Regulations Amending the Exemption Regulations (Persons) (Miscellaneous Program)

Her Excellency the Governor General in Council, on the recommendation of the Minister of Foreign Affairs, pursuant to paragraph 12(e) (see footnote a) of the Export and Import Permits Act (see footnote b), hereby makes the annexed Regulations Amending the Exemption Regulations (Persons) (Miscellaneous Program).

REGULATIONS AMENDING THE EXEMPTION REGULATIONS (PERSONS) (MISCELLANEOUS PROGRAM)

AMENDMENT

1. Paragraph 1(d) of the French version of the Exemption Regulations (Persons) (see footnote 1) is replaced by the following:

d) toute personne désignée à titre d’agent des pêches en vertu de la Loi sur les pêches, dans l’exercice des attributions que lui confère cette loi ou la Loi sur la protection des pêches côtières;

2. These Regulations come into force on the day on which they are registered.

Issue and objectives

The Department of Foreign Affairs and International Trade (DFAIT) seeks to correct inconsistent wording in the French version of the Exemption Regulations (Persons).

Description and rationale

On February 28, 2008, the Exemption Regulations (Persons) were registered by the Clerk of the Privy Council as SOR/2008-45.

In a letter of June 25, 2008, the Standing Joint Committee for the Scrutiny of Regulations brought to the attention of DFAIT the usage of inconsistent terminology between the English and French versions of these Regulations. Specifically, it was noted that while the phrase “duties and functions” in the English version of paragraph 1(a) is rendered in the French version as “les attributions,” the English phrase “duties or functions” used in paragraph 1(d) was rendered in the French version as “des fonctions.” An amendment to the French version of the Regulations that ensures a consistent translation of the English phrases “duties and functions” and “duties or functions” will provide greater consistency in terminology within the Regulations.

The costs associated with this amendment will be limited to the administrative costs of making the amendment and its publication.

Consultation

The amendment does not involve a policy change regarding the import or export of controlled items and will not have any impact on Canadian industry; therefore, public consultation was deemed unnecessary.

Implementation, enforcement and service standards

The Canada Border Services Agency and the Royal Canadian Mounted Police are responsible for enforcement of export controls.
