BROADCASTING ACT

Order Declining to Refer Back to the CRTC Decision CRTC 2009-673

Whereas the Canadian Radio-television and Telecommunications Commission (“the Commission”) rendered Broadcasting Decision CRTC 2009-673 on October 27, 2009, which approved the application by the Canadian Broadcasting Corporation for a broadcasting licence to operate an English-language FM radio programming undertaking to replace its existing AM station CFWH in Whitehorse, Yukon;

Whereas, subsequent to the rendering of the decision, the Governor in Council received a petition requesting that the decision be referred back to the Commission for reconsideration and hearing of the matter;

And whereas the Governor in Council, having considered this petition, is not satisfied that the decision derogates from the attainment of the objectives of the broadcasting policy for Canada set out in subsection 3(1) of the Broadcasting Act (see footnote a);

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act (see footnote b), hereby declines to refer Broadcasting Decision CRTC 2009-673 of October 27, 2009 back to the Commission for reconsideration and hearing with respect to the application by the Canadian Broadcasting Corporation for a broadcasting licence to operate an English-language FM radio programming undertaking to replace its existing AM station CFWH in Whitehorse, Yukon.
