Regulations Amending the Food and Drug Regulations (1437 — Maximum Residue Limits for Veterinary Drugs)

Her Excellency the Governor General in Council, on the recommendation of the Minister of Health, pursuant to subsection 30(1) (see footnote a) of the Food and Drugs Act (see footnote b), hereby makes the annexed Regulations Amending the Food and Drug Regulations (1437 — Maximum Residue Limits for Veterinary Drugs).

AMENDMENTS

1. The portion of item K.1 of Table III to Division 15 of Part B of the French version of the Food and Drug Regulations (see footnote 1) in column IV is replaced by the following:

Issue and objectives

The amendment to the Food and Drug Regulations (the Regulations), Project 1437, was published in Canada Gazette, Part II, on September 17, 2008. On January 28, 2009, Health Canada was advised by the Standing Joint Committee for the Scrutiny of Regulations (SJCSR) of two instances where the word “kidneys” was used in the English version but was not consistently translated in the French version.

This miscellaneous amendment to the Regulations is necessary to amend the French version to ensure that the French interpretation of the word is consistent with the English use of the word “kidneys.”

Description and rationale

Changes to Table III to Division 15 of the Food and Drug Regulations can only be accommodated by regulatory amendment.

On January 28, 2009, by letter, the General Counsel for the SJCSR advised Health Canada that review of the Regulations (1437 — Maximum Residue Limits for Veterinary Drugs) revealed that, in two instances, the equivalent translation of the English word “kidneys” appeared as the term “reins” in the French version, while elsewhere the term used was “rognons.” The Committee further advised that the terminology in the French version should be rendered consistent. “Rognons” is the correct term in this case as it refers to kidneys served as food while “reins” is an anatomical term.

Health Canada, in its June 30, 2009 letter of response to the SJCSR, committed to correction of the identified discrepancies by amendment to the Regulations. There is no anticipated increase in cost to government from the administration of these amendments nor does the issue present any perceived risk. The amendments will permit accurate and consistent translation of the English word “kidney” in the French version of the Regulations.

Consultation

As these proposed miscellaneous amendments were initiated on the advice of the SJCSR and no undue impact on other areas or sectors was anticipated, no consultation was undertaken.
