CANADA ENERGY REGULATOR

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES

Macquarie Energy Canada Ltd.

By an application dated March 9, 2020, Macquarie Energy Canada Ltd. (the “Applicant”) has applied to the Commission of the Canada Energy Regulator (the “Commission”), under Division 2 of Part 7 of the Canadian Energy Regulator Act (the “Act”), for authorization to export up to 4 380 000 MWh of combined firm and interruptible energy annually for a period of 10 years.

The Commission wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The directions on procedure that follow explain in detail the procedure that will be used.

  1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at 181 Bay Street, Suite 3100, Toronto, Ontario M5J 2T3; copies are also available from the Applicant’s Legal Director for Commodities and Global Markets, 1‑713‑275‑6107 (telephone), CGMLegalHouston@macquarie.com (email). The Applicant shall provide a copy of the application to any person who requests one. A copy of the application is available for viewing during normal business hours, by appointment, in the Canada Energy Regulator’s library, at 517 Tenth Avenue SW, 2nd Floor, Calgary, Alberta T2R 0A8.   2. Submissions that any party wishes to present shall be filed with the Secretary of the Commission of the Canada Energy Regulator, 517 Tenth Avenue SW, Suite 210, Calgary, Alberta T2R 0A8, 403‑292‑5503 (fax), and served on the Applicant by April 13, 2020.
  3. Pursuant to subsection 359(2) of the Act, the Commission is interested in the views of submitters with respect to
    • (a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported; and
    • (b) whether the Applicant has
      • (i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
      • (ii) given an opportunity to buy electricity on conditions as favourable as the conditions specified in the application to those who, within a reasonable time after being so informed, demonstrate an intention to buy electricity for consumption in Canada.
  4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Commission and served on the party that filed the submission by April 28, 2020.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File No. PR-2019-044) on March 6, 2020, with respect to a complaint filed by Bluenose Transit Inc., of Cambridge, Nova Scotia, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. W0102-20019D/A) by the Department of Public Works and Government Services on behalf of the Department of National Defence (DND). The solicitation was to establish a Regional Individual Standing Offer for the charter of 40 to 48 passenger activity buses (with operator) for the purpose of transporting Regular Force, cadets, and Militia personnel from 14 Wing Greenwood, Nova Scotia, to various locations within the Atlantic provinces for DND 14 Wing Transportation Section, Greenwood, Nova Scotia.

Having examined the evidence presented by the parties, the Tribunal determined that the complaint was valid in part.

RECOMMENCEMENT OF INQUIRY (E-REGISTRY PILOT PROJECT)

Certain fabricated industrial steel components

On February 28, 2020, the Federal Court of Appeal referred back to the Canadian International Trade Tribunal its finding (Inquiry No. NQ-2016-004R) of May 25, 2017, in Inquiry No. NQ-2016-004, for redetermination of the denial of exclusion requests made by LNG Canada Development Inc., Suncor Energy Inc. and Fluor Canada Ltd. (the requesters). The Tribunal hereby gives notice that it has recommenced its inquiry to make such a redetermination.

The Tribunal invites parties interested in participating in this inquiry to file a notice of participation with the Tribunal on or before March 11, 2020. Each counsel who intends to represent a party in this proceeding must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before March 11, 2020.

This proceeding will be conducted by way of written submissions. Any of the requesters listed above wishing to file a submission must do so no later than March 18, 2020. Domestic producers and supporting parties who wish to respond to the above submissions must do so no later than March 25, 2020. Submissions should consist of arguments strictly in relation to the proposed wording of the exclusions, as set out in paragraph 36 of the Federal Court of Appeal’s reasons for judgment (reasons), including whether any additions are necessary and appropriate, as set out in paragraph 43 of the reasons. No new or supplemental evidence will be accepted.

The Tribunal will endeavour to make its decision before June 26, 2020.

Notice of representation, as well as a declaration and undertaking, should be filed electronically through the Tribunal’s Secure E-filing Service.

Following receipt of the notices of participation and the declaration of undertakings, the Tribunal will send a letter to counsel and parties with information on the E-Registry Service pilot and the filing of written submissions.

REQUEST FOR PANEL REVIEW

Fabricated structural steel from Canada

Notice is hereby given, in accordance with the Special Import Measures Act (as amended by the North American Free Trade Agreement Implementation Act), that on February 28, 2020, a Request for Panel Review of the final determination made by the United States Department of Commerce, International Trade Administration, respecting “Certain Fabricated Structural Steel from Canada,” was filed by counsel for Industries Canatal Inc. and Les Constructions Beauce-Atlas Inc. (CBA) with the United States Section of the NAFTA Secretariat, pursuant to Article 1904 of the North American Free Trade Agreement.

The final determination was published in the Federal Register, on January 30, 2020 [85 Fed. Reg. 5373].

The panel review will be conducted in accordance with the NAFTA Article 1904 Panel Rules. Subrule 35(1)(c) of the above-mentioned rules provides that

EXPLANATORY NOTE

Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.

These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.

Under Article 1904 of the North American Free Trade Agreement, which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These rules were published in the Canada Gazette, Part I, on January 1, 1994, and as amended on March 29, 2008.
