CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Establishment of a board of review for Decamethylcyclopentasiloxane (D5)

Whereas a final screening assessment of Decamethylcyclopentasiloxane (D5), Chemical Abstracts Service Registry Number 541-02-6 (“the substance”), conducted pursuant to section 74 of the Canadian Environmental Protection Act, 1999 (“the Act”), was published pursuant to subsection 77(6) of the Act in the Canada Gazette, Part I, on January 31, 2009, and concluded, based on the available information, that the substance is entering the environment in a quantity or concentration or under conditions that have or may have an immediate or long-term harmful effect on the environment or its biological diversity, thus meets one or more of the criteria set out in section 64 of the Act;

Whereas the Minister of the Environment (“the Minister”) and the Minister of Health, pursuant to subsection 77(2) of the Act, recommended the substance be added to Schedule 1 to the Act;

Whereas the Minister and the Minister of Health, pursuant to subsection 332(1) of the Act, published in the Canada Gazette, Part I, on May 16, 2009, the proposed Order Adding Toxic Substances to Schedule 1 to the Canadian Environmental Protection Act, 1999 (“the proposed Order”) listing the substance and seven other substances to be added to Schedule 1;

Whereas the Silicones Environmental, Health and Safety Council of North America, pursuant to subsection 332(2) of the Act, filed with the Minister a notice of objection to the proposed Order and requested that a board of review be established under section 333 of the Act;

Whereas scientific information respecting the substance has been made available since the conduct and publication of the final screening assessment,

Therefore the Minister hereby establishes a board of review (“the Board”) under subsection 333(1) of the Act, consisting of Dr. John Giesy as Chair, as well as Dr. Keith Solomon and Dr. Sam Kacew, to inquire into the nature and extent of the danger posed by the substance taking into account the Terms of Reference below.

TERMS OF REFERENCE

1. The Board shall inquire into the nature and extent of the danger posed by the substance and will be governed by the Rules of Procedure for Boards of Review established pursuant to section 341 of the Act.

2. The Board may conduct hearings and accept evidence or representations provided in person, in writing or in electronic form, including by teleconference or videoconference.

3. Hearings conducted in person shall be held in the National Capital Region described in the Schedule to the National Capital Act.

4. No funding to any person or party to the inquiry shall be provided.

5. The Board shall use the automated document management program specified by the Minister for the purpose of its inquiry.

6. The Board shall submit, on or before March 31, 2011, a report, together with its recommendations and the evidence that was presented to it, to the Minister.

Significant New Activity Notice

(Section 85 of the Canadian Environmental Protection Act, 1999)

Whereas the Minister of the Environment and the Minister of Health have assessed information in respect of the substance Poly(oxy-1,2-ethanediyl), α-monoalkyl ethers-ω-mono(hydrogen maleate)-, under section 83 of the Canadian Environmental Protection Act, 1999;

Whereas the substance is not specified on the Domestic Substances List;

And whereas the Ministers suspect that a significant new activity in relation to the substance may result in the substance becoming toxic within the meaning of section 64 of the Canadian Environmental Protection Act, 1999,

Therefore, the Minister of the Environment indicates, pursuant to section 85 of the Canadian Environmental Protection Act, 1999, that subsection 81(4) of that Act applies to the substance in accordance with the Annex.

ANNEX

Information Requirements

(Section 85 of the Canadian Environmental Protection Act, 1999)

1. In relation to the substance Poly(oxy-1,2-ethanediyl), α-monoalkyl ethers-ω-mono(hydrogen maleate)-, a significant new activity is the use of the substance as a surfactant in a consumer product, in any quantity.

2. The following information must be provided to the Minister, at least 90 days before the commencement of each significant new activity:

(a) a description of the proposed significant new activity in relation to the substance;

(b) the information specified in Schedule 9 to the New Substances Notification Regulations (Chemicals and Polymers);

(c) the information specified in item 5 of Schedule 10 to those Regulations;

(d) the test data and the test report from a skin sensitization study concerning the substance, which establishes the concentration of the substance that will generate the minimal dose inducing a stimulation of proliferation in draining lymph nodes that is threefold the negative control (EC3 value), conducted according to the methodology described in the Organisation for Economic Co-operation and Development (OECD) Test Guideline No. 429 (Test Guideline) titled Skin Sensitisation: Local Lymph Node Assay, and in conformity with the practices described in the OECD Principles of Good Laboratory Practice (Principles of GLP) set out in Annex 2 of the Decision of the Council Concerning the Mutual Acceptance of Data in the Assessment of Chemicals, adopted on May 12, 1981, and where both the Test Guideline and Principles of GLP are current at the time the test data are developed;

(e) where the quantity of the substance involved in the significant new activity exceeds 50 000 kg per calendar year, the information specified in paragraphs 11(3)(a), (b) and (c) to those Regulations; and

(f) all other information or test data concerning the substance that are in the possession of the person who proposes the significant new activity, or to which they have access, and that are relevant to determine whether the substance is toxic or capable of becoming toxic.

3. The above information will be assessed within 90 days after the day on which it is received by the Minister.

EXPLANATORY NOTE

(This explanatory note is not part of the Significant New Activity Notice.)

A Significant New Activity Notice is a legal instrument issued by the Minister of the Environment pursuant to section 85 of the Canadian Environmental Protection Act, 1999. The Significant New Activity Notice sets out the appropriate information that must be provided to the Minister for assessment prior to the commencement of a new activity as described in the Notice.

Substances that are not listed on the Domestic Substances List can be manufactured or imported only by the person who has met the requirements set out in section 81 of the Canadian Environmental Protection Act, 1999. Under section 86 of the Canadian Environmental Protection Act, 1999, in circumstances where a Significant New Activity Notice is issued for a new substance, it is the responsibility of every person who transfers the physical possession or control of the substance to notify all persons to whom the possession or control is transferred of the obligation to comply with the Significant New Activity Notice and of the obligation to notify the Minister of the Environment of any new activity and all other information as described in the Notice. It is the responsibility of the users of the substance to be aware of and comply with the Significant New Activity Notice and to submit a Significant New Activity notification to the Minister prior to the commencement of a significant new activity associated with the substance. However, as mentioned in subsection 81(6) of the Canadian Environmental Protection Act, 1999, a Significant New Activity notification is not required when the proposed new activity is regulated under an act or regulations listed on Schedule 2 to the Canadian Environmental Protection Act, 1999.

A Significant New Activity Notice does not constitute an endorsement from Environment Canada or the Government of Canada of the substance to which it relates, or an exemption from any other laws or regulations that are in force in Canada and that may apply to this substance or activities involving the substance.

Notice No. SMBR-002-10 — BPR-10, Issue 1, Application Procedures and Rules for Digital Television (DTV) Undertakings

Notice is hereby given that Industry Canada is publishing Broadcasting Procedures and Rules: Part 10 (BPR-10), Issue 1, Application Procedures and Rules for Digital Television (DTV) Undertakings.

In August 2009, the Department released a provisional issue of BPR-10, to provide the application procedures and the operational requirements for DTV undertakings. This document has been updated and finalized to reflect the revised status of analog television, as well as the status of television channels 52 to 69 after August 31, 2011, as per the new Broadcasting Regulatory Policy (CRTC 2010-167), A group-based approach to the licensing of private television services, published by the Canadian Radio-television and Telecommunications Commission (CRTC) on March 22, 2010. Issue 1 of BPR-10 also reflects comments received in response to the publication of the provisional issue of the document.

The document BPR-10, Issue 1, will come into force as of the date of publication of this notice.
