FARM PRODUCTS AGENCIES ACT
Whereas the Governor in Council has, by the Canadian Hatching Egg Producers Proclamation (see footnote a), established Canadian Hatching Egg Producers (“Agency”) pursuant to subsection 16(1) (see footnote b) of the Farm Products Agencies Act (see footnote c);
Whereas the Agency has been empowered to implement a marketing plan pursuant to that Proclamation;
Whereas the proposed Order Amending the Canadian Broiler Hatching Egg Marketing Levies Order is an order of a class to which paragraph 7(1)(d) (see footnote d) of that Act applies by reason of section 2 of the Agencies’ Orders and Regulations Approval Order (see footnote e), and has been submitted to the National Farm Products Council pursuant to paragraph 22(1)(f) of that Act;
And whereas, pursuant to paragraph 7(1)(d) (see footnote f) of that Act, the National Farm Products Council has approved the proposed Order, after being satisfied that it is necessary for the implementation of the marketing plan that the Agency is authorized to implement;
Therefore, Canadian Hatching Egg Producers, pursuant to paragraph 22(1)(f) of the Farm Products Agencies Act (see footnote g) and section 8 of the schedule to the Canadian Hatching Egg Producers Proclamation (see footnote h), hereby makes the annexed Order Amending the Canadian Broiler Hatching Egg Marketing Levies Order.

ORDER AMENDING THE CANADIAN BROILER HATCHING EGG MARKETING LEVIES ORDER
AMENDMENTS
1. (1) Paragraph 2(1)(b) of the Canadian Broiler Hatching Egg Marketing Levies Order (see footnote 1) is replaced by the following:
(b) in the Province of Quebec, $0.0056;
(2) Subsection 2(2) of the Order is replaced by the following:
(2) A levy is imposed on a producer, dealer or hatchery operator in a non-signatory province of $0.007005 per broiler hatching egg produced in a non-signatory province and marketed by that producer, dealer or hatchery operator in interprovincial trade into a signatory province.
COMING INTO FORCE
2. This Order comes into force on March 29, 2009 immediately after the coming into force of the Order Amending the Canadian Broiler Hatching Egg Marketing Levies Order, SOR/2009-72, but if this Order is registered after that day, it comes into force on the day on which it is registered.
EXPLANATORY NOTE
(This note is not part of the Order.)
The amendments increase the levy imposed on producers in Quebec for broiler hatching eggs marketed by those producers in interprovincial or export trade and increase the levy on producers, dealers and hatchery operators in non-signatory provinces for broiler hatching eggs marketed in interprovincial trade into signatory provinces.
