Hazardous Products Act (Baby Walkers)

Her Excellency the Governor General in Council, on the recommendation of the Minister of Health, pursuant to section 6 (see footnote a) of the Hazardous Products Act (see footnote b), being satisfied that certain products are or are likely to be a danger to the health or safety of the public by reason of their design, construction or contents, hereby makes the annexed Order Amending Part I of Schedule I to the Hazardous Products Act (Baby Walkers) (Miscellaneous Program).

ORDER AMENDING PART I OF SCHEDULE I TO THE
HAZARDOUS PRODUCTS ACT (BABY WALKERS)
(MISCELLANEOUS PROGRAM)

AMENDMENT

1. Item 12 of Part I of Schedule I to the French version of the Hazardous Products Act (see footnote 1) is replaced by the following:

12. Marchette pour bébé qui est montée sur des roues ou d’autres objets en permettant le déplacement et qui comporte une enceinte maintenant le bébé en position assise ou debout, de sorte que ses pieds puissent toucher le sol et ainsi déplacer horizontalement la marchette.

Description

The purpose of this Order is to amend the French version of item 12 of Part I of Schedule I to the Hazardous Products Act (Baby Walkers), to provide a greater degree of correlation between the French and English versions. The inconsistencies between the French and English versions were due to an administrative error that was noticed by the Health Canada (HC) Health Drafting Services Section.

On March 23, 2004 (SOR/2004-46), HC prohibited the advertisement, sale, and importation of baby walkers in Canada by adding item 12 to Part I of Schedule I to the Hazardous Products Act (HPA). In English, item 12 reads as follows:

12. Baby walkers that are mounted on wheels or any other device permitting movement of the walker and that have an enclosed area supporting the baby in a sitting or standing position so that their feet touch the floor, thereby enabling the horizontal movement of the walker,
and in French it reads:

12. Marchette pour bébés montée sur roues ou autres objets similaires et comportant une enceinte qui supporte le bébé en position assise ou debout de sorte que ses pieds puissent toucher le sol et ainsi permettre le déplacement horizontal de la marchette.

As it was published in March 2004, the French version was more restrictive than the English version since the baby walker in the French version had to be mounted on wheels or other similar devices meaning that the similar devices had to be comparable to wheels whereas the English version is much broader since the devices can be any other devices and do not have to be comparable to wheels. Therefore, item 12 in French will be amended to read:

12. Marchette pour bébé qui est montée sur des roues ou d’autres objets en permettant le déplacement et qui comporte une enceinte maintenant le bébé en position assise ou debout, de sorte que ses pieds puissent toucher le sol et ainsi déplacer horizontalement la marchette.

This amendment will have no impact on industry or the Canadian population. The purpose of the Miscellaneous Amendment Regulations Program is to simplify the regulatory process and to minimize regulatory costs.

Pursuant to the requirements of subsection 7(1) of the HPA, the Minister of Health shall cause a copy of the Order, amending Part I or II of Schedule I of said Act, to be laid before each House of Parliament on any of the first fifteen days on which that House is sitting (after the day the Order is made) and accordingly, it is necessary to table this legally binding prohibition.
