Vancouver 2010 Interim Order Respecting the Transportation of Dangerous Goods (Into, Through or Within Controlled Access Zones)

Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to paragraph 27.6(3)(a) (see footnote a) of the Transportation of Dangerous Goods Act, 1992 (see footnote b), hereby approves the Vancouver 2010 Interim Order Respecting the Transportation of Dangerous Goods (Into, Through or Within Controlled Access Zones), made by the Minister of Transport on January 25, 2010.

EXPLANATORY NOTE

(This note is not part of the Order.)

The Order approves the Vancouver 2010 Interim Order Respecting the Transportation of Dangerous Goods (Into, Through or Within Controlled Access Zones) (the Interim Order), made by the Minister of Transport on January 25, 2010. Without this approval, the Interim Order would, in accordance with paragraph 27.6(3)(a) of the Transportation of Dangerous Goods Act, 1992 (the Act), cease to have effect 14 days after the day on which it was made (February 8, 2010). As a result of this approval, the Interim Order, in accordance with paragraph 27.6(3)(d) of the Act and section 7 of the Interim Order, ceases to have effect at 23:59:59 Pacific standard time on March 3, 2010. The security requirements put in place by the Interim Order need to be in force for more than 14 days in order to be in place during activities leading up to the 2010 Winter Olympic Games, during those Games, and during activities after those Games until the day on which the Olympic Athletes’ Villages close.

These requirements are in addition to the requirements of the Interim Order Respecting Dangerous Goods that are Lost or Stolen or Otherwise Unlawfully Interfered with, which was approved on July 23, 2009 and requires the reporting of dangerous goods that are lost, stolen or otherwise unlawfully interfered with, as well as in addition to the railway security rules made under section 19 of the Railway Safety Act. The approval of the Interim Order is part of the safety and security plans for the 2010 Winter Olympics Games to be hosted in Vancouver, B.C., starting on February 12, 2010 and ending on February 28, 2010.

The Interim Order establishes thirteen controlled access zones that encompass competition and non-competition Olympic venues in and around Vancouver, Whistler and surrounding areas, and into, through or within which the handling, offering for transport and transporting of dangerous goods by a road vehicle or a railway vehicle is controlled. The Interim Order also establishes time of day restrictions for access to the zones. In addition, it prohibits the importing, handling, offering for transport and transporting on the BNSF Railway barge of dangerous goods that require an emergency response assistance plan.

These requirements will be enforced by inspectors designated under the Act. Contraventions of the requirements are subject to prosecution under section 33 of the Act.
