Regulations Amending the Canada Pension Plan (Social Insurance Numbers) Regulations

His Excellency the Governor General in Council, on the recommendation of the Minister of Human Resources and Skills Development, pursuant to subsection 101(1) (see footnote a) of the Canada Pension Plan (see footnote b), makes the annexed Regulations Amending the Canada Pension Plan (Social Insurance Numbers) Regulations.

REGULATIONS AMENDING THE CANADA PENSION PLAN
(SOCIAL INSURANCE NUMBERS) REGULATIONS

AMENDMENTS

1. The definition “Minister” in section 2 of the Canada Pension Plan (Social Insurance Numbers) Regulations (see footnote 1) is repealed.

2. (1)The portion of subsection 3(2) of the Regulations before paragraph (a) is replaced by the following:

(2) Every individual who changes their name, by reason of marriage or otherwise, and who is required by the Act to inform the Minister of their new name shall do so by delivering or mailing to a local office of the Commission a notification, in the form prescribed for that purpose, containing

(2) Paragraph 3(2)(a) of the English version of the Regulations is replaced by the following:

  • (a) the information required by subsection (1) in respect of an application for the assignment of a Social Insurance Number;

(3) The portion of subsection 3(3) of the Regulations before paragraph (a) is replaced by the following:

(3) Every individual whose Card has been lost or destroyed may apply to the Minister for a new Card by delivering or mailing to a local office of the Commission an application, in the form prescribed for that purpose, containing

(4) Paragraphs 3(3)(a) and (b) of the English version of the Regulations are replaced by the following:

  • (a) the information required by subsection (1) in respect of an application for the assignment of a Social Insurance Number; and
  • (b) their Social Insurance Number, or if it is unknown, a statement that they were previously assigned a Social Insurance Number.

(5) Subsection 3(4) of the English version of the Regulations is amended by replacing “him” with “them” and “he” with “they”, with any necessary modifications.

3. Paragraph 4(d) of the Regulations is replaced by the following:

  • (d) any office of the Department of Human Resources and Skills Development.

4. Section 5 of the Regulations is replaced by the following:

5. An employer who requires an employee to inform them of their Social Insurance Number shall provide the employee with the appropriate form to apply for a Social Insurance Number or Card if the employer ascertains that the employee

  • (a) has not had a Social Insurance Number assigned to them;
  • (b) has changed their name since their Social Insurance Number was assigned; or
  • (c) has lost their Social Insurance Card or it has been destroyed.

5. Section 6 of the Regulations is replaced by the following:

(1) If an employee fails to inform their employer of their Social Insurance Number within the period set out in subsection 98(6) of the Act, the employer shall, within three days after the expiry of the period, report the circumstances of the failure to the local office of the Commission and provide it with the information necessary to identify the employee.

(2) If an employee who has been reported under subsection (1) subsequently informs the employer of their Social Insurance Number, the employer shall immediately notify the local office of the Commission.

6. Sections 7 and 8 of the Regulations are replaced by the following:

7. The Minister or the Minister of National Revenue may cause a Social Insurance Number to be assigned to an individual who has not been assigned a Social Insurance Number.

8. The Minister or the Minister of National Revenue may cause a Card to be issued to an individual to whom a Social Insurance Number was caused to be assigned under section 7.

7. The English version of the Regulations is amended by replacing “his” with “their”, with any necessary modifications, in the following provisions:

  • (a)the definition “local office of the Commission” in section 2; and
  • (b)paragraphs 3(1)(a) to (f) and paragraphs 3(2)(b) and (c).

COMING INTO FORCE

8. These Regulations come into force on April 30, 2013.
