EXPLANATORY NOTE

(This note is not part of the Order.)

In 2005, Health Canada’s Pest Management Regulatory Agency (PMRA) established the List of Pest Control Product Formulants and Contaminants of Health or Environmental Concern (referred to hereafter as “the List”). In accordance with paragraph 43(5)(b) of the Pest Control Products Act (PCPA), the identity and concentration of a formulant or contaminant that appears on the List are not protected from disclosure in the way that confidential business information is otherwise protected under the PCPA. Consequently, the public is entitled to access such information.

The PMRA’s Regulatory Directive DIR2006-02, Formulants Policy and Implementation Guidance Document outlines how formulants of concern are identified. Meanwhile, contaminants of concern are identified as chemicals designated for reduction and/or elimination under an international treaty/convention that Canada has ratified or a Canadian government policy/risk management strategy. Additionally, a formulant or contaminant is only included on the List if it is found in pest control products that are currently registered in Canada. These criteria and the process for updating and maintaining the List are set out in Science Policy Note 2020-01.

Since the establishment of the List in 2005, the criteria for establishing the List have been updated to reflect current scientific knowledge and new convention/agreement/treaty commitments, allowing for more responsive regulation and enhanced protection of public health and the environment. Meanwhile, the formulants and contaminants that are present in registered pest control products have also changed.
