AN ACT TO AMEND THE CREE-NASKAPI (OF QUEBEC) ACT

Order Fixing February 1, 2010 as the Date of the Coming into Force of Certain Sections of the Act

Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to subsection 33(1) of An Act to amend the Cree-Naskapi (of Quebec) Act, chapter 12 of the Statutes of Canada, 2009, hereby fixes February 1, 2010 as the day on which that Act, other than sections 1, 3 to 5, 7, 8, 15 to 21, 25 and 27, comes into force.

EXPLANATORY NOTE

The Order fixes February 1, 2010 as the day on which An Act to amend the Cree Naskapi (of Quebec) Act (the “Act”) comes into force, other than sections 1, 3 to 5, 7, 8, 15 to 21, 25 and 27, pursuant to section 33 of that Act.

The Act amends the Cree-Naskapi (of Quebec) Act in respect of Cree bands and Category IA land by providing the Cree Regional Authority with additional responsibilities and powers, including by-law making powers, and by recognizing the Crees of Oujé-Bougoumou as a separate band and a local government under the Cree-Naskapi (of Quebec) Act. The Order brings into force the provisions of the Act that provide the Cree Regional Authority with additional responsibilities and powers, including by-law making powers.

The provisions of the Act that recognize the Crees of Oujé-Bougoumou as a separate band and a local government under the Cree-Naskapi (of Quebec) Act, sections 1, 3 to 5, 7, 8, 15 to 21, 25 and 27, come into force, as specified in subsection 33(2) of the Act, on the day on which land is set aside by the Governor in Council as Category IA land for the exclusive use and benefit of the collectivity known as the Crees of Oujé-Bougoumou. In accordance with section 32 of the Act, notice of the date that the land is set aside shall be published in the Canada Gazette.
