Regulations Amending the First Nations Property Assessment and Taxation (Railway Rights-of-Way) Regulations

His Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to paragraph 36(1)(d) of the First Nations Fiscal Management Act (see footnote a), makes the annexed Regulations Amending the First Nations Property Assessment and Taxation (Railway Rights-of-Way) Regulations.

Amendments

1 The definition track in place in section 1 of the First Nations Property Assessment and Taxation (Railway Rights-of-Way) Regulations (see footnote 1) is replaced by the following:

track in place has the same meaning as track in place of a railway corporation in subsection 21(15) of the Assessment Act of British Columbia, as amended from time to time. (voie ferrée existante)

2 The portion of subsection 3(1) of the French version of the Regulations before paragraph (a) is replaced by the following:

3 (1) Sous réserve du paragraphe (2), tout texte législatif relatif à l’imposition foncière des propriétés situées dans une zone d’emprise doit prévoir que l’évaluateur détermine la valeur imposable des types de propriétés ci-après en recourant aux taux d’évaluation, rajustements, exceptions, inclusions et exclusions qui s’appliqueraient si ces propriétés étaient assujetties aux lois fiscales provinciales :

3 Paragraph 4(4)(a) of the Regulations is replaced by the following:

4 The portion of paragraph 1(b) of Schedule 1 to the French version of the Regulations in column 2 is replaced by the following:

Coming into Force

7 These Regulations come into force on the day on which they are registered.
