Regulations Amending Certain Department of Transport Regulations (Miscellaneous Program)

Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, Infrastructure and Communities, hereby makes the annexed Regulations Amending Certain Department of Transport Regulations (Miscellaneous Program), pursuant to:

(a) section 4.9 (see footnote a) of the Aeronautics Act (see footnote b); and

(b) subsection 2(1) (see footnote c) of the Government Property Traffic Act (see footnote d).

CHARTER FLIGHTS AIRPORT FACILITIES RESERVATION REGULATIONS

1. (1) The reference

CANADIAN COMPUTER RESERVATION SYSTEMS (CRS) REGULATIONS

2. Subsection 11(1) of the French version of the Canadian Computer Reservation Systems (CRS) Regulations (see footnote 2) is amended by replacing the word “périodiquement” with the words “de temps à autre”.

3. Subsection 17(1) of the French version of the Regulations is replaced by the following:

17. (1) Le serveur de système doit permettre à tout transporteur de participer à ses infrastructures de distribution et à ses services supplémentaires, sous réserve des contraintes techniques indépendantes de sa volonté.

4. Section 25 of the French version of the Regulations is replaced by the following:

REGULATORY IMPACT
ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Description

The Regulations Amending Certain Department of Transport Regulations (Miscellaneous Program) modify regulations in order to reflect the change of the name of two international airports.

Halifax International Airport was renamed “Halifax Robert L. Stanfield International Airport” to pay tribute to the former Premier of Nova Scotia, Robert L. Stanfield. The new name was proclaimed February 9, 2007.

Winnipeg International Airport was renamed “Winnipeg James Armstrong Richardson International Airport” to honour James Armstrong Richardson, father of commercial aviation in Canada. The new name became effective December 10, 2006.

Appropriate amendments changing airport references to the new names are being made to the Canadian Aviation Regulations, Charter Flights Airport Facilities Reservation Regulations, the Airport Traffic Regulations and the Traffic on the Land Side of Airports Regulations.

In addition, the Regulations Amending Certain Department of Transport Regulations (Miscellaneous Program) contain amendments to the Canadian Computer Reservation Systems (CRS) Regulations (the CRS Regulations) that deal with issues raised by the Standing Joint Committee for the Scrutiny of Regulations (SJCSR).

In response to SJCSR concerns, subsection 11(1) of the French version of the CRS Regulations is amended by replacing the word “périodiquement” with the expression “de temps à autre” in order to correct the discrepancy between the two versions. SJCSR indicated that according to the English version, a system vendor is not obligated to offer the choice periodically, only from time to time.

Furthermore, the SJCSR indicated that subsection 17(1) and section 25 of the French version of the CRS Regulations contain the expression “le cas échéant” for which there is no equivalent expression in the English version. They pointed out that the expression is not necessary and therefore should be deleted from the French version.
