IMMIGRATION AND REFUGEE PROTECTION ACT

Regulations Amending the Immigration and Refugee Protection Regulations (Section 87.1)

Her Excellency the Governor General in Council, on the recommendation of the Minister of Citizenship and Immigration, pursuant to subsections 5(1) and 14(2) and section 26 of the Immigration and Refugee Protection Act (see footnote a), hereby makes the annexed Regulations Amending the Immigration and Refugee Protection Regulations (Section 87.1).

REGULATIONS AMENDING THE IMMIGRATION AND REFUGEE PROTECTION REGULATIONS (SECTION 87.1)

AMENDMENT

1. Section 87.1 of the Immigration and Refugee Protection Regulations (see footnote 1) , as enacted by section 5 of the Regulations Amending the Immigration and Refugee Protection Regulations, SOR/2008-202, is renumbered as subsection 87(12).

COMING INTO FORCE

2. These Regulations come into force on the day on which they are registered.

Issue and objectives

On June 12, 2008, a regulatory amendment to the Provincial Nominee Program relating to requirements for accompanying family members was registered under section 87.1 of the Immigration and Refugee Protection Regulations (SOR/2008-202). In August 2008, new regulations were introduced for the Canadian Experience Class, which were also given the numbering of 87.1.

A regulatory amendment is needed to renumber section 87.1 of the Immigration and Refugee Protection Regulations, as enacted in SOR/2008-202, to section 87(12).

Description and rationale

Section 87.1 of the Immigration and Refugee Protection Regulations, as enacted by section 5 of the Regulations Amending theImmigration and Refugee Protection Regulations, SOR/2008-202, is to be renumbered as section 87(12).

The amendment will address the irregularity in the numbering of the Regulations. No impacts are expected as the amendment is strictly technical.

Consultation

Consultations were held with officials responsible for the programs affected at Citizenship and Immigration Canada, including the Department Legal Services Unit. The consultation resulted in a consensus to proceed with the proposed renumbering.
