Consultations on policy proposals to include in regulations under the Prohibition on the Purchase of Residential Property by Non-Canadians Act

On August 19, 2022, the Government of Canada launched consultations inviting interested Canadians and stakeholders to share their views on policy proposals to include in regulations being developed under the Prohibition on the Purchase of Residential Property by Non-Canadians Act (the “Act”).

Background

In Budget 2022, the Government of Canada announced its intention to prohibit non-Canadians from purchasing residential property in Canada for a period of two years. On June 23, 2022, the Parliament of Canada passed legislation, the Prohibition on the Purchase of Residential Property by Non-Canadians Act, which will come into force on January 1, 2023. The Act prohibits foreign commercial enterprises and people who are neither Canadian citizens nor permanent residents from acquiring non-recreational, residential property in Canada for a period of two years.

The Government of Canada is working to finalize certain details in regulations under the Act, to be brought forward prior to the coming into force of the Act on January 1, 2023. These include certain definitions and clarifications, as well as details of exceptions previously announced by the Government of Canada in Budget 2022.

Consultations

The purpose of this consultation is to seek feedback from interested Canadians and stakeholders on policy proposals to include in regulations being developed to finalize the implementation of the prohibition on the purchase of residential property by non-Canadians.

These policy proposals are set out in a consultation document released by the Canada Mortgage and Housing Corporation (CMHC), which can be found on the CMHC website.

All interested parties are invited to read the consultation document and submit their written input to CMHC, by September 16, 2022. Input can be sent to the following email address: cmhcfeedback@cmhc.ca.
