The Canadian Environmental Assessment Agency (the Agency) re-declares that commercial guiding activities in the Northern National Parks of Canada contained in the Parks Canada model class screening report (MCSR) no longer need to undergo individual environmental assessments.

Parks Canada has conducted a model class screening for projects within a designated class, to account for location-specific or project-specific information and to record a conclusion on the significance of the environmental effects of that project. The details of this model class screening are provided in the MCSR on commercial guiding activities in the Northern National Parks of Canada.

Public consultation on the MCSR took place from February 10 to March 11, 2011. The Agency received no written submissions from the public during this period. The Agency has reviewed the MCSR and has determined that the project screening process, as described in the document, meets the requirements of the Canadian Environmental Assessment Act (the Act) for the environmental assessment of this particular class of projects. It is also the Agency’s opinion that the class of projects described in the MCSR is not likely to cause significant adverse environmental effects when the design standards and mitigation measures described in the report are applied.

The re-declaration is effective May 26, 2011, and is subject to certain conditions, including the following:

  • The Agency agrees with Parks Canada that the re-declaration is valid until May 26, 2021;
  • The Agency will place the MCSR in the Canadian Environmental Assessment Registry (the Registry) at www.ceaa-acee.gc.ca; and
  • On a quarterly basis, Parks Canada will post on the Registry a statement of the projects for which the MCSR was applied, as required under the Act.

The Agency has reviewed the RCSR and has determined that the project screening process, as described in the document, meets the requirements of the Canadian Environmental Assessment Act (the Act) for the environmental assessment of the particular class of projects. It is also the Agency’s opinion that the class of projects described in the RCSR is not likely to cause significant adverse environmental effects when the design standards and mitigation measures described in the report are applied.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

EXPIRY REVIEW OF FINDINGS

Copper pipe fittings

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that it will, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiate an expiry review of its findings (Expiry Review No. RR-2011-001) made on February 19, 2007, in Inquiry No. NQ-2006-002, concerning the dumping of solder joint pressure pipe fittings and solder joint drainage, waste and vent pipe fittings, made of cast copper alloy, wrought copper alloy or wrought copper, for use in heating, plumbing, air conditioning and refrigeration applications (copper pipe fittings), originating in or exported from the United States of America, the Republic of Korea and the People’s Republic of China and the subsidizing of copper pipe fittings originating in or exported from the People’s Republic of China, restricted to the products enumerated in the Appendix (the subject goods).

Notice of Expiry No. LE-2011-001, issued on April 12, 2011, informed interested persons and governments of the impending expiry of the findings. On the basis of the information filed, the Tribunal is of the opinion that an expiry review of the findings is warranted. The Tribunal has notified the Canada Border Services Agency (CBSA), as well as other interested persons and governments, of its decision.

The Tribunal has issued a Draft Guideline on Expiry Reviews that can be found on the Tribunal’s Web site at www.citt-tcce.gc.ca. In this expiry review, the CBSA must determine whether the expiry of the findings in respect of the subject goods is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods.

If the CBSA determines that the expiry of the findings in respect of any goods is likely to result in the continuation or resumption of dumping and/or subsidizing, the CBSA will provide the Tribunal with the information that is required under the Canadian International Trade Tribunal Rules. The Tribunal will then conduct an expiry review to determine if the continued or resumed dumping and/or subsidizing is likely to result in injury or retardation. The Tribunal will issue its order no later than February 17, 2012, and its statement of reasons no later than March 2, 2012.

If the CBSA determines that the expiry of the findings in respect of any goods is unlikely to result in the continuation or resumption of dumping and/or subsidizing, the Tribunal will not consider those goods in its subsequent determination of the likelihood of injury or retardation and will issue an order rescinding the findings with respect to those goods.

The CBSA must provide notice of its determination within 120 days after receiving notice of the Tribunal’s decision to initiate an expiry review, that is, no later than September 29, 2011. The CBSA will also notify all persons or governments that were notified by the Tribunal of the commencement of an expiry review, as well as any others that participated in the CBSA’s investigation.

Letters have been sent to parties with a known interest in the expiry review providing them with the schedule respecting both the CBSA’s investigation and the Tribunal’s expiry review, should the CBSA determine that the expiry of the findings in respect of any goods is likely to result in a continuation or resumption of dumping and/or subsidizing.

The CBSA will conduct its investigation pursuant to the provisions of SIMA and the administrative guidelines set forth in the Anti-dumping and Countervailing Directorate’s publication entitled Guidelines on the Conduct of Expiry Review Investigations under the Special Import Measures Act. Any information submitted to the CBSA by interested persons concerning this investigation is deemed to be public information unless clearly designated as confidential. Where a submission is confidential, a non-confidential edited version or summary of the submission must also be provided which will be disclosed to interested parties upon request.

With respect to the CBSA’s investigation, the schedule specifies, among other things, the date for the filing of replies to the expiry review questionnaires, the date on which the CBSA exhibits will be available to parties to the proceeding, the date on which the administrative record will be closed and the dates for the filing of submissions by parties in the proceeding. Further information regarding the CBSA’s investigation can be obtained by contacting the CBSA officer as mentioned below.

Tribunal’s expiry review

Should the CBSA determine that the expiry of the findings in respect of any goods is likely to result in a continuation or resumption of dumping and/or subsidizing, the Tribunal will conduct its expiry review, pursuant to the provisions of SIMA and its Draft Guideline on Expiry Reviews, to determine if there is a likelihood of injury or retardation. The schedule for the Tribunal’s expiry review specifies, among other things, the date for the filing of replies by domestic producers to Part E of the expiry review questionnaire, the date for the filing of updated information from domestic producers, importers and exporters to the expiry review questionnaire replies, the date on which information on the record will be made available by the Tribunal to interested parties and counsel that have filed notices of participation and the dates for the filing of submissions by interested parties.

