Notice is hereby given that, pursuant to section 127 of the Canadian Environmental Protection Act, 1999, Disposal at Sea Permit No. 4543-2-06459 authorizing the loading for disposal and the disposal of waste or other matter at sea is approved.

 1. Permittee: Department of Fisheries and Oceans, Small Craft Harbours Branch, St. George, New Brunswick.

 2. Waste or other matter to be disposed of: Dredged material.

2.1. Nature of waste or other matter: Dredged material consisting of gravel, sand, silt and clay.

 3. Duration of permit: Permit is valid from January 1, 2011, to December 31, 2011.

3.1. The loading and disposal at sea activities are restricted to the following period(s): January 1, 2011, to April 30, 2011.

 4. Loading site(s): Seal Cove, New Brunswick: 44°38.87′ N, 66°50.40′ W (NAD83), as described in Drawing No. 1 (July 19, 2007) submitted in support of the permit application.

 5. Disposal site(s):

(a) Seal Cove Site 1, within a 100 m radius of 44°36.45′ N, 66°51.63′ W (NAD83); and

(b) Seal Cove Site 2, within a 100 m radius of 44°38.17′ N, 66°46.90′ W (NAD83).

 6. Method of loading: Dredging will be carried out using a barge-mounted mechanical dredge.

 7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site via towed or self-propelled scows, as described in the drawing titled “Proposed Disposal Locations” (January 10, 2007) submitted in support of the permit application.

 8. Method of disposal: Disposal shall take place in accordance with the dredged material disposal plan required by paragraph 14.2 of this permit.

 9. Total quantity to be disposed of: Not to exceed 90 000 m³ scow measure.

10. Fees: The fee prescribed by the Disposal at Sea Permit Fee Regulations shall be paid by the Permittee in accordance with those Regulations.

11. Inspection:

11.1. By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

11.2. Ships operating under the authority of this permit shall be marked in accordance with the Collision Regulations of the Canada Shipping Act when located on or in the waterway.

12. Contractors:

12.1. The loading or disposal at sea referred to under this permit shall not be carried out by any person without written authorization from the Permittee.

13. Reporting and notification:

13.1. The Permittee shall provide the following information at least 48 hours before loading and disposal activities commence: name or number of ship, platform or structure used to carry out the loading and/or disposal, name of the contractor including corporate and on-site contact information, and expected period of loading and disposal activities. The above-noted information shall be submitted to

13.2. The Permittee shall submit a written report to the Minister, as represented by the Regional Director of the Environmental Protection Operations Directorate, Atlantic Region, c/o Ms. Jayne Roma, as identified in paragraph 13.1, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: a list of all work completed pursuant to the permit, including the location of the loading and disposal site(s) used, the quantity of matter disposed of at the disposal site(s) and the dates on which disposal activities occurred.

13.3. The Canadian Coast Guard, Marine Communication and Traffic Services (MCTS) Sydney (1-800-686-8676) is to be notified in advance of the commencement of work so that appropriate Notices to Shipping/Mariners may be issued.

13.4. At all times, a copy of this permit and of documents and drawings referenced in this permit shall be available at the loading site and on all powered ships directly engaged in the loading and disposal operations.

14. Special precautions :

14.1. The loading and disposal at sea activities referred to under this permit shall be carried out in accordance with the mitigation measures summarized in the document titled “Environmental Screening Harbour Development Seal Cove Harbour, Charlotte County, New Brunswick” (November, 2007) submitted in support of the permit application.

14.2. The Permittee shall submit a dredged material disposal plan to Ms. Jayne Roma, as identified in paragraph 13.1, for approval by Environment Canada prior to commencement of the first dredging operation authorized by this permit. The plan shall address procedures to accurately measure or estimate quantities of dredged material disposed of at the disposal site(s), vessel tracking, and a schedule for use of the disposal site. Modifications to the plan shall be made only with the written approval of Environment Canada.

 1. Permittee: Torngat Fish Producers Co-operative Society Limited, Happy Valley-Goose Bay, Newfoundland and Labrador.

 2. Waste or other matter to be disposed of: Fish waste and other organic matter resulting from industrial fish processing operations.

2.1. Nature of waste or other matter: Fish waste and other organic matter consisting of fish and shellfish waste.

 3. Duration of permit: Permit is valid from October 10, 2010, to October 9, 2011.

 4. Loading site(s): Makkovik, Newfoundland and Labrador, at approximately 55°05.30′ N, 59°10.60′ W (NAD83).

 5. Disposal site(s): Makkovik, within a 250 m radius of 55°05.60′ N, 59°10.20′ W (NAD83), at an approximate depth of 37 m.

 6. Method of loading:

6.1. The Permittee shall ensure that the material is loaded onto floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved disposal site.

