Her Excellency the Governor General in Council, considering that the collection of certain amounts is unreasonable and unjust, on the recommendation of the Treasury Board and the President of the Treasury Board, pursuant to subsection 23(2.1) footnote a of the Financial Administration Act footnote b, makes the annexed Certain Unauthorized Reimbursements Made Under the Public Service Health Care Plan Remission Order.

Certain Unauthorized Reimbursements Made Under the Public Service Health Care Plan Remission Order

Definition of Plan

1 In this Order, Plan means the Public Service Health Care Plan.

Remission

2 (1) Remission is granted to persons described in subsection (2) of amounts equal to the reimbursements the persons received for eligible expenses, as described in the Public Service Health Care Plan Directive, under the terms of the Plan during the relevant period, less amounts the persons paid as contributions in accordance with the terms of the Plan during the relevant period.

Persons to whom remission is granted

(2) For the purpose of subsection (1), a person is granted remission if they were enrolled in error in the Plan when they were not eligible to join the Plan and

Relevant period

(3) For the purpose of subsection (1), the relevant period is the period that begins on the day that a person described in subsection (2) was enrolled in error in the Plan and ends on the earlier of the day that this Order is made and the day that the person died.

EXPLANATORY NOTE

(This note is not part of the Order.)

Pursuant to subsection 23(2.1) of the Financial Administration Act, the Certain Unauthorized Reimbursements Made Under the Public Service Health Care Plan Remission Order remits past reimbursements paid under the Public Service Health Care Plan to former employees of the Freshwater Fish Marketing Corporation and of the Canadian Wheat Board, and their dependants, who are or were in receipt of a pension benefit under the Public Service Superannuation Act but who were not eligible to join the Plan.
