regulations (see footnote 1) is replaced by the following:

“Universal Postal Convention” means the Universal Postal Convention drawn up by the Universal Postal Union at the 24th Congress, 2008. (Convention postale universelle)

2. The portion of item 3 of the schedule to the French version of the Letter Mail Regulations (see footnote 2) in column I is replaced by the following:

COMING INTO FORCE

6. (1) Subject to subsection (2), these Regulations come into force on the day on which they are registered.

(2) Sections 1 and 3 to 5 come into force on the later of January 1, 2010 and the day on which the Universal Postal Convention of the 24 th Congress, 2008 is ratified for Canada.