The Tribunal’s Guide to Making Requests for Product Exclusions, which can be found on the Tribunal’s Web site at www.citt-tcce.gc.ca, describes the procedure for filing requests for specific product exclusions. This Guide also includes a form for filing requests for product exclusions and a form for any party that opposes a request to respond to such requests. This does not preclude parties from making submissions in a different format if they so wish, provided all of the information and supporting documentation requested in the forms are included. Requests to exclude goods from the findings shall be filed by interested parties no later than noon, on November 30, 2011. Parties opposed or consenting or not opposed to the request for exclusion shall file written reply submissions no later than noon, on December 7, 2011. Should a request for a specific product exclusion be opposed, and if the interested party wishes to reply, it must do so no later than noon, on December 14, 2011.

Under section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why the information is designated as confidential. Furthermore, the person must submit a non-confidential edited version or non-confidential summary of the information designated as confidential or a statement indicating why such an edited version or summary cannot be made.

Public hearing

The Tribunal will hold a public hearing relating to this expiry review in the Tribunal’s Hearing Room No. 1, 18th Floor, Standard Life Centre, 333 Laurier Avenue W, Ottawa, Ontario, commencing January 9, 2012, at 9:30 a.m., to hear evidence and representations by interested parties.

Each interested person or government wishing to participate at the hearing as a party must file a notice of participation with the Secretary on or before October 11, 2011. Each counsel who intends to represent a party at the hearing must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before October 11, 2011.

To allow the Tribunal to determine whether simultaneous interpretation will be required for the hearing, each interested person or government filing a notice of participation and each counsel filing a notice of representation must advise the Secretary, at the same time that they file their notice, whether they and their witnesses will be using English or French or both languages at the hearing.

The Canadian International Trade Tribunal Rules govern these proceedings.

In order to observe and understand production processes, the Tribunal, accompanied by its staff, may conduct plant visits.

There were no submissions from affected parties to the screening officer with respect to any of the above claims for exemption and related MSDSs or label.

Each of the claims for exemption listed above was found to be valid. The screening officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations. Having regard for the various data readily available in the literature and any information provided by the claimant, the screening officer found that the respective MSDS in respect of which the claims bearing Registry Numbers 7330, 7427, 7470, 7502, 7629, 7630, 7666, 7669, 7722, 7736, 7774, 7805, 7806, 7837, 7852, 7866, and 8031 were filed, complied with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

In the case of the claims bearing Registry Numbers 7172, 7480, 7484, 7573 and 7591, being a claim from an employer in the province of Alberta, the screening officer found that the MSDSs relating to these claims did not comply with the applicable disclosure requirements of the Occupational Health and Safety Code 2009 of the Province of Alberta.

In the case of the claim bearing Registry Number 7326, being a claim from an employer in the province of Ontario, the screening officer found that the MSDS relating to this claim did not comply with the applicable disclosure requirements of the Occupational Health and Safety Act of the Province of Ontario.

In the case of the claim bearing Registry Number 8031, being a claim from an employer in the province of Alberta, the screening officer found that the MSDS in respect of which the claim was filed complied with the applicable disclosure requirements of the Occupational Health and Safety Code 2009 of the Province of Alberta.

In all cases where the material safety data sheet or the label was determined not to be in compliance with the relevant legislation, the screening officer offered the claimant the possibility of entering into an undertaking whereby the claimant would voluntarily make the changes necessary to bring the MSDS or the label into compliance. Pursuant to subsection 16.1(1) of the Hazardous Materials Information Review Act, the claimant was given 30 days to provide the screening officer with a signed undertaking accompanied by the MSDS or the label amended as necessary.

In the case of the following claims, the claimant supplied the screening officer with a signed undertaking accompanied by the MSDS or label amended as necessary within the time frame specified. The screening officer was satisfied that the claimant had taken the measures set out in the undertaking in the manner and within the period specified therein.

CLAIMS WHERE THE SCREENING OFFICER WAS SATISFIED THAT THE CLAIMANT HAD TAKEN THE MEASURES SET OUT IN THE UNDERTAKING

Pursuant to paragraph 18(1)(b) of the Hazardous Materials Information Review Act, the Chief Screening Officer of the Hazardous Materials Information Review Commission hereby gives notice of any information that has been disclosed on the relevant material safety data sheet or label in compliance with an undertaking.

The claimant had been advised to amend certain aspects of the content of the MSDS. The claimant had been further advised to amend the MSDS as indicated below.

1. Disclose that an ingredient in the controlled product has been shown to be corrosive to the eyes of laboratory animals;

2. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be washed gently with water for 20 minutes or until the chemical is removed;

3. In relation to the first aid information shown on the MSDS for eye contact, disclose a statement to the effect that the eyes should be flushed continuously with water for 30 minutes;

Pursuant to paragraphs 18(1)(a) and 18(1)(b) of the Hazardous Materials Information Review Act, this notice includes certain information which, in the opinion of the screening officer, should have been shown on the relevant MSDS or label.

Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.

Pursuant to subsection 24(3) of the Controlled Products Regulations, amended labels must be available in both official languages.

Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal a decision or order of a screening officer. It also affords the opportunity to an affected party to appeal an undertaking. To initiate the appeal process, a Statement of Appeal (Form 1) as prescribed by the Hazardous Materials Information Review Act Appeal Board Procedures Regulations must be completed and delivered within 45 days of the publication of this notice in the Canada Gazette, Part I, to the Chief Appeals Officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3, 613-998-2363.
