PUBLIC SERVICE EMPLOYMENT ACT

Student Employment Programs Participants Exclusion Approval Order

Whereas the Public Service Commission has decided that it is neither practicable nor in the best interests of the public service to apply certain provisions of the Public Service Employment Act (see footnote a) to participants in the Federal Student Work Experience Program, the Research Affiliate Program, the Post-Secondary Co-op/Internship Program or any other student employment program established by the Treasury Board after consultation with the Public Service Commission, for the purposes of hiring and during the course of their employment under the program;

And whereas, pursuant to subsection 20(2) of that Act, the Public Service Commission has consulted with the employer;

Therefore, the Public Service Commission, pursuant to section 20 of the Public Service Employment Act (see footnote b), hereby

(a) re-applies the provisions of the Public Service Employment Act (see footnote c) to the persons and positions that were excluded by Order in Council P.C. 1997-488 of April 8, 1997 (see footnote d); and

(b) excludes the application of that Act, other than section 2, subsections 15(1) and (2), sections 16 to 21, 24, 25, 29, 34, 54, 55, 66 to 72, 111 to 122, 134 and 135 of that Act to participants in the Federal Student Work Experience Program, the Research Affiliate Program, the Post-Secondary Co-op/Internship Program or any other student employment program established by the Treasury Board after consultation with the Public Service Commission, for the purposes of hiring and during the course of their employment under the program.

Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 20 of the Public Service Employment Act (see footnote e), hereby approves

(a) the re-application by the Public Service Commission of the provisions of the Public Service Employment Act (see footnote f) to the persons and positions that were excluded by Order in Council P.C. 1997-488 of April 8, 1997 (see footnote g); and

(b) the exclusion by the Public Service Commission from the application of that Act, other than section 2, subsections 15(1) and (2), sections 16 to 21, 24, 25, 29, 34, 54, 55, 66 to 72, 111 to 122, 134 and 135 of that Act to participants in the Federal Student Work Experience Program, the Research Affiliate Program, the Post-Secondary Co-op/Internship Program or any other student employment program established by the Treasury Board after consultation with the Public Service Commission, for the purposes of hiring and during the course of their employment under the program.

EXPLANATORY NOTE

(This note is not part of the Order.)

By the Order, the Governor General in Council approves the exclusion of participants in certain student employment programs established by the Treasury Board from the application, for the purposes of hiring and during the course of their employment under the program, of the provisions of the Public Service Employment Act other than the following provisions:

(a) section 2 (definitions);

(b) subsections 15(1) and (2) (exercise of powers and functions by deputy heads);

(c) section 16 (compliance with appointment policies);

(d) sections 17 to 19 (Commission audits);

(e) section 20 to 21 (Exclusions and Regulations of Governor in Council);

(f) sections 24 and 25 (deputy heads);

(g) section 29 (Commission’s exclusive authority to appoint);

(h) section 34 (area of selection);

(i) section 54 (oath or affirmation);

(j) section 55 (effective date of appointment or deployment);

(k) sections 66 to 72 (investigation of appointments by the Commission);

(l) sections 111 to 122 (political activities);

(m) section 134 (authority to administer oaths and affirmations); and

(n) section 135 (access by the Commission).

The exclusion replaces the previous exclusion approved by Order in Council P.C. 1997-488 of April 8, 1997.
