SPECIAL IMPORT MEASURES ACT

Polyiso insulation board — Decision

On April 6, 2010, the President of the Canada Border Services Agency (CBSA) made a final determination of dumping, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), in respect of faced rigid cellular polyurethane-modified polyisocyanurate thermal insulation board (polyiso insulation board) originating in or exported from the United States of America.

The goods in question are usually classified under the following Harmonized System classification number: 3921.13.99.10.

The Canadian International Trade Tribunal (Tribunal) is continuing its inquiry into the question of injury to the domestic industry and will make an order or finding by May 6, 2010. Provisional duties will continue to apply until this date.

If the Tribunal finds that the dumping has caused injury or is threatening to cause injury, future imports of subject goods will be subject to anti-dumping duty equal to the margin of dumping on the goods. In that event, the importer in Canada shall pay all such duties. The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping duty.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2009-064) on April 14, 2010, with respect to a complaint filed by Krista Dunlop & Associates Inc. (KD&A Inc.), of Ottawa, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, concerning a procurement (Solicitation No. 10090828) by the Department of Canadian Heritage (Canadian Heritage). The solicitation was for the provision of graphic design services.

KD&A Inc. alleged that Canadian Heritage improperly evaluated its proposal.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was valid in part.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2009-154) from Forrest Green Resource Management Corp. (Forrest Green), of Richmond Hill, Ontario, concerning a procurement (Solicitation No. 1000279086) by the Canada Border Services Agency (CBSA). The solicitation is for the provision of financial and related services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

Forrest Green alleges that the CBSA did not evaluate its proposal in accordance with the provisions of the tender documents.

The deadline for submission of interventions and/or comments on the additional document pertaining to item 1 only is April 16, 2010.

On February 10, 2010, the Commission requested that representatives of CKLN Radio Incorporated provide the audio logger tapes, the program logs and a program schedule relating to the programming (local and network periods, if any) broadcast by CKLN-FM Toronto during the week of January 10 to 16, 2010, from 6:00 a.m. to midnight. This information was to be filed by no later than March 1, 2010, and it was noted that failure to do so may constitute a failure to comply with subsection 9(4) of the Radio Regulations, 1986 (the Regulations).

In Broadcasting Notice of Consultation 2010-146, the Commission indicated that this material had been received and would be analyzed. The Commission has completed the analysis of the material provided. Commission staff notified the licensee of the results of this analysis by letter dated April 9, 2010. This letter stated that it appears to Commission staff that the licensee may have failed to comply with section 8 of the Regulations, which pertains to logs and records.

This letter has been added to the public record of this proceeding. Interveners will have until April 16, 2010, to provide additional comments on this letter only. The licensee will have until April 22, 2010, to provide reply comments.

NATIONAL ENERGY BOARD

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES

Louis Dreyfus Energy Services L.P.

By an application dated April 15, 2010, Louis Dreyfus Energy Services L.P. (the “Applicant”) has applied to the National Energy Board (the “Board”), under Division II of Part VI of the National Energy Board Act (the “Act”), to amend its existing permit EPE-350 to export firm energy and interruptible energy from Canada.

Currently the Applicant has authority to export up to 500 MWh of firm energy and 100 MWh of interruptible energy annually for a period of 10 years. The Applicant seeks authorization to increase its export capacity to 4 380 000 MWh of firm energy and 876 000 MWh of interruptible energy annually for the remaining time period of its existing permit.

The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The directions on procedure that follow explain in detail the procedure that will be used.

1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at Louis Dreyfus Energy Services L.P., 20 Westport Road, Wilton, Connecticut 06897, U.S.A., Attn: Duane Duclaux, 203-761-8107 (telephone), 203-761-8217 (fax), and provide a copy of the application to any person who requests one. 3. Pursuant to subsection 119.06(2) of the Act, the Board shall have regard to all considerations that appear to it to be relevant. In particular, the Board is interested in the views of submitters with respect to

(a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported;

(b) the impact of the exportation on the environment; and

(c) whether the Applicant has

(i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and

(ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.

4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by June 8, 2010.
