His Excellency the Governor General in Council, on the recommendation of the Minister of Fisheries and Oceans, hereby makes the annexed Regulations Amending Certain Department of Fisheries and Oceans Regulations (Miscellaneous Program), pursuant to

(a) section 43 (see footnote a) and subsection 87(2) of the Fisheries Act (see footnote b); and

(b) subsection 35(3) of the Oceans Act (see footnote c).

REGULATIONS AMENDING CERTAIN DEPARTMENT OF FISHERIES AND OCEANS REGULATIONS (MISCELLANEOUS PROGRAM)

FISHERIES ACT

ATLANTIC FISHERY REGULATIONS, 1985

1. Subsection 3(5) of the Atlantic Fishery Regulations, 1985 (see footnote 1) is replaced by the following:

(5) Sections 13 to 14, 17, 17.1, 39 to 45 and 46 to 50, subsection 51.3(1) and sections 51.4, 52, 54, 57, 61, 61.1, 63, 66, 68, 69, 70.1 to 72, 74, 77, 78, 80, 82, 83, 87, 90, 91, 99, 106, 106.1 and 108 to 115.1 do not apply with respect to fishing and related activities carried out under the authority of a licence issued under the Aboriginal Communal Fishing Licences Regulations.

2. Section 45.1 of the Regulations is repealed.

OCEANS ACT

ENDEAVOUR HYDROTHERMAL VENTS MARINE PROTECTED AREA REGULATIONS

24. Section 1 of the Endeavour Hydrothermal Vents Marine Protected Area Regulations (see footnote 7) is replaced by the following:

1. The area of the Pacific Ocean — the seabed, the subsoil and the waters superjacent to the seabed — that is bounded by a line drawn from a point at 47°54′N, 129°02′W, from there west to a point at 47°54′N, 129°08′W, from there north to a point at 48°01′N, 129°08′W, from there east to a point at 48°01′N, 129°02′W, and from there south to the point of beginning, is hereby designated as a marine protected area to be known as the Endeavour Hydrothermal Vents Marine Protected Area (the “Area”). In these Regulations, all geographical coordinates (latitude and longitude) are expressed in the North America Datum 1983 (NAD83) geodetic reference system.

MUSQUASH ESTUARY MARINE PROTECTED AREA REGULATIONS

25. The definition “vessel” in subsection 1(1) of the Musquash Estuary Marine Protected Area Regulations (see footnote 8) is replaced by the following:

“vessel” has the same meaning as in section 2 of the Canada Shipping Act, 2001. (bâtiment)

26. Paragraph 4(d) of the French version of the Regulations is replaced by the following:

27. (1) The portion of section 3 of the French version of the Bowie Seamount Marine Protected Area Regulations (see footnote 9) before paragraph (a) is replaced by the following:

REGULATORY IMPACT
ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Issue and objectives

This regulatory amendment will provide more clear and concise regulations, which will minimize the possibility of misinterpretation of the affected provisions by correcting errors, omissions and inconsistencies. It will also address issues raised by the Standing Joint Committee for the Scrutiny of Regulations (SJCSR). Amendments will be made to certain regulations under the Fisheries Act and Oceans Act.

Description and rationale

Under the Fisheries Act, minor corrections will be made to the Pacific Fishery Management Area Regulations, 2007, Atlantic Fishery Regulations, 1985, Maritime Provinces Fishery Regulations and the Marine Mammal Regulations to correct errors and inconsistencies noted by Fisheries and Oceans Canada and the SJCSR. Minor corrections will also be made to the Fisheries (General) Regulations to better reflect the original intent.

Under the Oceans Act, minor corrections will be made to the Bowie Seamount Marine Protected Area Regulations, Musquash Estuary Marine Protected Area Regulations and the Endeavour Hydrothermal Vents Marine Protected Areas as a result of inconsistent terminology and minor errors, and inconsistencies noted by the SJCSR.

