Further to its Broadcasting Notice of Consultation 2009-770, the Commission announces that the applicant has withdrawn its request to retain its current definition of “broadcast day” and has indicated that it will adopt the standard conditions of licence set out in Conditions of licence for competitive Canadian specialty services operating in the genres of mainstream sports and national news, Broadcasting Regulatory Policy CRTC 2009-562, September 4, 2009.

Accordingly, the paragraphs set out below in bold have been removed from its application.

Application by CTVglobemedia Inc. (CTVgm) to amend the broadcasting licence for the specialty television programming undertaking The Sports Network (TSN) to incorporate the new conditions of licence described in Conditions of licence for competitive Canadian specialty services operating in the genres of mainstream sports and national news, Broadcasting Regulatory Policy CRTC 2009-562, September 4, 2009 (Broadcasting Regulatory Policy 2009-562), in which the Commission announced standard conditions of licence for competitive Canadian mainstream sports and news specialty services.

The licensee also states that it wishes to retain its current definition of “broadcast day” as it applies to the conditions of licence for TSN, rather than adopt the definition of this term contemplated in Broadcasting Regulatory Policy 2009-562, which reads as follows:

“broadcast day”, in respect of a licensee, means the period of up to 18 consecutive hours, beginning each day not earlier than six o’clock in the morning and ending not later than one o’clock in the morning of the following day, as selected by the licensee.

The licensee notes that the definition of “broadcast day” that currently applies to the conditions of licence for TSN is the same as that originally proposed by the Commission in Proposed conditions of licence for competitive Canadian sp e cialty services operating in the genres of mainstream sports and mainstream national news — Notice of consultation, Broadcasting Public Notice CRTC 2008-103, October 30, 2008, which reads as follows:

“broadcast day” means a 24-hour period beginning at six o’clock in the morning, or any other period approved by the Commission.

CTVgm contends that operating with an 18-hour broadcast day would negatively affect its programming strategies. Specifically, CTVgm stated that it would act as a disincentive for the service to invest in and broadcast live Canadian programming from the West Coast, since TSN will no longer receive full credit for airing Canadian sporting events from Western Canada that exceed the time limit set for an 18-hour broadcast day.

NOTICE OF CONSULTATION 2010-41

Call for comments on opening up the general interest pay services genre to competition in the French-language market and on proposed conditions of licence for competing Canadian general interest pay services in the French-language market

The Commission calls for written comments on the appropriateness of opening up the general interest pay television genre to competition in the French-language market. The Commission also invites written comments on the conditions of licence relating to nature of service, exhibition of Canadian programming and Canadian programming expenditures that it would impose on competing services in the general interest pay services genre in the event that it opens up the genre to competition, consistent with the regulatory framework announced in Broadcasting Public Notice 2008-100. The deadline for filing comments is March 19, 2010.

NATIONAL ENERGY BOARD

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES

Centre Lane Trading Ltd.

By an application dated January 26, 2010, Centre Lane Trading Ltd. (the “Applicant”) has applied to the National Energy Board (the “Board”), under Division II of Part VI of the National Energy Board Act (the “Act”), for authorization to export up to 1 000 MW per hour/8 760 000 MWh per year of firm power and energy and up to 1 000 MW per hour/8 760 000 MWh per year of interruptible energy for a period of 10 years.

The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The directions on procedure that follow explain in detail the procedure that will be used.

1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at Centre Lane Trading Ltd., 113 Wineva Avenue, Toronto, Ontario M4E 2T1, 416-668-6924 (telephone), and provide a copy of the application to any person who requests one. A copy of the application is also available for viewing during normal business hours in the Board’s library, at 444 Seventh Avenue SW, Room 1002, Calgary, Alberta T2P 0X8.

2. Submissions that any party wishes to present shall be filed with the Secretary, National Energy Board, 444 Seventh Avenue SW, Calgary, Alberta T2P 0X8, 403-292-5503 (fax), and served on the Applicant by March 8, 2010.

3. Pursuant to subsection 119.06(2) of the Act, the Board shall have regard to all considerations that appear to it to be relevant. In particular, the Board is interested in the views of submitters with respect to

  1. (a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported;
  2. (b) the impact of the exportation on the environment; and
  3. (c) whether the Applicant has

    1. (i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
    2. (ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.

4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by March 23, 2010.
