AN ACT TO AMEND THE MARINE LIABILITY ACT AND THE FEDERAL COURTS ACT AND TO MAKE CONSEQUENTIAL AMENDMENTS TO OTHER ACTS

Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, Infrastructure and Communities, pursuant to subsection 24(2) of An Act to amend the Marine Liability Act and the Federal Courts Act and to make consequential amendments to other Acts, chapter 21 of the Statutes of Canada, 2009, hereby fixes, as the day on which sections 11, 13, 17 and 19 to 23 of that Act come into force, the day that is the first day on which both of the following are in force in Canada:
(a) the International Convention on Civil Liability for Bunker Oil Pollution Damage, 2001;
(b) the Protocol of 2003 to the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage, 1992.
EXPLANATORY NOTE
(This note is not part of the Order.)
The Order fixes, as the day on which sections 11, 13, 17 and 19 to 23 of An Act to amend the Marine Liability Act and the Federal Courts Act and to make consequential amendments to other Acts (“the Act”) come into force, the day that is the first day on which both of the following are in force in Canada:
(a) the International Convention on Civil Liability for Bunker Oil Pollution Damage, 2001;
(b) the Protocol of 2003 to the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage, 1992.
Section 11 of the Act
(a) amends Part 6 of the Marine Liability Act to implement the Protocol of 2003 to the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage, 1992 as well as the International Convention on Civil Liability for Bunker Oil Pollution Damage, 2001;
(b) continues, in Part 7, the Ship-source Oil Pollution Fund and modernizes its governance; and
(c) includes, in Part 8, general provisions relating to the administration and enforcement of offences under the Marine Liability Act.
Sections 13, 17 and 19 to 23 of the Act enact provisions that are related to the amendments made by section 11 of the Act.