6.2. The Permittee shall ensure that the waste to be disposed of is covered by netting or other material to prevent access by gulls and other marine birds, except during direct loading or disposal of the waste.

6.3. Material loaded for the purpose of disposal at sea may not be held aboard any ship for more than 96 hours from the commencement of loading without the written consent of an enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999.

6.4. The loading and transit shall be completed in a manner that ensures that no material contaminates the marine environment, notably the harbour and adjacent beaches. The Permittee shall also ensure that the loading sites are cleaned up and, if necessary, that spilled wastes are recovered.

 7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site.

 8. Method of disposal:

8.1. The Permittee shall ensure that the waste to be disposed of is discharged from the equipment or ship while steaming within the disposal site boundaries and in a manner which will promote dispersion.

 9. Total quantity to be disposed of: Not to exceed 500 tonnes.

10. Inspection:

10.1. By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

11. Contractors:

11.1. The loading or disposal at sea referred to under this permit shall not be carried out by any person without written author-ization from the Permittee.

11.2. The Permittee shall ensure that all contractors involved in the loading or disposal activity for which the permit is issued adhere to the conditions identified in the permit and are aware of possible consequences of any violation of these conditions.

12. Reporting and notification:

12.1. The Permittee shall provide the following information at least 48 hours before loading and disposal activities commence: name or number of ship, platform or structure used to carry out the loading and/or disposal, name of the contractor including corporate and on-site contact information, and expected period of loading and disposal activities. NOTICE OF INTENT ON THE IN-COMMERCE SUBSTANCES LIST (ICL) NOMINATION PROCESS

The purpose of this Notice of Intent is to announce the start of the nomination process to the ICL.

Background of the In-Commerce Substances List (ICL)

On September 13, 2001, the Minister of Health announced that substances in products regulated by the Food and Drugs Act would be subject to the New Substances Notification Regulations (NSNR) now replaced by the New Substances Notification Regulations (Chemicals and Polymers) [NSNR (C&P)] and the New Substances Notification Regulations (Organisms) [NSNR (O)], under the Canadian Environment Protection Act, 1999, (CEPA 1999) because the Food and Drugs Act was no longer excluded from the requirements of CEPA 1999. To address this development, substances in products that were regulated under the Food and Drugs Act and that were in Canadian commerce between January 1, 1987, and September 13, 2001, were placed on the ICL until a regulatory framework could be developed to determine the potential environmental and indirect human health risks. The ICL was compiled from Health Canada records and contains approximately 9 000 substances. These substances include chemicals, polymers, and living organisms.

This list is known as the current ICL. The list is an administrative list without statutory authority.

In many cases the substances retrieved from Health Canada’s records were identified by common or trade names. For potential future regulatory activities such as risk assessment, it is important that each substance be accurately identified. Health Canada has undertaken to revise the ICL through a nomination process whereby stakeholders are encouraged to make nominations of substances which they believe meet the eligibility criteria. Upon receipt of a nomination and verification of the information provided, Health Canada will add the nominated substance to the list of verified substances. At the end of the nomination process, the “revised” ICL will be published in the Canada Gazette, Part I. A 90-day correction and review period will be followed by re-publication of the Revised ICL in the Canada Gazette, Part I.

Scope

The nomination process commenced in July 2010 and will end in July 2011.

The nomination process is divided into two phases. During Phase I, from July 2010 to October 2010, a previously identified group of companies will submit nominations of substances contained in their products that were regulated under the Food and Drugs Act and which were in Canadian commerce between January 1, 1987, and September 13, 2001. Phase II will begin no later than March 2011, and will be open to all manufacturers, importers, distributors and users.

Planned actions

A. The current ICL

The current ICL, as it appears on Health Canada’s Web site, is divided into four separate lists:

(1) All Food and Drugs Act substances except cosmetics;

(2) Cosmetics substances with associated Chemical Abstracts Service Registry Numbers (CAS RNs);

(3) Cosmetic substances with no associated CAS RNs; and

(4) Cosmetic substances of unknown chemical identity.

B. The revised ICL

Prior to launching the nomination process, Health Canada has reviewed a subset of the entries that had a CAS RN, and where possible, confirmed their CAS RNs. The resulting verified entries are posted on the Health Canada Web site at www.hc-sc.gc.ca/ ewh-semt/contaminants/person/impact/list/revised-icl_lsc-revisee-eng.php. These entries comprise the initial “revised ICL.” The nomination process is intended to build upon this initial step.

C. Nomination forms for Phase I nominators

Nominators will be requested to provide information to Health Canada by completing and submitting in hard copy the form available on the Health Canada Web site. The form may also be obtained from the Publications Office of Health Canada at the following address:

There are two forms. One form is intended for the nomination of chemicals and polymers and a second form is intended for the nomination of living organisms.
