PROPOSED NOTICE REQUIRING THE PREPARATION AND IMPLEMENTATION OF POLLUTION PREVENTION PLANS WITH RESPECT TO BISPHENOL A IN INDUSTRIAL EFFLUENTS

 1. Definitions

The definitions in this section apply to this Notice.

“Act” means the Canadian Environmental Protection Act, 1999 (CEPA 1999).

“Bisphenol A or BPA” means Phenol, 4,4′ -(1-Methylethylidene)bis-, Chemical Abstracts Service (CAS) (see footnote 1) Number 80-05-7.

“Calendar year” refers to a complete year beginning January 1 and ending December 31.

“Final discharge point” is an identifiable discharge point beyond which the industrial facility owner or operator no longer exercises control over quality of the effluent.

“Effluent” means wastewater from an industrial facility released into the municipal sewer wastewater system or to surface water.

“Plan” means a pollution prevention plan.

“Pulp and paper deinking” means the use of mechanical and/or chemical processes on pulp fibres recovered from waste paper and paper board products, to separate the pulp fibres from attached ink and pigment particles.

“Composite sample”, in respect of an industrial facility, means

(a) For an industrial facility that continuously releases effluent during a period of 24 hours,

(i) a volume of effluent that consists of not less than three equal volumes, or three volumes proportionate to the rate of flow of the effluent, that have been collected at approximately equal time intervals that, combined, span at least 7 hours and at most 24 hours, or

(ii) a volume of effluent collected continuously over a period of 24 hours at a constant rate, or at a rate proportionate to the rate of flow of the effluent; and

(b) In any other case, grab samples of equal volumes taken every hour during which the industrial facility deposits effluent.

 2. Person or class of persons required to prepare and implement a plan

(1) This Notice applies to any person or class of persons who owns and/or operates an industrial facility that, during the calendar year prior to the date of publication of the Notice, or any calendar year thereafter meets the three following criteria:

(a) Manufactures or uses bisphenol A or a mixture containing bisphenol A;

(b) The total quantity of bisphenol A manufactured or used is equal or greater than 100 kg; and

(c) As a result of manufacturing or use of bisphenol A or a mixture containing bisphenol A, the effluent at the final discharge point of the facility contains bisphenol A.

(2) The Notice applies to any person or class of persons who is the successor or assign of the persons identified in subsection 2(1).

(3) Despite subsection 2(1), this Notice does not apply to any person or class of persons who releases an effluent containing bisphenol A resulting exclusively from pulp and paper deinking activities, scientific research or laboratory testing.

 3. Activities in relation to which the plan is to be prepared

(1) Persons or a class of persons identified in section 2 of the Notice to prepare and implement a plan in relation to the release of bisphenol A in effluents through

(a) the manufacture of bisphenol A or a mixture(s) containing bisphenol A; or

(b) the use of bisphenol A or a mixture(s) that contains bisphenol A during manufacturing or other processing activities.

(2) Despite subsection 3(1), a plan does not have to be prepared and implemented in relation to release of bisphenol A resulting exclusively from pulp and paper deinking activities, scientific research or laboratory testing.

 4. Factors to consider in preparing the plan

The Minister requires all persons or class of persons identified in section 2 of the Notice to consider the following factors when preparing their plan:

(1) The risk management objective for this Notice is to achieve and maintain a total bisphenol A concentration that is less than or equal to 1.75 µg/L in effluent released at the final discharge point of the facility, through methods other than dilution, by December 31, 2015.

(2) In order to prevent or minimize releases of bisphenol A to the environment, the ecological risk management objective is to achieve the lowest level of release of bisphenol A to environment that is technically and economically feasible. Therefore, continual improvement towards achieving this objective is encouraged.

(3) Bisphenol A was declared toxic under section 64 of the Act and has been added to the List of Toxic Substances in Schedule 1 of the Act. According to the Final Screening Assessment Report, bisphenol A is entering or may be entering the environment in a quantity or concentration or under conditions that have or may have an immediate or long-term harmful effect on the environment or its biological diversity or constitute or may constitute a danger in Canada to human life or health. Bisphenol A is acutely toxic to aquatic organisms and is a known endocrine disruptor. The final Screening Assessment Report for bisphenol A is available online at www.ec.gc.ca/substances/ese/eng/challenge/batch2/batch2_80-05-7_en.pdf.

(4) The use of pollution prevention planning should be prioritized as a means of addressing the release to the environment of toxic substances or other pollutants. In preparing a plan, a person subject to the Notice should give priority to pollution prevention activities rather than control activities. “Pollution prevention,” as defined in section 3 of the Act, means “the use of processes, practices, materials, products, substances or energy that avoids or minimizes the creation of pollutants and waste and reduces the overall risk to the environment or human health.”

(5) The use of alternatives to bisphenol A should be considered to reduce or minimize environmental risks. The chosen alternatives should not have, through their degradation, the potential to produce bisphenol A, nor should such alternatives cause similar environmental effects.

(6) Sampling and analysis should be completed as described below:

(a) The sampling should be representative of regular or typical operating conditions related to the manufacturing or use of bisphenol A;

(b) Samples should be undiluted, unfiltered and representative of the industrial facility’s effluent;

(c) Samples should be collected and analysed at a minimum of four times per year using a composite sampling method; and

(d) Analysis of the samples should be performed in accordance with generally accepted standards of good scientific practice at the time of the analysis by a laboratory that is accredited by a Canadian accrediting body under the International Organization for Standardization standard ISO/ IEC 17025: 2005 entitled General Requirements for the Competence of Testing and Calibration Laboratories, as amended from time to time.

(7) Additional documents that should be kept with the plan:

(a) a description and the location (maps) of all final discharge points; and

(b) a description of the factors (e.g. type of technology, human factor, accidental releases, type of manufacturing, daily use) that could increase the quantity or concentration of the substance in the facility’s effluent.

(8) Implementation of the plan should include one year of monitoring which involves sampling and analysis at the final discharge point(s) after meeting the risk management objective set in subsection 4(1). Sampling and analysis should be conducted as specified in subsection 4(6).

(9) The Minister will evaluate the effectiveness of this Notice with respect to the risk management objectives set out in subsections 4(1) and (2) of the Notice in order to determine whether other measures, including regulations, are needed to further prevent or reduce negative impacts of bisphenol A on the environment or human health.

 5. Period within which the plan is to be prepared

(1) For a person or class of persons subject to the final Notice on the date of publication in the Canada Gazette, Part I, the Minister requires that the plan be prepared and that its implementation be initiated no later than December 31, 2012.

6.0 Monitoring and Reporting

Describe the monitoring and reporting used to track progress in implementing the pollution prevention plan.

7.0 Risk Management Objective

Describe how the pollution prevention plan met the risk management objectives identified in sections 4(1) and 4(2) of the Notice:

(1) The risk management objective for this Notice is to achieve and maintain a concentration of total bisphenol A that is less than or equal to 1.75 µg/L in the effluent released at the final discharge point, through methods other than dilution, by December 31, 2015.

(2) In order to prevent or minimize releases of bisphenol A to the environment, the ecological risk management objective is to achieve the lowest level of release of bisphenol A to environment that is technically and economically feasible. Therefore, continuous improvement towards achieving this objective is encouraged.

If this plan did not meet the risk management objectives, explain why.

This ends the section (Parts 3.0 through 7.0) to be completed separately for each Activity specified in Part 3.0 above.

8.0 Factors to Consider
