Announcement of planned actions to assess and manage, where appropriate, the risks posed by certain substances to the health of Canadians and the environment

ANNEX

Plan to Address Certain Substances on the Domestic Substances List

The Minister of the Environment and the Minister of Health (the Ministers) will implement a series of actions regarding substances identified in this announcement to protect the health of Canadians and the environment from the potential effects of exposure to these substances where warranted.

1. Background and rationale for action

The Canadian Environmental Protection Act, 1999 (CEPA 1999) required the Ministers to categorize all substances that are on the Domestic Substances List (DSL) by virtue of section 66 of the Act in order to identify those (1) that are persistent and/or bioaccumulative (based on the Persistence and Bioaccumulation Regulations) and inherently toxic to humans or other organisms, or (2) that present, or may present, to individuals in Canada, the greatest potential for exposure. CEPA 1999 further requires that the Government conduct a screening assessment on each of the substances found to meet the categorization criteria. Any substances determined to meet the criteria under section 64 may be subject to risk management measures. The Government completed the categorization exercise in 2006. Out of the approximately 23 000 substances subject to categorization, about 4 300 were identified as requiring screening assessments. These substances became a focus for further work under Canada’s Chemicals Management Plan (CMP), launched on December 8, 2006. The Ministers have committed to addressing these substances by 2020 in support of an international framework, the Strategic Approach to International Chemicals Management, which has an overall objective of achieving the sound management of chemicals throughout their life cycle so that, by 2020, chemicals are produced and used in ways that minimize significant adverse impacts on human health and the environment.

The first phase of the CMP strengthened health and environmental protection by supporting an integrated, Government-wide approach to chemicals assessment and management and providing business certainty and public confidence through a predictable, science-based regulatory regime. The CMP included a number of initiatives, including the Challenge, which addressed approximately 200 high-priority substances identified during categorization. The assessment phase of the Challenge is nearing completion and the majority of final screening assessments will have been published by December 2011. Other initiatives in the CMP included the rapid screening of substances of lower concern, restrictions on the re-introduction and new uses of certain substances and the petroleum sector stream approach. Of the 4 300 substances identified as priorities for further action, approximately 1 100 have been addressed and 3 200 remain.

The initiative within this announcement builds on the first phase of the CMP by identifying approximately 500 substances in nine groups that have been selected as the next round of priorities and that are planned to be assessed over the coming five years.

In addition to these nine groups of substances, the Ministers plan to complete the assessments of petroleum sector stream substances and of other priority substances identified through the first phase of the CMP, and to address approximately 1 000 additional substances through other approaches such as a rapid screening approach of low volume or low hazard substances. In addition, in order to address the balance of the remaining priority substances efficiently, the Minister of the Environment plans to issue an update of the DSL. Basic information will be requested from industry in order to update the status of these substances in Canadian commerce.

2. Approach

This initiative retains the features of the Challenge that were found to be highly effective such as predictable timelines and early stakeholder engagement, while organizing substances in structural or functional groups to maximize the effectiveness and efficiencies in the risk assessment and risk management processes. This “grouping” approach should also facilitate stakeholder engagement and the identification of alternatives by chemical manufacturers and users.

3. Scope

This announcement covers approximately 500 substances in nine groups that were selected as priorities for further action during the categorization exercise completed in 2006 and considers new information received since that date. The groups account for structural or functional similarities, as well as considerations related to assessment efficiencies, management efficiencies, the ability to support informed substitution decisions and timing of international actions.

The nine groups of substances considered under this announcement will be known for the purposes of this initiative as follows:

  • aromatic azo- and benzidine-based substances;
  • substituted diphenylamines;
  • cobalt-containing substances;
  • methylenediphenyl diisocyanates and diamines (MDI/MDA);
  • certain internationally classified substances with potential for exposure to individuals in Canada;
  • selenium-containing substances;
  • certain organic flame retardants;
  • phthalates; and
  • boron-containing substances.

Eight of the groups in this announcement are being publicly identified as priorities for the first time. The aromatic azo- and benzidine-based substances group was the subject of a notice of intent published on June 5, 2010, in the Canada Gazette, Part Ⅰ, and is included in the current announcement of planned actions because it is considered part of the overall initiative and will follow a similar process to the other eight groups. 4. Planned actions

The Ministers will implement a series of actions regarding these substances to protect the health of Canadians and the environment from the potential effects associated with exposure to these substances. These actions may include, where warranted, information gathering, risk assessment, risk management, research and monitoring. Major producers, importers and users of these substances will continue to be expected to provide information to support risk assessment and risk management and to demonstrate that chemicals are being used safely.