The amendments being made to the regulations are as follows:

Fisheries Act

1. Pacific Fishery Management Area Regulations, 2007: Amendments requested by the SJCSR, in a letter dated July 10, 2008, are being addressed. The SJCSR found inconsistencies between the English and French versions of the Regulations regarding descriptions of geographical features. Changes will be made to the French version to reflect the English Regulations. The SJCSR and the Department of Fisheries and Oceans (DFO) regional offices have also identified amendments to ensure that certain geographical coordinates for Schedule II, Management Area Boundary Descriptions are described correctly.

2. Atlantic Fishery Regulations, 1985: Amendments will be made and will bring the Regulations up-to-date by repealing provisions which are no longer applicable. These provisions can be found in Part V: Pelagics, under the Herring section, Part VIII: Groundfish under the Catching and Landing of Groundfish section and Part X: Tuna, under the Landing of Tuna section. All these provision make reference to permission of landing which can be made only if a fishery officer inspects the fishing vessel for the catch. The provisions are being repealed because the conditions stated have already been accounted for through license conditions and dockside monitors at the port of landing. As monitors are not employees or agents of the crown, they do not represent DFO, rendering the sections redundant because DFO uses other oversight alternatives.

As well, an amendment requested by the SJCSR, in a letter dated March 5, 2009, will be made to clarify a boundary description to ensure the Regulations, both English and French, remain clear and concise to the public. Currently, the manner in which the Regulations are written brings uncertainty to the interpretation and may be reason to cause a boundary dispute.

3. Maritime Provinces Fishery Regulations (MPFR): The amendment will change the description of inland water boundary locations in Schedule II of the MPFR that have been altered due to new highways having been built in the West River of Pictou and Canaan River. The locations are exactly the same, but the references to the roads have changed.

4. Marine Mammal Regulations: The amendment will correct a typographical error on the map of Schedule III, Part IV, where the fishing area should be labelled as Area 26 and not area 31. The map had undergone an amendment in November 2004; however, the error was never corrected.

5. Fishery (General) Regulations: Amendments requested by the SJCSR, in a letter dated January 27, 2010, will replace wording in both the English and French versions, as the previous text did not reflect the original intent. The intention was to ensure that where a variation order is made, notice of the variation shall be given to those persons who are affected. This will be done by publishing the notice in the next available issue of a sport fishing publication, rather than publishing the notice in the current issue of a sport fishing publication.

Oceans Act

6. Bowie Seamount Marine Protected Area Regulations: Amendments requested by the SJCSR, in a letter dated November 12, 2008, involving inconsistent use of the term “living marine organism”, as well as improper use of the terms “foreign vessel” vs. “foreign ship” between the English and French versions of the Regulations. These changes will be made to the French version of the Regulations, and will be amended to more accurately reflect the English version. The SJCSR also noted that the French version of the Regulations needed to be more precise, and so the words “dans la zone” will be added, where necessary, to sections 3, 4, 5 and 6 of the French Regulations.

7. Musquash Estuary Marine Protected Area Regulations: Amendments requested by the SJCSR, in a letter dated September 10, 2008, involving inconsistent reference of the word “vessel”. The English and French version will be amended to reflect the new definition of “vessel” under the new Canada Shipping Act, 2001. As well, amendments are being made to ensure the appropriate use of the word “authorization”. Since the English version appropriately uses the term, the French version of the Regulations will be amended to reflect the English version more accurately.

8. Endeavour Hydrothermal Vents Marine Protected Area Regulations: The amendment will add statements to both the English and French versions of the Regulations to clarify how the coordinates are expressed to reflect the North America Datum 1983 geodetic reference system. Currently, this reference is missing in the Regulations.

The amendments are of a technical nature with many having been brought to DFO’s attention by the SJCSR. The impact of the proposed amendment is expected to be minimal to none, with the intent that all changes will provide greater clarity for the end user. Not making these changes would leave the regulations in an ambiguous state.

Consultation

As the amendments to the regulations are minor and administrative in nature, it was determined that consultation was not necessary.
