AN ACT RESPECTING THE MANDATORY REPORTING OF INTERNET CHILD PORNOGRAPHY BY PERSONS WHO PROVIDE AN INTERNET SERVICE

Order Fixing December 8, 2011 as the Day on which the Act Comes into Force

His Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to section 13 of An Act respecting the mandatory reporting of Internet child pornography by persons who provide an Internet service, chapter 4 of the Statutes of Canada, 2011, hereby fixes December 8, 2011 as the day on which that Act comes into force.

EXPLANATORY NOTE

The Order fixes December 8, 2011, as the coming into force date of An Act respecting the mandatory reporting of Internet child pornography by persons who provide an Internet service (the Act), which received Royal Assent on March 23, 2011, as Chapter 4 of the Statutes of Canada, 2011.

Under the Act, providers of Internet services are required to report to a designated organization tips that they might receive regarding Web sites where child pornography may be available to the public and to notify police and safeguard evidence if they believe that a child pornography offence has been committed using an Internet service that they provide.

The Internet Child Pornography Reporting Regulations provide the enabling framework for the legislation by naming the designated organization (Canadian Centre for Child Protection), elaborating its role, functions and activities, and elaborating the manner in which service providers discharge their duties under the Act. The Regulations come into force on December 8, 2011.
