AN ACT TO AMEND THE CRIMINAL CODE (SUICIDE BOMBINGS)

Order Fixing November 30, 2011 as the Day on which An Act amending the Criminal Code (suicide bombings) Comes into Force

His Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to section 2 of An Act to amend the Criminal Code (suicide bombings), chapter 19 of the Statutes of Canada, 2010, hereby fixes November 30, 2011 as the day on which that Act comes into force.

EXPLANATORY NOTE

An Act to amend the Criminal Code (suicide bombings), Bill S-215 (the Act), received Royal Assent on December 15, 2010, and will come into force at a date to be determined by order of the Governor General in Council. It is now Chapter 19, Statutes of Canada, 2010.

The Act amends the definition of “terrorist activity” in subsection 83.01(1) of the Criminal Code to clarify that it includes suicide bombings when committed for a terrorist purpose. At present, the definition of “terrorist activity” is set out in subsection 83.01(1) of the Criminal Code. The first part of the definition of “terrorist activity” incorporates, in part, criminal conduct as envisaged by the International Convention for the Suppression of Terrorist Bombings. The second part of the definition of “terrorist activity” includes an act which intentionally causes death or serious bodily harm or endangers a person’s life. Thus, suicide bombing, when committed for a terrorist purpose, falls within the definition of “terrorist activity” of the Criminal Code.

The Act comes into force on November 30, 2011.
