Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2009-088) on June 15, 2010, with respect to a complaint filed by Adware Promotions Inc., Canadian Spirit Inc., Contractual Joint Venture (Adware), of Ottawa, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, concerning a procurement (Solicitation No. 42001-070468/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Treasury Board Secretariat. The solicitation was for the management of the Long Service Award Program and the Instant Award Program.

Adware alleged that PWGSC improperly evaluated its proposal, specifically as it related to the reference check portion of the evaluation criteria for the Instant Award Program.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement, the Agreement on Government Procurement and the Canada-Chile Free Trade Agreement, the Tribunal determined that the complaint was valid in part.

CANADIAN RADIO-TELEVISION AND TELECOMMUNICATIONS COMMISSION

REGULATORY POLICY 2009-562-1

Conditions of licence for competitive Canadian specialty services operating in the genres of mainstream sports and national news — Implementation of the Accessibility Policy and other matters

In Broadcasting Regulatory Policy 2009-562, the Commission announced standard conditions of licence for competitive Canadian mainstream sports and national news specialty services. In order to ensure that the Accessibility Policy announced in Broadcasting and Telecom Regulatory Policy 2009-430 be implemented in an equitable and competitively neutral manner for all new and existing services operating in these competitive genres, the Commission also considers it appropriate to add the standardized conditions of licence concerning accessibility of programming to the standard conditions for competitive news and sports speciality services. Accordingly, in the appendices to the document, the Commission amends the conditions set out in Broadcasting Regulatory Policy 2009-562 to include such standardized conditions of licence. To avoid unnecessary administrative burden, the Commission has also included the standard authorization to make available for distribution an upgraded version of a service in high-definition format.
