Coming into Force

3 (1) These Regulations, except subsections 1(2) and (3), come into force on the day on which they are registered.

(2) Subsection 1(2) comes into force on July 31, 2022.

(3) Subsection 1(3) comes into force on June 30, 2021.

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Issues

Pursuant to subsection 12(3) of the Apprentice Loans Act (the Act), these amendments were developed to amend Schedule 1 to the Apprentice Loans Regulations (the Regulations). They will ensure that the Red Seal trades currently designated by the Canadian Council of Directors of Apprenticeship (CCDA) are accurately reflected in the Regulations, and that all apprentices registered in a Red Seal trade program are eligible for Canada Apprentice Loans.

Background

The CCDA is a voluntary intergovernmental partnership among the provinces and territories and the federal government. The CCDA consists of 15 members, including one official from each province and territory and two federal government representatives from the Department of Employment and Social Development. The CCDA manages the Red Seal Program, which is responsible for apprenticeship training and trade certification.

In 2015, the Department of Employment and Social Development developed the Canada Apprentice Loan to enable apprentices registered in Red Seal trade programs to receive Canada Apprentice Loans to help cover the costs of technical training that forms part of apprenticeship programs. Schedule 1 to the Regulations lists all of the designated Red Seal trades in each province and territory and is regularly updated according to the CCDA Red Seal Program.

Subsection 12(3) of the Act permits the Minister of Employment and Social Development to amend Schedule 1 to the Regulations.

Objective

The objective of these regulatory amendments is to reflect changes made by the CCDA Red Seal Program. Furthermore, the amendments will ensure that the list of designated Red Seal trades in Schedule 1 to the Regulations is consistent with the Red Seal trade programs in each province and territory.

Description

The amendments to the Regulations will update the list of eligible trades in Schedule 1 to reflect changes by the CCDA Red Seal Program. These amendments include removing Electric Motor System Technician (EMST) and Rig Technician from Schedule 1, given that the CCDA will de-designate them as Red Seal trades on July 31, 2022, and June 30, 2021, respectively; updating the names of specific trades; and implementing updates to reflect the current provincial and territorial designations of Red Seal trades.

One-for-one rule

The one-for-one rule does not apply to these regulatory amendments, as there is no change in administrative costs to businesses.

Small business lens

The small business lens does not apply to these regulatory amendments, as there are no costs to small businesses.

Consultation

The amendments to Schedule 1 to the Regulations are operational in nature. They do not represent policy changes. No prepublication was required.

Rationale

The regulatory amendments will support the aforementioned objectives by ensuring that the list of all designated Red Seal trades remains up to date. By extension, this will ensure that all apprentices registered in a Red Seal trade are eligible for Canada Apprentice Loans.

Implementation, enforcement and service standards

The regulatory amendments updating the names of specific trades and implementing updates to reflect the current provincial and territorial designations of Red Seal trades will come into force the day they are registered by the Privy Council Office. The regulatory amendment to remove EMST will come into force on July 31, 2022, and the regulatory amendment to remove Rig Technician will come into force on June 30, 2021.
