Her Excellency the Governor General in Council, on the recommendation of the Minister of Employment and Social Development, pursuant to section 12 of the Apprentice Loans Actfootnote a and section 15footnote b of the Canada Student Financial Assistance Actfootnote c, makes the annexed Regulations Amending the Apprentice Loans Regulations.

Regulations Amending the Apprentice Loans Regulations

Amendments

1 (1) The definition severe permanent disability in subsection 1(1) of the Apprentice Loans Regulations footnote 1 is replaced by the following:

severe permanent disability
means any impairment, including a physical, mental, intellectual, cognitive, learning, communication or sensory impairment — or a functional limitation — that prevents a person from performing the daily activities necessary to participate in the labour force in a manner that is substantially gainful, as defined in section 68.1 of the Canada Pension Plan Regulations, and is expected to remain with the person for their expected life. (invalidité grave et permanente)

(2) The definition permanent disability in subsection 1(2) of the Regulations is replaced by the following:

permanent disability
means any impairment, including a physical, mental, intellectual, cognitive, learning, communication or sensory impairment — or a functional limitation — that restricts the ability of a person to perform the daily activities necessary to participate in an apprenticeship program or in the labour force and that is expected to remain with the person for the person’s expected life. (invalidité permanente)

(3) Subsection 1(2) of the Regulations is amended by adding the following in alphabetical order:

persistent or prolonged disability
means any impairment, including a physical, mental, intellectual, cognitive, learning, communication or sensory impairment — or a functional limitation — that restricts the ability of a person to perform the daily activities necessary to participate in an apprenticeship program or in the labour force and has lasted, or is expected to last, for a period of at least 12 months but is not expected to remain with the person for the person’s expected life. (invalidité persistante ou prolongée)

2 (1) Subparagraph 12(1)(b)(i) of the Regulations is replaced by the following:

Coming into Force

3 These Regulations come into force on August 1, 2022.
