APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES
11772244 Canada Inc.
By an application dated December 11, 2019, 11772244 Canada Inc. (the “Applicant”) has applied to the Commission of the Canada Energy Regulator (the “Commission”), under Division 2 of Part 7 of the Canadian Energy Regulator Act (the “Act”), for authorization to export up to 4 500 000 MWh of combined firm and interruptible energy annually for a period of 10 years.
The Commission wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The directions on procedure that follow explain in detail the procedure that will be used.
- The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at 11772244 Canada Inc., 601-1811 William Street, Montréal, Quebec, 438‑490‑5559 (telephone), and provide a copy of the application to any person who requests one. A copy of the application is available for viewing during normal business hours, by appointment, in the Canada Energy Regulator’s library, at 517 Tenth Avenue SW, 2nd Floor, Calgary, Alberta T2R 0A8. - Submissions that any party wishes to present shall be filed with the Secretary of the Commission of the Canada Energy Regulator, 517 Tenth Avenue SW, Suite 210, Calgary, Alberta T2R 0A8, 403‑292‑5503 (fax), and served on the Applicant by January 22, 2020.
- Pursuant to subsection 359(2) of the Act, the Commission is interested in the views of submitters with respect to
- (a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported; and
- (b) whether the Applicant has
- (i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
- (ii) given an opportunity to buy electricity on conditions as favourable as the conditions specified in the application to those who, within a reasonable time after being so informed, demonstrate an intention to buy electricity for consumption in Canada.
- Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Commission and served on the party that filed the submission by February 5, 2020.

EXPIRY REVIEW OF FINDING

The Canadian International Trade Tribunal hereby gives notice that it will, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiate an expiry review (Expiry Review No. RR-2019-003) of its finding made on January 9, 2015, in Inquiry No. NQ-2014-001, concerning the dumping of hot-rolled deformed steel concrete reinforcing bar in straight lengths or coils, commonly identified as rebar, in various diameters up to and including 56.4 mm, in various finishes, excluding plain round bar and fabricated rebar products, originating in or exported from the People’s Republic of China, the Republic of Korea and the Republic of Turkey, and the subsidizing of the aforementioned goods originating in or exported from the People’s Republic of China. In accordance with the Tribunal’s finding in Inquiry No. NQ-2014-001, the product definition also excludes 10-mm-diameter (10M) rebar produced to meet the requirements of CSA G30 18.09 (or equivalent standards) and coated to meet the requirements of epoxy standard ASTM A775/A 775M 04a (or equivalent standards) in lengths from 1 foot (30.48 cm) up to and including 8 feet (243.84 cm).
In this expiry review, the Canada Border Services Agency (CBSA) will first determine whether the expiry of the finding in respect of the subject goods is likely to result in the continuation or resumption of dumping and subsidizing of the subject goods. If the CBSA determines that the expiry of the finding in respect of any goods is likely to result in the continuation or resumption of dumping and subsidizing, the Tribunal will then conduct an expiry review to determine if the continued or resumed dumping and subsidizing are likely to result in injury. The CBSA will provide notice of its determinations within 150 days after receiving notice of the Tribunal’s decision to initiate an expiry review, that is, no later than May 7, 2020. The Tribunal will issue its order and its statement of reasons no later than October 14, 2020.
Each person or government wishing to participate in this expiry review must file a notice of participation with the Tribunal on or before May 22, 2020. Each counsel who intends to represent a party in the expiry review must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before May 22, 2020.

The Tribunal will hold a public hearing relating to this expiry review in the Tribunal’s Hearing Room No. 1, 18th Floor, 333 Laurier Avenue West, Ottawa, Ontario, commencing on August 4, 2020, at 9:30 a.m., to hear evidence and representations by interested parties. If there are no opposing parties, the Tribunal may explore the possibility of a holding a file hearing, i.e. a hearing through written submissions only, instead of an oral hearing.
In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

Project management services
The Canadian International Trade Tribunal has received a complaint (File No. PR-2019-049) from Opus Leaders Inc. (Opus), of Stittsville, Ontario, concerning a procurement (Solicitation No. 19364-190004/B) by the Department of Public Works and Government Services (PWGSC). The solicitation is for the provision of project management services for the Department of Justice. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on December 9, 2019, to conduct an inquiry into the complaint.
Opus alleges that the tender documentation does not provide all pertinent details concerning the evaluation criteria used in the evaluation.
