TO ALL TO WHOM these presents shall come or whom the same may in any way concern,

GREETING:

A Proclamation

Whereas the Governor in Council, under subsection 16(1)footnote a of the Farm Products Agencies Act footnote b, by the Chicken Farmers of Canada Proclamation footnote c, established an agency known as Chicken Farmers of Canada;

Whereas paragraph 17(2)(c) of that Act provides that the Governor in Council may, by proclamation, amend the terms of a marketing plan that Chicken Farmers of Canada is empowered to implement or withdraw any of the powers set out in section 22footnote d of that Act that were previously vested in the agency;

Whereas paragraph 17(2)(f) of that Act provides that the Governor in Council may, by proclamation, provide for the manner of appointment of members of Chicken Farmers of Canada and a term of appointment of those members that varies from the manner and term provided in subsection 18(1) of that Act or from the manner and term provided in the proclamation establishing Chicken Farmers of Canada;

And whereas, by Order in Council P.C. 2023-363 of April 21, 2023, the Governor in Council directed that a proclamation do issue amending the Chicken Farmers of Canada Proclamation footnote c in accordance with the annexed schedule;

Now Know You that We, by and with the advice of Our Privy Council for Canada and under Order in Council P.C. 2023-363 of April 21, 2023, do by this Our Proclamation amend the Chicken Farmers of Canada Proclamation footnote c in accordance with the annexed schedule;

Of all which Our loving subjects and all others whom these presents may concern are required to take notice and to govern themselves accordingly.

In testimony whereof, We have caused this Our Proclamation to be published and the Great Seal of Canada to be affixed to it.

Our Right Trusty and Well-beloved Mary May Simon, Chancellor and Principal Companion of Our Order of Canada, Chancellor and Commander of Our Order of Military Merit, Chancellor and Commander of Our Order and Merit of the Police Forces, Governor General and Commander-in-Chief of Canada.

SCHEDULE

1 (1) The definition Canadian Restaurant and Food Service Association in section 1 of the schedule to the Chicken Farmers of Canada Proclamation footnote c is repealed.

(2) The definition chicken in section 1 of the schedule to the Proclamation is replaced by the following:

chicken
means chicken or any part of a chicken produced in Canada and marketed in interprovincial or export trade; (poulet)

(3) Paragraph (b) of the definition Commodity Board in section 1 of the schedule to the Proclamation is replaced by the following:

(4) Paragraph (d) of the definition Commodity Board in section 1 of the schedule to the Proclamation is replaced by the following:

(5) Paragraph (g) of the definition Commodity Board in section 1 of the schedule to the Proclamation is replaced by the following:

(6) Paragraph (j) of the definition Commodity Board in section 1 of the schedule to the Proclamation is replaced by the following:

(7) Section 1 of the schedule to the Proclamation is amended by adding the following in alphabetical order:

Restaurants Canada
means Restaurants Canada, a corporation established in Canada by letters patent dated January 6, 1944; (Restaurants Canada)

2 Subsection 2(3) of the schedule to the Proclamation is replaced by the following:

(3) Restaurants Canada may, at any time, appoint a person who is a resident of Canada and who is experienced in the business or trade of supplying prepared foods to consumers to be a member of CFC to hold office until the end of CFC’s annual meeting in the second calendar year following the year of appointment.

3 (1) The definition quota system in section 5 of the schedule to the Proclamation is replaced by the following:

means a system established by CFC under which the quantity, if any, of chicken of any variety, class or grade that may be marketed in interprovincial or export trade is fixed and determined, and quotas are allotted
  • (a) by CFC to producers in a non-signatory territory; and
  • (b) by the appropriate Board or Commodity Board on behalf of CFC to producers in a signatory province. (contingentement)

(2) Paragraphs (e) and (f) of the definition Board in section 5 of the schedule to the Proclamation are replaced by the following:

4 Section 9 of the schedule to the Proclamation is repealed.

5 Section 12.1 of the schedule to the Proclamation is replaced by the following:

12.1 Licence fees, levies or charges imposed by orders or regulations of CFC that are unpaid 30 days after the day on which they were due constitute a debt payable to CFC.