Specifically, the Ministers plan to take the following actions to implement this initiative:

  • The Ministers will provide opportunities for stakeholders to engage in discussions on the groups of substances, associated data needs and on potential information-gathering exercises under section 71 of CEPA 1999. Discussion on generation and submission of other information to inform decision-making may also take place, including, but not limited to, information on physical, chemical and toxicological properties and uses and releases to the environment.
  • The Ministers will take into account all relevant information and conduct assessments on the substances in a phased manner to determine whether the substances meet one or more of the criteria set out under section 64 of CEPA 1999.
  • The Ministers will release draft assessments for a 60-day public comment period, including their proposal to pursue one of the measures specified under subsection 77(2) of CEPA 1999, where applicable. Discussions with stakeholders on risk management will be initiated at the time of the draft assessment publication, when risk management action is proposed; information on potential risk management actions will be issued, with an opportunity for stakeholders to provide comments. Comments received will be considered prior to the release of final assessments and final recommendations under subsection 77(6) or paragraphs 68(b) and (c) of CEPA 1999, where applicable. Upon recommending an addition to Schedule 1, further information on possible risk management will be issued at the same time as the final assessment publication, outlining actions the Government proposes to take to protect Canadians and their environment from risks associated with these substances.
  • Within five years of the commencement of this initiative, the Ministers will complete assessments of all of the substances in the groups covered in this announcement. Timelines are being tailored to the needs of individual groups, allowing for consideration of stakeholder engagement as well as risk assessment and risk management requirements. 5. Stakeholder engagement

Stakeholder engagement has been crucial to the success of the first phase of the CMP and will have an equally important role in the next phase. The Ministers will continue to make information on chemical substances publicly available so that Canadians, non-governmental organizations, the Canadian business community and other stakeholders can actively participate in this initiative. Opportunities for stakeholder engagement will occur at predictable junctures for each group of substances, and will include

  • preliminary engagement to allow stakeholders to provide input into approaches for information collection, assessment and management, as appropriate, and to voluntarily submit information that is not publicly available;
  • data collection initiatives, including notices under section 71 of CEPA 1999;
  • public comment periods on risk assessment and risk management documents; and
  • consultations during the selection and development of risk management instruments.

Proposed amendments to the Determination of Country of Origin for the Purposes of Marking Goods (Non-NAFTA Countries) Regulations

The Government is seeking views from interested parties regarding proposed amendments to the Determination of Country of Origin for the Purposes of Marking Goods (Non-NAFTA Countries) Regulations. It is the Government’s intention to replace Schedule II to the Regulations with the schedule set out below. This proposed change would replace the list of goods exempt from marking with the list of marking exemptions that is currently found in the Determination of Country of Origin for the Purposes of Marking Goods (NAFTA Countries) Regulations.

Background

Budget 2011 announced a commitment to modernize Canada’s Customs Tariff with a view to facilitating trade and lowering the administrative burden of businesses and government. The proposed change would apply the same exemptions for marking purposes to goods imported from a non-NAFTA country as those that apply to goods imported from a NAFTA country. The NAFTA exemptions are broader than those in the existing non-NAFTA list and are more effective at ensuring that manufacturing inputs are not subject to country-of-origin marking.

Submissions

Interested parties wishing to comment on the proposed amendments should submit their views in writing by November 18, 2011. Interested parties should focus on the impact that the proposed marking exemptions would have on the products of interest to them.

Proposed amendments to the Determination of Country of Origin for the Purposes of Marking Goods (NAFTA Countries) Regulations

The Government is seeking views from interested parties regarding proposed amendments to the Determination of Country of Origin for the Purposes of Marking Goods (NAFTA Countries) Regulations. It is the Government’s intention to delete references to packaging and related operations from the general provisions of these Regulations and to replace Schedule III to the Regulations with the schedule set out below.

Background

Budget 2011 announced a commitment to modernize Canada’s Customs Tariff with a view to facilitating trade and lowering the administrative burden of businesses and government. In order to be eligible for preferential tariff treatment under NAFTA, certain goods must qualify both as originating, under the NAFTA Annex 401 — Specific Rules of Origin, and as eligible to be marked as a good of one of the NAFTA countries. The proposed deletion of packaging and related operations from the general provisions of these Regulations would be consistent with recent liberalizing changes made to the NAFTA Annex 401 — Specific Rules of Origin. As well, the proposed replacement of Schedule III to the Regulations with the schedule set out below would result in the current list of “tariff shift” rules of origin being replaced by a list of updated and more liberal rules of origin. These changes would better align Canada’s marking rules for NAFTA countries with current market conditions. Although the draft rules of origin in the schedule below are aligned with the current version of the Harmonized System, prior to the coming into force of such rules of origin, they would be adjusted to reflect the 2012 amendments to come to the Harmonized System.

