SPECIAL IMPORT MEASURES ACT

Large line pipe — Decisions

On September 20, 2016, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) made final determinations of dumping in respect of certain welded large diameter carbon and alloy steel line pipe (large line pipe) originating in or exported from the People's Republic of China (China) and Japan, and subsidizing of large line pipe from China.

The goods in question are usually classified under the following Harmonized System classification numbers:

The Canadian International Trade Tribunal (CITT) is continuing its inquiry into the question of injury to the domestic industry and will make a finding by October 20, 2016. Provisional duties relating to the dumping and subsidizing of the goods will continue to apply until this date on imports of subject goods from China and Japan.

If the CITT finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, anti-dumping duty and/or countervailing duty will be applied to future importation of the subject goods. In that event, the importer in Canada shall pay all such duties.

The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping and countervailing duty.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2016-035) from Agence Gravel Inc. (Agence Gravel), of Québec, Quebec, concerning a procurement (Solicitation No. M8500-14R086/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Royal Canadian Mounted Police. The solicitation is for 7.62 mm fast-attach firearm suppressors. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on September 20, 2016, to conduct an inquiry into the complaint.

Agence Gravel alleged that PWGSC's decision to cancel the Request for a Standing Order was illegal and contravened the contract binding it to Agence Gravel.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2016-034) from Bravo Zulu Productions Inc. (Bravo Zulu), of North Vancouver, British Columbia, concerning a procurement (Solicitation No. EZ899-162881/A) by Public Services and Procurement Canada (PSPC). The solicitation is for audio visual production services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on September 19, 2016, to conduct an inquiry into the complaint.

Bravo Zulu alleges that PSPC failed to follow the evaluation criteria set out in the Request for Proposal in selecting a different bidder and requests the Tribunal to determine the amount of compensation that should flow from this breach.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

ORDER

Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) issued an order (File No. PR-2016-020) on September 9, 2016, with respect to a complaint filed by Canadian Maritime Engineering Ltd. (Canadian Maritime Engineering), of St. Catharines, Ontario, concerning a procurement by the St. Lawrence Seaway Management Corporation on behalf of the Department of Transport. The solicitation was for the operation of the Port Weller dry dock and marine facility.

Pursuant to paragraph 10(b) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, the Tribunal dismissed the complaint and terminated all proceedings relating thereto.
