NOTICE OF FILING OF AN APPLICATION FOR A PERMIT TO BUILD AND OPERATE AN INTERNATIONAL POWER LINE

Application by Hydro-Québec for a permit to build and operate a direct current power line from the Hertel substation to the Champlain Hudson Power Express project in the United States

On July 8, 2022, under section 248 of the Canadian Energy Regulator Act, Hydro-Québec (the Applicant) filed an application with the Canada Energy Regulator (CER) for a permit to build and operate a 400 kV direct current international power line. The selected route for the power line covers approximately 58 km (underground) from the Hertel substation in the municipality of La Prairie, to a point in the municipality of Lacolle, at the border between Quebec and New York State, United States.

The Commission of the CER (Commission) informs all interested persons that it is now initiating a preliminary technical analysis of the application. Upon completion of its analysis, a second notice will invite all interested persons to submit their comments to the CER before the Commission makes any decision about the permit application. To the extent possible, the Commission wishes to minimize duplications with the provincial regulatory process, namely, the environmental assessment process conducted by the Ministère de l’Environnement et de la Lutte contre les changements climatiques (Québec department of the environment and the fight against climate change), including all public hearing consultation sessions held by the Bureau d’audiences publiques sur l’environnement (BAPE) [Québec office for public hearings on the environment].

In the meantime, the Commission encourages all interested parties to submit any comments or concerns they may have directly to the Applicant and to participate in the assessment being carried out as part of the provincial regulatory process, including the BAPE.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

Body armour

The Canadian International Trade Tribunal has received a complaint (File PR-2022-045) from M.D. Charlton Co. Ltd. (M.D. Charlton), of Victoria, British Columbia, concerning a procurement (Solicitation WS3264674520 [M2989-222403]) made by the Department of Public Works and Government Services (PWGSC) on behalf of the Royal Canadian Mounted Police. The solicitation was for the provision of “Instant Armor-Tac III with Blanket System (5 Panels) with hardcase attachment package” body armour. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on October 11, 2022, to conduct an inquiry into the complaint.

M.D. Charlton alleges that by proceeding with a directed, non-competed solicitation, by further failing to conduct an advance contract award notice to identify all potential suppliers, and by failing to publicly publish contract award notices within the required time period, PWGSC violated multiple provisions of the Canadian Free Trade Agreement.