Proposed amendment to the Proof of Origin of Imported Goods Regulations

The Government is seeking views from interested parties regarding a proposed amendment to the Proof of Origin of Imported Goods Regulations. It is the Government’s intention to add a new subsection to section 6 of these Regulations to waive the North American Free Trade Agreement (NAFTA) Certificate of Origin requirement of subsection 35.1(1) of the Customs Act for locomotives of headings 86.01 and 86.02 and railway freight cars of heading 86.06 transported overland from the United States into Canada and for which NAFTA preferential tariff treatment is claimed.

Background

Canadian rail carriers compete in an integrated North American marketplace, with rail equipment regularly crossing the border between the United States and Canada. As such, a regulatory environment that is cost-effective and harmonized with that of the United States is important for the rail industry.

Locomotives and railway rolling stock used in North American freight service are almost exclusively manufactured in North America and, therefore, would qualify for duty-free entry into Canada under the NAFTA if accompanied by a NAFTA Certificate of Origin. Since 2000, locomotives and freight railcars have been allowed to enter the United States without the need for NAFTA certification. The proposed change will provide the same treatment to such goods entering Canada.

The objective of this proposal is to facilitate railway operations and the management of railway equipment, as well as the movement of locomotives and freight railcars in common commercial use between the United States and Canada. This proposal is in line with the Budget 2011 commitment to streamline Canada’s Customs Tariff with a view to facilitating trade and lowering the administrative burden of businesses and government.

Interested parties wishing to comment on the proposed amendment should submit their views in writing by November 18, 2011. Interested parties should focus on the impact that the proposed waiver of the NAFTA Certificate of Origin requirement for locomotives and railway freight cars would have on them.

Notice is hereby given that Industry Canada is releasing the following documents:

  1. CB-01, Issue 4, Requirements for Certification Bodies;
  2. CB-02, Issue 6, Recognition Criteria, and Administrative and Operational Requirements Applicable to Certification Bodies for the Certification of Radio Apparatus to Industry Canada’s Standards and Specifications;
  3. DES-CB, Issue 3, Procedure for the Designation of Canadian Certification Bodies by Industry Canada; and
  4. DES-LAB(E), Issue 5, Procedure for Designation and Recognition of Canadian Testing Laboratories by Industry Canada.

The following changes have been introduced:

  1. CB-01 has been updated in Issue 4 to apply to both Canadian and foreign certification bodies (CBs), by moving existing requirements for foreign CBs from REC-CB into CB-01. This update consolidates the recognition procedures in a single document. With the release of this update, CB-01 will supersede REC-CB.
  2. The Cross-Reference Checklist table, formerly in Appendix II of CB-01, Issue 3, has been moved to Annex A of CB-02, Issue 6. This will allow updates to CB-02 in the future without affecting CB-01. The table has also been updated with regard to the changes introduced in CB-02, Issue 6.
  3. The product audit section of CB-02, Issue 6, has been updated to provide clarifications on audit requirements. This update clarifies how to calculate the number of products to be targeted for audit by the certification bodies within a calendar year.
  4. References to ISO/IEC standards have been changed from specific editions to the latest editions in all the above documents.
  5. Contact information for Industry Canada has been updated in all the above documents.

CB-01, Issue 4; CB-02, Issue 6; DES-CB, Issue 3; and DES-LAB(E), Issue 5, will come into effect upon publication of this notice.

Technical Standards Document No. 305, Electrolyte Spillage and Electrical Shock Protection — Revision 3

Notice is hereby given, pursuant to section 12 of the Motor Vehicle Safety Act and sections 16 and 17 of the Motor Vehicle Safety Regulations, that the Department of Transport has revised Technical Standards Document (TSD) No. 305, Electrolyte Spillage and Electrical Shock Protection, which specifies requirements for limitation of electrolyte spillage, retention of electric energy storage/conversion devices, and protection from harmful electric shock during and after a crash.

Revision 3 of TSD No. 305 is effective as of the date of publication of this notice and will become enforceable six months thereafter.

TSD No. 305, Electrolyte Spillage and Electrical Shock Protection, reproduces U.S. Federal Motor Vehicle Safety Standard No. 305, Electric-powered vehicles: electrolyte spillage and electrical shock protection, and is incorporated by reference in section 305 of the Motor Vehicle Safety Regulations. This revision replicates the regulatory text of the Final Rule issued by the National Highway Traffic Safety Administration (NHTSA) of the United States Department of Transportation that was published in the Federal Register of July 29, 2011 (Vol. 76, No. 146, p. 45436). This revision is introduced to respond to petitions for reconsideration of the NHTSA’s Final Rule of June 14, 2010, by addressing issues related to the scope, the definitions, the retention requirements for electric energy storage/conversion systems, the electrical isolation requirements, the test specifications and requirements for electrical isolation monitoring, and the state-of-charge of electric energy storage devices prior to the crash tests.
