Withdrawal from Disposal of Certain Tracts of Territorial Lands in the Northwest Territories (Ts’ude niline Tu’eyeta (Ramparts River and Wetlands)) Order

His Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to paragraph 23(a) of the Territorial Lands Act (see footnote a), hereby makes the annexed Withdrawal from Disposal of Certain Tracts of Territorial Lands in the Northwest Territories (Ts’ude niline Tu’eyeta (Ramparts River and Wetlands)) Order.

WITHDRAWAL FROM DISPOSAL OF CERTAIN TRACTS OF TERRITORIAL LANDS IN THE NORTHWEST TERRITORIES (TS’UDE NILINE TU’EYETA (RAMPARTS RIVER AND WETLANDS)) ORDER

PURPOSE

1. The purpose of this Order is to withdraw from disposal certain tracts of territorial lands for the reason that the lands may be required as a candidate protected area, through the Northwest Territories Protected Areas Strategy, as identified in Section 26 of the Sahtu Dene and Metis Comprehensive Land Claim Agreement.

LANDS WITHDRAWN FROM DISPOSAL

2. The tracts of territorial lands set out in Schedule 1, including the surface and subsurface rights to the lands, and the tracts of territorial lands set out in Schedule 2, including the subsurface rights to the lands, are withdrawn from disposal for the period beginning on the day on which this Order is made and ending on November 30, 2013.

EXCEPTIONS

DISPOSITION OF SUBSTANCES OR MATERIALS

3. Section 2 does not apply to the disposition of substances or materials under the Territorial Quarrying Regulations.

EXISTING RIGHTS AND INTERESTS

4. For greater certainty, section 2 does not apply to

  • (a) the locating of a mineral claim by the holder of a prospecting permit granted before the day on which this Order is made;
  • (b) the recording of a mineral claim that is referred to in paragraph (a) or that was located before the day on which this Order is made;
  • (c) the granting of a lease under the Northwest Territories and Nunavut Mining Regulations to a person with a recorded claim, if the lease covers an area in the recorded claim;
  • (d) the issuance of a significant discovery licence under the Canada Petroleum Resources Act to a holder of an exploration licence that was issued before the day on which this Order is made, if the significant discovery licence covers an area subject to the exploration licence;
  • (e) the issuance of a production licence under the Canada Petroleum Resources Act to a holder of a significant discovery licence that is referred to in paragraph (d), if the production licence covers an area subject to the significant discovery licence;
  • (f) the issuance of a production licence under the Canada Petroleum Resources Act to a holder of an exploration licence or a significant discovery licence that was issued before the day on which this Order is made, if the production licence covers an area subject to the exploration licence or the significant discovery licence;
  • (g) the issuance of a surface lease under the Territorial Lands Act to a holder of a recorded claim under the Northwest Territories and Nunavut Mining Regulations or of an interest under the Canada Petroleum Resources Act, if the surface lease is required to allow the holder to exercise rights under the claim or interest; or
  • (h) the renewal of an interest.

REPEAL

5. The Order Respecting the Withdrawal from Disposal of Certain Lands in the Northwest Territories (Ts’ude niline Tu’eyeta (Ramparts River and Wetlands)) (see footnote 1) is repealed.

All that parcel of land more particularly described as follows, all topographic features hereinafter referred to being according to:

Edition 2 of the Ramparts River map sheet number 106G of the National Topographic System produced at a scale of 1:250,000 by the Canada Centre for Mapping, Department of Energy, Mines and Resources, at Ottawa;

Edition 2 of the Sans Sault Rapids map sheet number 106H of the National Topographic System produced at a scale of 1:250,000 by the Canada Centre for Mapping, Department of Energy, Mines and Resources, at Ottawa;

Edition 2 of the Fort Good Hope map sheet number 106I of the National Topographic System produced at a scale of 1:250,000 by the Surveys and Mapping Branch, Department of Energy, Mines and Resources, at Ottawa;

Edition 2 of the Ontaratue River map sheet number 106J of the National Topographic System produced at a scale of 1:250,000 by the Surveys and Mapping Branch, Department of Energy, Mines and Resources, at Ottawa;

Commencing at a point at the intersection of the easterly boundary of the Gwich’in Settlement Area (as defined in Appendix A of the Gwich’in Comprehensive Land Claim Agreement) with latitude 66°23′49″ North at approximate longitude 132°00′08″ West;

Thence northeasterly in a straight line to the intersection of latitude 66°33′39″ North and longitude 131°31′41″ West;

Thence northeasterly in a straight line to the intersection of latitude 66°38′52″ North and longitude 130°59′31″ West;

Thence easterly in a straight line to the intersection of latitude 66°39′58″ North and longitude 130°34′01″ West;

Thence southeasterly in a straight line to the intersection of latitude 66°37′57″ North and longitude 130°09′19″ West;

Thence southeasterly in a straight line to the intersection of latitude 66°29′36″ North and longitude 129°21′04″ West;

Sub-surface withdrawal of Sahtu Parcels 14 and a portion of 21, and Sahtu Specific Site FGH57 (surveyed as lot 1001, quad 106 I/4 and recorded in the Canada Lands Surveys Records under plan 81322 CLSR), Sahtu Specific Site FGH56 (surveyed as lot 1000, quad 106 I/4 and recorded in the Canada Lands Surveys Records under plan 79041 CLSR), Sahtu Specific Site FGH27 (surveyed as lot 1002, quad 106 I/3 and recorded in the Canada Lands Surveys Records under plan 81323 CLSR), Sahtu Specific Site FGH55 (surveyed as lot 1001, quad 106 I/3 and recorded in the Canada Lands Surveys Records under plan 79040 CLSR) and Sahtu Specific Site FGH59 (surveyed as lot 1001, quad 106 H/12 and recorded in the Canada Lands Surveys Records under plan 81324 CLSR), within the proposed withdrawal area to the ordinary high-water mark which is under the administration and control of the Minister of Indian Affairs and Northern Development, excluding all third party interest administered by that Minister.

Containing an area of approximately 387.47 km2.

EXPLANATORY NOTE

(This note is not part of the Order.)

The Order repeals the Order Respecting the Withdrawal from Disposal of Certain Lands in the Northwest Territories (Ts’ude niline Tu’eyeta (Ramparts River and Wetlands)), made by Order in Council P.C. 2007-1660 dated November 1, 2007, as registered as SI/2007-102, and makes a new Withdrawal from Disposal of Certain Tracts of Territorial Lands in the Northwest Territories (Ts’ude niline Tu’eyeta (Ramparts River and Wetlands)) Order for the reason that the lands may be required as a candidate protected area, through the Northwest Territories Protected Areas Strategy, as identified in Section 26 of the Sahtu Dene and Metis Comprehensive Land Claim Agreement, for the period beginning on the day on which this Order is made and ending on November 30, 2013.
