AN ACT TO AMEND THE CANADA MARINE ACT, THE CANADA TRANSPORTATION ACT, THE PILOTAGE ACT AND OTHER ACTS IN CONSEQUENCE

Order Fixing August 1, 2008 as the Date of the Coming into Force of the Act, Other Than Section 64

Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, Infrastructure and Communities, pursuant to section 66 of An Act to amend the Canada Marine Act, the Canada Transportation Act, the Pilotage Act and other Acts in consequence, assented to on June 18, 2008, being chapter 21 of the Statutes of Canada, 2008, hereby fixes August 1, 2008 as the day on which that Act, other than section 64, comes into force.

EXPLANATORY NOTE

(This note is not part of the Order.)

The Order fixes August 1, 2008 as the day on which An Act to amend the Canada Marine Act, the Canada Transportation Act, the Pilotage Act and other Acts in consequence, being chapter 21 of the Statutes of Canada, 2008, comes into force. The enactment amends the Canada Marine Act to clarify and make technical changes to certain provisions. The amendments modify the Act’s purpose, modify the rules governing a port authority’s access to federal funding, add provisions regarding the power of a port authority to borrow money, provide additional regulatory powers to the Governor in Council, add provisions regarding the amalgamation of port authorities, modify provisions regarding the appointment of directors of port authorities, add a penalty scheme and streamline certain other enforcement provisions. The enactment also includes a transitional provision, corrections to two other Acts and consequential amendments to other Acts. Section 64 of the enactment is not included in the Order as it came into force on the date of assent in accordance with section 66 of the enactment and section 5 of the Interpretation Act.
