Notice is hereby given that, on March 1, 2011, further to a judgment of the Federal Court of Appeal dated July 20, 2010, which set aside the determination of the Canadian International Trade Tribunal (the Tribunal) in File No. PR-2008-048 made on June 23, 2009, and remitted the matter to the Tribunal, the Tribunal made a re-determination (File No. PR-2008-048R). This re-determination was related to a complaint filed by Almon Equipment Limited, of Toronto, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47 [CITT Act], concerning a procurement (Solicitation No. W0125-088713/B) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for aircraft ground de-icing services.
Pursuant to subsection 30.14(2) of the CITT Act, the Tribunal determined that the complaint was valid in part.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2010-090) from Opsis, Gestion d’infrastructures Inc. (Opsis), of Montréal, Quebec, concerning a procurement (Solicitation No. K4C20-091012/B) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of the Environment. The solicitation is for the maintenance and operation of mechanical and electrical systems at the Canadian Meteorological Centre in Dorval, Quebec. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.
Opsis alleges that PWGSC evaluated its proposal improperly.

Call for comments on the addition of six non-Canadian services to the lists of eligible satellite services for distribution on a digital basis
The Commission calls for comments on Soundview Entertainment Inc.’s (Soundview) request for the addition of six non-Canadian services to the lists of eligible satellite services for distribution on a digital basis. Parties submitting comments on the requests should also submit a true copy of their comments to the Canadian sponsor, Soundview.
Comments on Soundview’s request must be received by the Commission no later than March 23, 2011. A copy of the comments must be received by Soundview no later than the deadline for receipt of comments by the Commission.
Soundview may file a written reply to any comments received concerning its request. This reply should be filed with the Commission, and a copy sent to the person who submitted the comments, by no later than April 7, 2011.

Further to Broadcasting Notice of Consultation 2010-783, the Commission would like to inform interested parties of an additional matter that it wishes to consider as part of this proceeding.
In Public Notice 1996-69, the Commission eliminated the application of the benefits test in the case of transfers of ownership or changes in control of distribution undertakings. The Commission concluded that, “with adoption by the Commission of a policy that removes all or most of the existing licensing restrictions on market entry and which, in fact, encourages the imminent entry of new competitors using a variety of distribution technologies, the underlying rationale for applying the benefits test in considering future applications for authority to transfer the ownership or control of distribution undertakings has essentially disappeared.”
In light of the growing trend of industry consolidation and vertical integration, the Commission would like to examine whether the above determination on the application of the benefits tests should be upheld or reversed.
Interested parties who wish to comment on this matter may do so on or before April 27, 2011.

Broadcasting licence fees — Part I
1. The Broadcasting Licence Fee Regulations, 1997 (the Regulations) provide for the payment of a Part I licence fee by certain broadcasting undertakings. Subsection 9(1) of the Regulations sets out the components for the calculation of the regulatory costs.
2. Pursuant to section 10 of the Regulations, the Commission announces in this public notice that the estimated total broadcasting regulatory costs of the Commission for the 2011–2012 fiscal year are $29.881 million.
3. The annual adjustment amount referred to in subsection 8(2) for the 2009–2010 fiscal year is $2.060 million.
4. The net billing for the Part I licence fee for the 2011–2012 fiscal year, taking into account the adjustment in paragraph 3 above, is $31.941 million. This amount is $3.871 million lower (i.e. a 10.8% decrease) than the 2010–2011 net billing of $35.812 million. This decrease is due primarily to the end of two years of temporary funding for the CRTC’s broadcasting activities announced in Notification of a temporary increase to CRTC Part I Broadcasting Licence Fees and Telecommunications Fees, Broadcasting Circular CRTC 2007-9, December 21, 2007.
