Regulations Repealing the Cooperatives Tariff of Fees (Miscellaneous Program)

Her Excellency the Governor General in Council, on the recommendation of the Minister of Industry, pursuant to subsection 372(1) (see footnote a) of the Canada Cooperatives Act (see footnote b), hereby makes the annexed Regulations Repealing the Cooperatives Tariff of Fees (Miscellaneous Program).

REGULATIONS REPEALING THE COOPERATIVES TARIFF OF FEES (MISCELLANEOUS PROGRAM)

REPEAL

1. The Cooperatives Tariff of Fees (see footnote 1) is repealed.

COMING INTO FORCE

2. These Regulations come into force on the day on which they are registered.

Description

The objective of these Regulations is to repeal the Cooperatives Tariff of Fees (Tariff) because it is spent (i.e. no longer enforced).

In 1998, the Canada Cooperatives Associations Act (the old Act), and its associated regulations, was replaced by the Canada Cooperatives Act (the new Act) with its associated regulations. At that time the Cooperatives Tariff of Fees, which was a regulation under the old Act, was not repealed although the regulations under the new Act included a schedule of fees. Since 1998, only the fees under the new Act have been charged since only the services under that Act have been provided by Corporations Canada. The Cooperatives Tariff of Fees is inconsistent with the provisions set out in the current fee schedule because both covered similar services (e.g., incorporation, continuance or amalgamation) although under different statutes. Since the old Act has been repealed, the Cooperatives Tariff of Fees is no longer enforced and should be repealed.

The amendments to these Regulations are of a technical nature. They do not reflect substantive changes to the Regulations they modify, but repeal spent regulations.

It is expected that the repealing of the Tariff will have no impact on Canadians.
