FARM PRODUCTS AGENCIES ACT

Regulations Amending the Canadian Chicken Licensing Regulations

Whereas the Governor in Council has, by the Chicken Farmers of Canada Proclamation (see footnote a), established Chicken Farmers of Canada (“CFC”) pursuant to subsection 16(1) (see footnote b) of the Farm Products Agencies Act (see footnote c);

And whereas CFC has been empowered to implement a marketing plan pursuant to that Proclamation;

Therefore, Chicken Farmers of Canada, pursuant to paragraph 22(1)(f) of the Farm Products Agencies Act (see footnote d) and section 11 (see footnote e) of the schedule to the Chicken Farmers of Canada Proclamation (see footnote f), hereby makes the annexed Regulations Amending the Canadian Chicken Licensing Regulations.

REGULATIONS AMENDING THE CANADIAN CHICKEN LICENSING REGULATIONS

AMENDMENTS

1. (1) The definition “processor” in section 1 of the Canadian Chicken Licensing Regulations (see footnote 1) is replaced by the following:

“processor” means a person who is engaged in the business of processing and otherwise marketing chicken. (transformateur)

(2) The definition “marketing” in section 1 of the English version of the Regulations is replaced by the following:

“marketing”, in relation to chicken, live or in processed form, includes selling or offering it for sale or buying, pricing, assembling, packing, processing, transporting or storing it or any other act that is necessary to prepare it in a form, or to make it available at a place and time, for purchase for consumption or use. (3) The definition “associate” in section 1 of the Regulations is amended by striking out “and” at the end of paragraph (e) and by adding the following after paragraph (f):

  • (g) an employer or employee of that person; and
    (h) an officer or director of that person’s business. (lien)

2. Subsection 4(4) of the Regulations is replaced by the following:

(4) If a licensee fails, during the period of validity of the licence, to fulfil a condition set out in subsection 5(1) or (3), their obligation to comply with the unfulfilled condition is to survive the expiration or revocation of the licence.

3. (1) Paragraph 5(1)( b ) of the French version of the Regulations is replaced by the following:

  • b) il doit fournir aux PPC, dans les sept jours suivant sa réception, une copie du document qui est délivré au nom des PPC par l’Office de commercialisation de la province où sont situées ses installations de production agréées et qui précise soit le contingent qui lui a été alloué soit le nombre de kilogrammes de poulet qu’il est autorisé par ailleurs à produire;

(2) Paragraph 5(3)(b) of the English version of the Regulations is replaced by the following:

  • (b) the licensee must submit a market development commitment form to CFC, or to any Provincial Commodity Board or person authorized by CFC, at least seven days before the day on which CFC allocates the quota for the period indicated in section 1 of the market development commitment form;

(3) Subparagraph 5(3)(i.01)(vii) of the Regulations is replaced by the following:

  1. (vii) a declaration that is capable of being audited by a third party and that establishes the dry weight and, by reference to section 1 of Schedule 2, the product categories of any chicken referred to in section 2 of the market development commitment form that has been marketed under a licence;

(4) Paragraph 5(4)(b) of the Regulations is replaced by the following:

  • (b) the primary processor from whom the licensee purchased the chicken does not claim the live weight equivalent of the number of kilograms of chicken against his or her own market development commitment under paragraph (3)(d), and has declared, in the form set out in Schedule 3, that the chicken is being claimed by the licensee to meet the licensee’s market development commitment and has sent a copy of the declaration within seven days after the day on which it is signed to CFC, the Provincial Commodity Board and the licensee.

4. Subection 8(2) of the English version of the Regulations is replaced by the following:

(2) CFC may refuse to issue a licence to an applicant if any associate or affiliated body of the applicant has failed to comply with a condition of any licence issued under these Regulations.

5. Subsection 9(3) of the Regulations is replaced by the following:

(3) A decision on whether to refuse to issue or renew a licence or to suspend or revoke a licence is to be made by CFC taking into account the circumstances that gave rise to the intention referred to in subsection (1) and the representations, if any, made by the applicant or the licensee.

(4) Despite subsections (1) to (3), a market development licence is to be automatically suspended if the holder fails to comply with subsection 11.2(3) of the Canadian Chicken Marketing Levies Order.

6. Schedule 1 to the Regulations is amended by replacing “(Section 1 and subparagraph 5(3)(i.01)(vii))” after the heading “SCHEDULE 1” with “(Section 1)”.

7. Section 3 of Schedule 2 to the French version of the Regulations is replaced by the following:

Le poulet ou son équivalent en poids vif est commercialisé sur le marché interprovincial ou d’exportation auprès de n’importe quel acheteur pour quelque utilisation finale que ce soit, sauf dans le cas où le poulet ou son équivalent en poids vif relève des catégories de produits 3, 7 ou 8 et est commercialisé sur le marché interprovincial, dans un tel cas il est commercialisé auprès de personnes détenant chacune une lettre de confirmation quant au volume visé par la politique d’expansion du marché délivré par le ministère des Affaires étrangères et du Commerce international et pour l’utilisation finale visée dans la lettre.

COMING INTO FORCE

8. These Regulations come into force on the day on which they are registered.

EXPLANATORY NOTE

(This note is not part of the Regulations.)

These amendments make changes to certain provisions of the Regulations to clarify certain terminology used in the Regulations, to make grammatical corrections, to make references within the Regulations internally consistent, and to make the English and French versions of the Regulations more consistent with each other.
