Order Amending the List of Wildlife Species at Risk (Decisions Not to Add Certain Species) Order (Miscellaneous Program)

Her Excellency the Governor General in Council, on the recommendation of the Minister of the Environment, pursuant to subsection 27(1.2) of the Species at Risk Act footnote a, makes the annexed Order Amending the List of Wildlife Species at Risk (Decisions Not to Add Certain Species) Order (Miscellaneous Program).

Amendment

1 The Annex of the French version to the List of Wildlife Species at Risk (Decisions Not to Add Certain Species) Order footnote 1 is amended by replacing “TAC global de 2015 : 2 000 tonnes” with “TAC global de 2015 : 2 000 t”.

Coming Into Force

2 This Order comes into force on the day on which it is registered.

Issues

On May 3, 2017, the Standing Joint Committee for the Scrutiny of Regulations (SJCSR) identified a number of technical issues with the French version of the annexed statement to the List of Wildlife Species at Risk (Decisions Not to Add Certain Species) Order (the Order) and has recommended that the regulations be amended to address these issues.

Objective

The amendments are intended to correct a discrepancy between the French and English versions of the Order as originally published on April 13, 2017.

Description

The Order was published in the Canada Gazette, Part II, on May 3, 2017, after the Governor in Council, on the recommendation of the Minister of the Environment, decided that the Atlantic bluefin tuna (ABT) and the yellowmouth rockfish not be added to the List of Wildlife Species at Risk (the List) set out in Schedule 1 to the Species at Risk Act. An annex to the Order sets out the reasons for the decisions not to add those species to the List.

Subsequently, and upon reviewing the Order, the Standing Joint Committee for the Scrutiny of Regulations identified an inconsistency in the unit of measurement used to describe the amount of total allowable catch (TAC) for the ABT between the English and French versions of the Annex to the Order. The fifth paragraph of the English version of the Annex refers to “2015 global TAC: 2 000 t”, while the French version refers to “TAC global de 2015 : 2 000 tonnes”.

According to the Weights and Measures Act, the French equivalent of “tonne” is “tonne métrique,” which is 1 000 kilograms. The symbol for this unit is “t” in both languages. In contrast, the word “tonne” in French is equivalent to “ton” in English, which is 2 000 pounds.

With respect to the fifth paragraph of the annexed statement to the Order, the intended unit of measurement used to describe the TAC for the ABT is the “metric ton” represented by the symbol “t” as used in the English version of the Annex. Therefore, the amendment corrects the French version from “tonne” to “t” in order to correspond to the English version.

Regulatory analysis

“One-for-One” Rule and small business lens

The “One-for-One” Rule does not apply to these amendments, as there is no change in administrative costs or burden to business. The small business lens does not apply to these amendments either, as there are no regulatory costs to small business.
