CANADA TRAVELLING EXHIBITIONS INDEMNIFICATION ACT

Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 5 of the Canada Travelling Exhibitions Indemnification Act (see footnote a), hereby makes the annexed Regulations Amending the Canada Travelling Exhibitions Indemnification Regulations.
REGULATIONS AMENDING THE CANADA TRAVELLING EXHIBITIONS INDEMNIFICATION REGULATIONS
AMENDMENT
1. Section 10 of the Canada Travelling Exhibitions Indemnification Regulations (see footnote 1) is replaced by the following:
10. Within 15 days after the applicant assumes responsibility for the safeguarding of an object or appurtenance that is the subject of an indemnity agreement, the applicant shall file with the Minister a condition report describing the physical condition of the object or appurtenance as of the time that the applicant accepts responsibility for its safeguarding.
COMING INTO FORCE
2. These Regulations come into force on the day on which they are registered.

Issue and objectives
These amendments are being undertaken to correct a discrepancy between the two official language versions of section 10 of the Canada Travelling Exhibitions Indemnification Regulations, in response to a request made by the Standing Joint Committee for the Scrutiny of Regulations. As a result of these changes, both language versions of the Regulations will be consistent with one another as well as better reflecting the current practices of the museums community and the administration of the Canada Travelling Exhibitions Indemnification Program.
Description and rationale
Section 10 establishes responsibility for submitting a condition report to the Minister. Currently, the English version refers to the “owner” whereas the French version refers to “le propriétaire ou, s’il est autorisé par celui-ci, le demandeur.”
By making minor amendments to the French and English versions of the Regulations so as to refer to “the applicant” and “le demandeur” respectively, this discrepancy will be eliminated and ensure proper concordance between the French and English texts. In addition, these amendments will establish that it is the applicant (le demandeur) who is required to provide a condition report, thus eliminating the requirement imposed on the owner (le propriétaire). As such, the amendment is entirely administrative in nature and will have no major impact on the current practice within the museums community regarding submissions of the initial condition report to the Minister or to the ongoing administration of the Regulations by the Canada Travelling Exhibitions Indemnification Program.
Consultation
In view of the nature of the amendment and because it will not have a substantive impact on stakeholders, no external consultation was carried out.
